McCabe, Rosenstein, et al and what charges could be brought?

Good day all. Last week, former Assistant Director, With the emphasis on “ASS”), started his book tour hawking his “I was trying to save the Republic by destroying the Republic” book. While it doesn’t contain a lot of new information, it does put all of the little bits into one, easy to read spot.

 

McCabe has also begun throwing his co-conspirators under the proverbial bus, starting with Deputy Attorney General Rod Rosenstein. I use the term co-conspirators intentionally. I’ve mentioned before that what these people did might not rise to the level of treason, a carefully defined law actually written into the Constitution, but that there were probably other laws they broke. I beleive I’ve found such a law.

That law is 18 U.S. Code §?2385. Advocating overthrow of Government. It states:

Whoever knowingly or willfully advocates, abets, advises, or teaches the duty, necessity, desirability, or propriety of overthrowing or destroying the government of the United States or the government of any State, Territory, District or Possession thereof, or the government of any political subdivision therein, by force or violence, or by the assassination of any officer of any such government; or

Whoever, with intent to cause the overthrow or destruction of any such government, prints, publishes, edits, issues, circulates, sells, distributes, or publicly displays any written or printed matter advocating, advising, or teaching the duty, necessity, desirability, or propriety of overthrowing or destroying any government in the United States by force or violence, or attempts to do so; or

Whoever organizes or helps or attempts to organize any society, group, or assembly of persons who teach, advocate, or encourage the overthrow or destruction of any such government by force or violence; or becomes or is a member of, or affiliates with, any such society, group, or assembly of persons, knowing the purposes thereof—

Shall be fined under this title or imprisoned not more than twenty years, or both, and shall be ineligible for employment by the United States or any department or agency thereof, for the five years next following his conviction.

If two or more persons conspire to commit any offense named in this section, each shall be fined under this title or imprisoned not more than twenty years, or both, and shall be ineligible for employment by the United States or any department or agency thereof, for the five years next following his conviction.

As used in this section, the terms “organizes” and “organize”, with respect to any society, group, or assembly of persons, include the recruiting of new members, the forming of new units, and the regrouping or expansion of existing clubs, classes, and other units of such society, group, or assembly of persons.

This law was last updated in 1994, probably in response to the rise of the militia movement. Back then William Jefferson Clinton was the Rapist Commander in Chief and people thought he and his wife, Felonia von Pantsuit, would move to institute a dictatorship. (Felonia probably was trying to figure out a way to do just that)

Now I’m not a lawyer, (Thank God I was smart enough to NOT go to Law School), but this appears to my unschooled eyes to be exactly what McCabe and the others did, and under Mueller, are continuing to do. They aren’t trying to overthrow the ENTIRE government, only get Donald Trump out of office, and literally by any means necessary, short of murder.

This all started when James Comey moved to bury the espionage case against Felonia von Pantsuit. She was the designated successor to Barack Obama. The problem was her paranoia, greed and personal corruption had finally blown up and forced the Department of Justice to pretend to look into it.

When Donald Trump started moving ahead of the pack and won the Republican Nomination, not only did the GOP Elites panic, so did the Obama Justice Department. When Donald Trump shocked everyone and won the election, McCabe and all the others decided they had to do whatever it took to stop Trump. They knew from his rhetoric during the campaign that he fully intended to “Drain the swamp. One of the first things he would have done would be to re-investigate Felonia von Pantsuit and how she was able to get a pass that has put others in prison for a lot less.

This led to the apparently illegally obtained FISA warrants, (Lying to the judges to get them to sign off), and spying on the Trump Transition team. (They found out about it and vacated their offices overnight) When President Trump fired James Comey, it looks like the conspiracy went full bore. All this led to the appointment of Mueller, who promptly staffed his office with die hard Trump haters.

This is when things began to fall apart. We had the two investigators, Page and Strzok, caught texting each other with plans to get Trump and an “insurance policy. Both ended up being fired. McCabe flat out lied to internal investigators and was also fired. Jeff “Sleepy” Sessions, who allowed all this to happen was also finally fired by President Trump.

Now McCabe is out talking about this, and appears to be either in the “If I’m going down, I’m taking all of you with me!” or on the search for some kind of deal if and when he is prosecuted. As I mentioned, I’m not a lawyer and I have no idea if this law is actually applicable. I would love to hear from actual students of the law and their opinions. If this law does fit the situation should it be used?
