Good day all, I was checking the news and saw this interesting headline on Drudge. GLORIA GONE WILD: ARREST LIMBAUGH FOR HIS SPEECH!
Now, who the heck is Gloria Allred1? She is a left wing militant feminist lawyer with a penchant for accusing conservatives of just about everything. She recently torpedoed the candidacy of Herman Cain by trotting out a number of women with questionable backgrounds. They all accused Mr. Cain of sexually harassing them. Of course, it quickly came out that these women all had certain issues including making false accusations.
She also destroyed Meg Whitman’s run for the governorship of California when she trotted out a former maid who was also an illegal alien. It came out that Whitman’s husband had been alerted to a potential problem and had told the maid to get it straightened out. This is what any employer would do if they find out there is an immigration issue. Have the person in question deal with the problem.
What happened then is that neither of the Whitmans bothered to follow up on their maids status for several years. After a few years, the maid went to the Whitmans and asked for help in getting her legalizing her immigration status. Apparently it was at this point they fired her. One of the issues that came out later was that in bringing out the maid, Allred actually endangered her. Not with a threat of violence, but with arrest and deportation. Basically, the maid was in the country illegally and had forged documents to get and keep her job. She also lied on the employment form. (And I think that is actionable as well) Allred’s desire to destroy a Republican candidate with a good shot at winning overrode her duties to protect her client2.
Now, Allred has decided to set her sights on Rush Limbaugh. A few weeks ago, Rush made some comments regarding Sandra Fluke and her testimony to a Congressional subcommittee. Long story short, Fluke said that companies should be forced to pay for birth control and abortion services and that it costs her $3000/year for her birth control. This has since been shown to be a lie and that Fluke is a 30 year old left wing activist with an agenda. Some people figured out that for Fluke to run up that kind of expense, she would have to be paying for her own condoms and servicing a minimum of 12 men per day. In other words, she would be a slut or a prostitute.
Rush apologized and unlike liberals, he meant it.
Now Allred is demanding that the State of Florida arrest and prosecute Rush for “Violating Section 836.04 of the Florida Statutes3” by calling Fluke a slut and a prostitute. Here are some of the details from Politico:
Rush Limbaugh has drawn the ire of celebrity lawyer Gloria Allred, who sent a letter to the Palm Beach County state attorney requesting an investigation into whether the popular radio host should be prosecuted for calling a law student a “slut” and “prostitute” last week.
Now, there are a few questions here. One BIG one is, has Gloria Allred ever heard of the First Amendment? What she is demanding is the criminalization of speech. From what I can see, this law was passed back in 1883 and is obviously unconstitutional. At best, Sandra Fluke might have a slander case in CIVIL court, but considering her background and just how erroneous her testimony was, more than likely Rush would win.
But, back to what Allred wants.
“Mr. Limbaugh targeted his attack on a young law student who was simply exercised her free speech and her right to testify before congress on a very important issue to millions of American women and he vilified her. He defamed her and engaged in unwarranted, tasteless and exceptionally damaging attacks on her,” Allred told POLITICO Friday afternoon. “He needs to face the consequences of his conduct in every way that is meaningful.”
Where shall we start? Well, as I said and Rush has also said, his remarks were tasteless and he has apologized for them. Referring to Sandra Fluke as “A young law student” isn’t all that accurate. Fluke is 30 years old, not some 22 year old law student. She is a left wing feminist activist who went to Georgetown to cause some trouble. Her testimony was inaccurate at best and if sworn, could be considered perjurous. If this was brought to court, Fluke’s background would be opened up and her testimony looked into. If she is shown to have lied to congress, she is in big trouble. Not that Allred cares.
Of course, Allred knows this is an unconstitutional law, but she doesn’t care.
The statute stipulates that anyone who “speaks of and concerning any woman, married or unmarried, falsely and maliciously imputing to her a want of chastity” is guilty of a misdemeanor of the first degree. Allred explained that the statute recently came to her attention as having never been repealed, and that it could very well apply to Limbaugh’s remarks as his show is broadcast from West Palm Beach.
In a letter dated March 8, Allred, writing on behalf of the Women’s Equal Rights Legal Defense and Education Fund, requested that Palm Beach County State Attorney Michael McAuliffe probe whether the conservative radio personality had violated Section 836.04 of the Florida Statutes by calling Georgetown University law student Sandra Fluke the two derogatory words.
Actually, although I’m not a lawyer, (Thank GOD!), even I can see this law would be laughed out of court.
It is now entirely up to the prosecutor to exercise his discretion on whether there will be a prosecution. McAuliffe did not immediately respond to a request for comment.
Gee, do you think he might be trying to catch his breath from laughing over Allred’s demands? Unlike Gloria Allred, I think Mr. McAuliffe knows that this would be a complete waste of time, resources and money. If he actually tried to bring charge Limbaugh under this statute, the Judge would dismiss it out of hand. If Mr. McAuliffe then went the appeals route, it would be rejected in every court. He would then have opened the state of Florida to a potential lawsuit by Rush Limbaugh.
Gloria Allred has a history of abusing the legal system to destroy anyone who is opposed to her moonbat views. I don’t know what the procedures are, but it’s far past time for her to be brought up in front of the Bar on ethics violations. (In my unschooled opinion) We don’t need lawyers of any political stripe who try to use criminal laws to suppress speech they don’t like.
