Good day all, back during the “Summer of Fiery Love” there was an incident in Texas. An Uber driver was forced to shoot an armed rioter. Normally, this being Texas, the general response would be “Damn, sorry you had to do that, but nice shot.” However, this happened in the People’s Republic of Austin.
The police, who have common sense and an understanding of the circumstance, ruled the shooting justified. However, the Progressive Liberal Democrat District Attorney, who actually supported the ideas of the rioters, (Black Communist Lives Only Matter), and tried the person for murder, Since most of the citizens of Austin or Moonbats, Liberals and idiots, the DA got a jury that convicted the man. Now Governor Abbott has issued a full pardon. Here are the details from Fox News:
Texas Gov. Greg Abbott on Thursday issued a full pardon for a former U.S. Army sergeant convicted of murder in the shooting death of an armed protester during a 2020 Black Lives Matter march.
The move by Abbott came minutes after a unanimous recommendation by the Texas Board of Pardons and Paroles that Daniel Perry be pardoned and have his firearms rights restored.
When this egregious miscarriage of justice by a crooked District Attorney and a jury made of of morons occurred, people were demanding that Abbott pardon Daniel Perry right then and there, Unfortunately, that isn’t how things work in Texas.
Under Texas law, the governor cannot issue a pardon without a recommendation from the board, which the governor appoints.
“The Texas Board of Pardons and Paroles conducted an exhaustive review of U.S. Army Sergeant Daniel Perry’s personal history and the facts surrounding the July 2020 incident and recommended a Full Pardon and Restoration of Full Civil Rights of Citizenship,” Abbott said in a statement.
“Among the voluminous files reviewed by the Board, they considered information provided by the Travis County District Attorney, the full investigative report on Daniel Perry, plus a review of all the testimony provided at trial,” Abbott said. “Texas has one of the strongest ‘Stand Your Ground’ laws of self-defense that cannot be nullified by a jury or a progressive District Attorney. I thank the Board for its thorough investigation, and I approve their pardon recommendation.”

I suspect that there was a good chance that Mr. Perry would have had the conviction overturned on appeal. As I recall, and mentioned above, the Austin PD investigated what happened and determined that there was grounds for self defense. It came out in the trial that the dead guy wasn’t just carrying a rifle, but he actually pointed it at Mr. Perry and his fare. (I may be misremembering this)
Perry’s attorney, Douglas K. O’Connell, said his client is “thrilled and elated to be free” and “optimistic for his future.”
“He wishes that this tragic event never happened and wishes he never had to defend himself against Mr. Foster’s unlawful actions,” O’Connell said. “At the same time, Daniel recognizes that the Foster family is grieving. We are anxious to see Daniel reunited with his family and loved ones.”
What I don’t know is what Mr. Perry’s current military status is. Was he discharged under honorable conditions or something else? Does he get any benefits? If there is any issues with his military record over this, then, provided things go as expected, President Trump needs to make sure it gets fixed ASAP once he regains the Oval Office from Mr. Mashed Potato Brains. Of course, there were those who weren’t happy with this pardon.
Travis County District Attorney Jose Garza blasted the pardon as a “mockery of our legal system.”
“The board and the governor have put their politics over justice,” Garza said. “They should be ashamed of themselves. Their actions are contrary to the law and demonstrate that there are two classes of people in this state where some lives matter and some lives do not. They have sent a message to Garrett Foster’s family, to his partner, and to our community that his life does not matter. ”

No you flaming moonbat. They took a look at what really happened, your background as a Soros DA, the flat out corruption of of both the city and county governments, along with your personal refusal to do anything to stop the BCLOM thugs who were threatening both law enforcement and anyone who didn’t support the goals of the Left.
Now the prosecution, or perhaps persecution would be a better term, came up with the novel idea that Mr. Perry could have just driven away. This flies in the face of several facts. Perry was surrounded and couldn’t just “Step on the gas” and drive away. He would have hit someone. (Personally, considering what we now know about these thugs, that might not be a bad idea)
Second, the rifle in question as a civilian version of the Kalashnikov AK-47. This fires a 7.62×39 millimeter cartridge and can very easily penetrate most parts of the car Mr. Perry was driving. Since Mr. Perry was in the Army, he knew these facts and considering the violence being perpetrated throughout the country, had every reason to think he was going to be fired on.
When this case first came up and people reviewed what they could find in the public record, they considered this to be a tragic, yet justified case of Self Defense. That this Communist Soros District Attorney brought the case surprised everyone who had any knowledge of the stand your ground and self defense laws in Texas.

However, this is Travis County and is one of the places that the Left as taken over with the usual results. (High crime, corrupt government and shear incompetence) Thankfully, Governor Abbott and the Board of Pardons took quick action and Mr. Perry is now a free man with all rights restored, as they should be. Hopefully, any issues with his military status can now be cleared up as well.
