I\u2019m feeling a bit more motivated today. Last week, <a href=\"http:\/\/angry.net\/blog2\/?p=13663\" target=\"_blank\" rel=\"noopener\">several courts ruled<\/a> that the NSA had indeed crossed the constitutional line and engaged in illegal search and seizure when they snarfed up all the cellphone data in the United States.<\/p>\n<p><!--more--><\/p>\n<p>Of course, certain members of Congress are up in arms over the courts not toeing the Progressive, Statist line and actually upholding the Constitution. According to the <a href=\"http:\/\/www.washingtontimes.com\/news\/2013\/dec\/17\/democrats-urge-courts-to-clear-nsa-program\/\" target=\"_blank\" rel=\"noopener\">Washington Times<\/a>:<\/p>\n<blockquote><p>Top Democrats pushed back Tuesday against a federal judge\u2019s ruling that the <a href=\"http:\/\/www.washingtontimes.com\/topics\/national-security-agency\/\" target=\"_blank\" rel=\"noopener\">NSA<\/a>\u2019s phone-records collection program violates privacy rights, asking for higher courts to quickly get involved and bring legal certainty to the murky world of intelligence gathering.<\/p><\/blockquote>\n<p>Gee, the Democrats railing against anything that stops them from spying on and controlling Americans. What a surprise. I assume it is, as they say in the crime novels, the \u201cUsual Suspects\u201d screaming about the decisions.<\/p>\n<blockquote><p><a href=\"http:\/\/www.washingtontimes.com\/topics\/dianne-feinstein\/\" target=\"_blank\" rel=\"noopener\">Sen. Dianne Feinstein<\/a>, California Democrat and chairwoman of the <a href=\"http:\/\/www.washingtontimes.com\/topics\/senate-select-committee\/\" target=\"_blank\" rel=\"noopener\">Senate Select Committee<\/a> on Intelligence, said Judge <a href=\"http:\/\/www.washingtontimes.com\/topics\/richard-j-leon\/\" target=\"_blank\" rel=\"noopener\">Richard J. Leon<\/a>\u2019s decision, released Monday, contradicts a secret intelligence court that has upheld the <a href=\"http:\/\/www.washingtontimes.com\/topics\/national-security-agency\/\" target=\"_blank\" rel=\"noopener\">National Security Agency<\/a>\u2019s phone program 35 times, and contradicts a federal court in California that said the program doesn\u2019t infringe on privacy.<\/p>\n<p>\u201cThere are differing opinions now. That\u2019s the state of play. And the assumption is that it\u2019s going to be appealed and the <a href=\"http:\/\/www.washingtontimes.com\/topics\/supreme-court\/\" target=\"_blank\" rel=\"noopener\">Supreme Court<\/a> will eventually make a decision, which is really the appropriate thing,\u201d <a href=\"http:\/\/www.washingtontimes.com\/topics\/dianne-feinstein\/\" target=\"_blank\" rel=\"noopener\">Mrs. Feinstein<\/a> said.<\/p><\/blockquote>\n<p>Feinstein is one of the loudest members of Congress, primarily on the Progressive Liberal Democrats side of the aisle, who wants the Constitution repudiated. Her hatred of the Second Amendment is well known, and she has also supported restrictions on the First Amendment and now the Fourth and Fifth Amendments.<\/p>\n<blockquote><p>But she also said part of the problem is that the administration has been operating the programs on the basis of secret legal memos that it refuses to turn over to <a href=\"http:\/\/www.washingtontimes.com\/topics\/congress\/\" target=\"_blank\" rel=\"noopener\">Congress<\/a>, making it difficult for even the lawmakers specifically cleared to oversee the intelligence community to know what is occurring.<\/p><\/blockquote>\n<p>Nice CYA there DiFi. The fact of the matter is, we have a member of the administration who, even with advance warning of the question to be asked, flat out lied under oath. What have you done about Mr. Clapper ((<a href=\"https:\/\/en.wikipedia.org\/wiki\/James_R._Clapper\" target=\"_blank\" rel=\"noopener\">James Robert Clapper, Jr.<\/a>)) you treasonous moonbat? Have you demanded that the InJustice Department prosecute him for perjury? Have you gone to see Eric Holder and inquired on when the Grand Jury will be empaneled to examine the evidence? Of course you haven\u2019t. You support anything that oppresses the American people you lying dried out old hag.<\/p>\n<blockquote><p>On Monday, Judge <a href=\"http:\/\/www.washingtontimes.com\/topics\/richard-j-leon\/\">Leon<\/a> became the first judge to rule against the <a href=\"http:\/\/www.washingtontimes.com\/topics\/national-security-agency\/\" target=\"_blank\" rel=\"noopener\">NSA<\/a> program, saying that gathering and storing the data likely violates Americans\u2019 privacy rights. He said technology has moved well beyond where it was in the 1970s, when the <a href=\"http:\/\/www.washingtontimes.com\/topics\/supreme-court\/\" target=\"_blank\" rel=\"noopener\">Supreme Court<\/a> upheld data-gathering in its Smith v. Maryland ruling. Judge <a href=\"http:\/\/www.washingtontimes.com\/topics\/richard-j-leon\/\" target=\"_blank\" rel=\"noopener\">Leon<\/a> ordered the <a href=\"http:\/\/www.washingtontimes.com\/topics\/national-security-agency\/\" target=\"_blank\" rel=\"noopener\">NSA<\/a> to stop collecting information on two plaintiffs in the case before him, though he stayed his own order to give the <a href=\"http:\/\/www.washingtontimes.com\/topics\/barack-obama\/\" target=\"_blank\" rel=\"noopener\">Obama administration<\/a> a chance to appeal.<\/p><\/blockquote>\n<p>Judge Leon really didn\u2019t have much of a choice in staying his decision. This IS going to reach the Supreme Court. Considering the court\u2019s recent activities in regards to 4<sup>th<\/sup> Amendment cases, the decision will probably be overturned. (With Roberts writing for the majority&#8230;again)<\/p>\n<blockquote><p>Many members of <a href=\"http:\/\/www.washingtontimes.com\/topics\/congress\/\" target=\"_blank\" rel=\"noopener\">Congress<\/a> applauded Judge <a href=\"http:\/\/www.washingtontimes.com\/topics\/richard-j-leon\/\" target=\"_blank\" rel=\"noopener\">Leon<\/a>\u2019s ruling, saying it highlighted an area where the government has overreached.<\/p>\n<p>But <a href=\"http:\/\/www.washingtontimes.com\/topics\/dianne-feinstein\/\" target=\"_blank\" rel=\"noopener\">Mrs. Feinstein<\/a> and <a href=\"http:\/\/www.washingtontimes.com\/topics\/senate\/\" target=\"_blank\" rel=\"noopener\">Senate<\/a> Majority Leader <a href=\"http:\/\/www.washingtontimes.com\/topics\/harry-reid\/\" target=\"_blank\" rel=\"noopener\">Harry Reid<\/a>, Nevada Democrat, said Judge <a href=\"http:\/\/www.washingtontimes.com\/topics\/richard-j-leon\/\" target=\"_blank\" rel=\"noopener\">Leon<\/a>\u2019s decision is an outlier.<\/p><\/blockquote>\n<p>Actually, at least one other court has ruled against the NSA in the last week. Not that the tyrants in DC care.<\/p>\n<blockquote><p>The <a href=\"http:\/\/www.washingtontimes.com\/topics\/white-house\/\" target=\"_blank\" rel=\"noopener\">White House<\/a> was mostly mum, but President Obama\u2019s nominee to be the next top attorney at the CIA, Caroline Krass, said she also disagreed with Judge <a href=\"http:\/\/www.washingtontimes.com\/topics\/richard-j-leon\/\" target=\"_blank\" rel=\"noopener\">Leon<\/a>.<\/p>\n<p>\u201cI have a different view about the Fourth Amendment. I think that under Smith versus Maryland, which I still consider to be good law, there is not a reasonable expectation of privacy in telephony metadata,\u201d she said.<\/p><\/blockquote>\n<p><a href=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2013\/04\/stupid_meter.gif\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter  wp-image-11573\" alt=\"stupid_meter\" src=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2013\/04\/stupid_meter.gif?resize=117%2C117\" width=\"117\" height=\"117\" \/><\/a><\/p>\n<p>And this shows why she is not qualified for the position she is going for. It also shows why she is not qualified to be a lawyer either. I\u2019ve <a href=\"http:\/\/angry.net\/blog2\/?p=12067\" target=\"_blank\" rel=\"noopener\">gone into<\/a> just what this metadata can show. The amount of information that can be garnered is a far cry from what was available when the original USSC decision was made in 1979. You can track people\u2019s travels, see who they are talking to, find out who they are texting, look at their internet search history, and a lot more.<\/p>\n<p>The excuse the totalitarians and secret police like to throw out there is that the phone companies collect this data anyway. However, they only use what little is needed for billing purposes, and network traffic analysis. (To see if there are any bottlenecks they need to deal with) They don\u2019t use it to check on a person\u2019s location, (Except in an emergency and after a request from Police. Usually for Search and Rescue) and they have no interest in where someone\u2019s been over the last few months. Currently, a number of members of Congress are working on legislation regarding the NSA and other government agencies actions on collecting data on Americans.<\/p>\n<blockquote><p><a href=\"http:\/\/www.washingtontimes.com\/topics\/congress\/\" target=\"_blank\" rel=\"noopener\">Congress<\/a> is rushing to fill the void, though lawmakers are moving in two directions. <a href=\"http:\/\/www.washingtontimes.com\/topics\/dianne-feinstein\/\" target=\"_blank\" rel=\"noopener\">Mrs. Feinstein<\/a>\u2019s committee has passed a bill she wrote that puts the <a href=\"http:\/\/www.washingtontimes.com\/topics\/national-security-agency\/\">NSA<\/a> phone-records program on firm legal ground, though it would require the <a href=\"http:\/\/www.washingtontimes.com\/topics\/national-security-agency\/\" target=\"_blank\" rel=\"noopener\">agency<\/a> to do more reporting.<\/p><\/blockquote>\n<p>Why am I not surprised that totalitarian scumbitch Feinstein wants to keep on spying on Americans? Actually I\u2019m not. It ties right in with her desire to forcibly disarm Americans as well as suppress their rights under the 1<sup>st<\/sup> Amendment. (Both speech and religion)<\/p>\n<blockquote><p>But some conservative Republicans and liberal Democrats have banded together to support a bill that would rewrite the Patriot Act and cancel bulk-records collection. The chief sponsor in the <a href=\"http:\/\/www.washingtontimes.com\/topics\/senate\/\" target=\"_blank\" rel=\"noopener\">Senate<\/a> is President Pro Tempore Patrick J. Leahy, Vermont Democrat and chairman of the <a href=\"http:\/\/www.washingtontimes.com\/topics\/senate\/\" target=\"_blank\" rel=\"noopener\">Senate<\/a> Judiciary Committee, who has blasted the scope of the <a href=\"http:\/\/www.washingtontimes.com\/topics\/national-security-agency\/\" target=\"_blank\" rel=\"noopener\">NSA<\/a> program.<\/p><\/blockquote>\n<p>I have my concerns when it comes to Patrick \u201cLeaky\u201d Leahy. I do not trust him at all. I haven\u2019t looked at his bill, but I won\u2019t be at all surprised if it does just the opposite of what he says it does. On the other hand, you have the utter dirtbags who want the Constitution disgarded so they can rule by decree. Just like their master, Obama.<\/p>\n<blockquote><p><a href=\"http:\/\/www.washingtontimes.com\/topics\/harry-reid\/\">Mr. Reid<\/a>, who appeared to side with <a href=\"http:\/\/www.washingtontimes.com\/topics\/dianne-feinstein\/\" target=\"_blank\" rel=\"noopener\">Mrs. Feinstein<\/a> and disagree with Judge <a href=\"http:\/\/www.washingtontimes.com\/topics\/richard-j-leon\/\" target=\"_blank\" rel=\"noopener\">Leon<\/a>\u2019s ruling, said there should be \u201ca good public debate\u201d on the issue, but he didn\u2019t commit to a time frame in the <a href=\"http:\/\/www.washingtontimes.com\/topics\/senate\/\" target=\"_blank\" rel=\"noopener\">Senate<\/a>.<\/p><\/blockquote>\n<p>Does the First day of Never sound about right? Harry Reid is the most corrupt, tyrannical Senate Majority Leader that I can recall. His actions, along with Obama\u2019s have done serious damage the this nation, to the point where you are now getting public testimony in Congress warning of a civil war. These warnings are falling on deaf ears among the leadership of both parties in both houses of Congress. They are so out of touch with what is going on, that it rivals the British Parliament back in the mid 18<sup>th<\/sup> century. For those of you who are historically challenged, (Public school students), the British Parliament passed numerous laws and taxes and would not listen to the American colonists. There were members of Parliament who saw how unfair and dangerous the actions of the majority were, and they tried to get the other ministers along with the Prime Minister to see reason. They didn\u2019t and now we have the United States of America. People like Reid and Feinstein are just like those members of Parliament back in the 1700\u2019s who wouldn\u2019t listen to people and thought they were the smartest people in the room.<\/p>\n<p>If our current political class doesn\u2019t listen, and continues with their attempts at vote rigging, (Al Franken is only in office because of a stolen election), suppression of religion, (Except Islam of course. Christians and Jews generally don\u2019t strap on suicide bomb vest and blow up people), and speech, (Using the<a href=\"http:\/\/www.newsmax.com\/Politics\/tea-party-irs-rules\/2013\/12\/05\/id\/540233\" target=\"_blank\" rel=\"noopener\"> IRS to suppress<\/a> conservative groups and <a href=\"http:\/\/legalinsurrection.com\/2013\/12\/secret-probe-of-conservatives-makes-wisconsin-ground-zero-in-first-amendment-war\/\" target=\"_blank\" rel=\"noopener\">District Attorneys raiding offices of other groups<\/a>), they are going to wake up to a massive explosion, both figuratively and literally.<\/p>\n<p><a href=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2013\/01\/times_up_flag_z.jpg\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter  wp-image-10528\" alt=\"times_up_flag_z\" src=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2013\/01\/times_up_flag_z-300x180.jpg?resize=198%2C119\" width=\"198\" height=\"119\" srcset=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2013\/01\/times_up_flag_z.jpg?resize=300%2C180&amp;ssl=1 300w, https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2013\/01\/times_up_flag_z.jpg?resize=150%2C90&amp;ssl=1 150w, https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2013\/01\/times_up_flag_z.jpg?resize=400%2C240&amp;ssl=1 400w, https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2013\/01\/times_up_flag_z.jpg?w=481&amp;ssl=1 481w\" sizes=\"auto, (max-width: 198px) 100vw, 198px\" \/><\/a><\/p>\n<p>There is a very easy fix to this whole thing. It\u2019s constitutional and people would agree to it. First, prosecute Clapper and all the other people who lied to Congress about just what the NSA was doing. Then, tell their replacements that they are not allowed to spy on Americans or lawful resident aliens inside the borders of the United States. (Spying on foreign governments and people outside the US is fine and is their job. The Constitution ends at the borders) Second, close down the FISA court. It\u2019s proven to be nothing more then a rubber stamp with no way for people to appeal their decisions, or even know about them. If there is need to collect metadata, then go into court and apply for the appropriate warrant. I can accept that it may need to be sealed for a while, maybe. However, this vacuuming of everything has to end and it has to end now.
