Good day all. With all the news regarding the Bundy Ranch situation, people haven\u2019t noticed other plans by the Bureau of Land Management to seize more land. The latest incident is taking place in Texas and has caused the Attorney General to challenge the BLM to try and take the land.<\/p>\n

<\/p>\n

Texas, like most states, does have some land controlled by the BLM. Unlike Nevada, it isn\u2019t all that much. (The BLM controls over 80% of Nevada) In this case, it looks like they are going after private property again. Here are the details from the April 21 2014 article on Breitbart<\/a>:<\/p>\n

After the recent Bundy Ranch episode by the U.S. Bureau of Land Management (BLM), Texans are becoming more concerned about the BLM\u2019s focus on 90,000 acres along a 116 mile stretch of the Texas\/Oklahoma boundary. The BLM is reviewing the possible federal takeover and ownership of privately-held lands which have been deeded property for generations of Texas landowners.<\/i><\/p>\n<\/blockquote>\n

As you might expect, this isn\u2019t going over well in Texas.<\/p>\n

\n

Sid Miller, former Texas State Representative and Republican candidate for Texas Agriculture Commissioner, has since made the matter a campaign issue to Breitbart Texas. <\/i><\/p>\n

\u201cIn Texas,\u201d Miller says, \u201cthe BLM is attempting a repeat of an action taken over 30 years ago along the Red River when Tommy Henderson lost a federal lawsuit. The Bureau of Land Management took 140 acres of his property and didn\u2019t pay him one cent.\u201d<\/i><\/p>\n

Miller referred to a 1986 case where the BLM attempted to seize some of Henderson\u2019s land. Henderson sued the BLM and lost 140 acres that had been in his family for generations. Now the BLM is looking at using the prior case as a precedent to claim an additional 90,000 acres.<\/i><\/p>\n<\/blockquote>\n

Read the story for all the details<\/a> on what happened 30 years ago and what the BLM is attempting to do now. Times have changed, and with the current mess in Nevada, the fact that people are really getting angry at the Federal Government, the state Governors and the Attorneys General are trying to restore the balance of powers through the courts. The problem is that the courts no longer, in many cases, pay any attention to the Constitution or the 10th<\/sup> Amendment ((Tenth Amendment to the United States Constitution<\/a>)). It isn\u2019t only court challenges, now they are starting to really throw down the gauntlets. In a follow up story on Breitbart<\/a>, the Texas Attorney General and candidate for governor Gregg Abbott ((Gregory Wayne Abbott<\/a>)) has said:<\/p>\n

\u201cI am about ready,\u201d General Abbott told Breitbart Texas, \u201cto go to the Red River and raise a \u2018Come and Take It\u2019 flag to tell the feds to stay out of Texas.\u201d<\/i><\/p>\n<\/blockquote>\n

Gen. Abbott sent a strongly-worded letter to BLM Director Neil Kornze, asking for answers to a series of questions related to the potential land grab. <\/i><\/p>\n

\u201cI am deeply concerned about the notion that the Bureau of Land Management believes the federal government has the authority to swoop in and take land that has been owned and cultivated by Texas landowners for generations,\u201d General Abbott wrote. \u201cThe BLM\u2019s newly asserted claims to land along the Red River threaten to upset long-settled private property rights and undermine fundamental principles\u2014including the rule of law\u2014that form the foundation of our democracy. Yet, the BLM has failed to disclose either its full intentions or the legal justification for its proposed actions. Decisions of this magnitude must not be made inside a bureaucratic black box.\u201d<\/i><\/p>\n<\/blockquote>\n

AG Abbott knows full well that all decisions made by Federal Agencies are done in bureaucratic black boxes. They don\u2019t want anyone to know what they are doing until it\u2019s to late. Then they move in with a small army to enforce whatever decision they have made. See what happened with the Bundy\u2019s in Nevada.<\/p>\n

\n

In an exclusive interview with Breitbart Texas, General Abbott said, \u201cThis is the latest line of attack by the Obama Administration where it seems like they have a complete disregard for the rule of law in this country …And now they\u2019ve crossed the line quite literally by coming into the State of Texas and trying to claim Texas land as federal land. And, as the Attorney General of Texas I am not going to allow this.\u201d<\/i><\/p>\n<\/blockquote>\n

Obama and the Progressive Liberal Fascist Democrats have tossed the Constitution and the Rule of Law out the window. In fact, Obama is considered by many knowledgeable people that he and his administration are the most corrupt and lawless administration in US history, far surpassing Richard Nixon. AG Abbott is putting the BLM Director on notice that he won\u2019t tolerate any attempts by the BLM to steal this territory.<\/p>\n

\n

Abbott challenged the BLM director directly stating in his letter, \u201cNearly a century ago, the U.S. Supreme Court determined that the gradient line of the south bank of the Red River\u2014subject to the doctrines of accretion and avulsion\u2014was the boundary between Texas and Oklahoma. Oklahoma v. Texas, 260 U.S. 606 (1923). More recently, in 1994, the BLM stated that the Red River area was \u201c[a] unique situation\u201d and stated that \u2018[t]he area itself cannot be defined until action by the U.S. Congress establishes the permanent state boundary between Oklahoma and Texas.\u2019 Further, the BLM determined that one possible scenario was legislation that established the \u2018south geologic cut bank as the boundary,\u2019 which could have resulted \u2018in up to 90,000 acres\u2019 of newly delineated federal land. But no such legislation was ever enacted.\u201d<\/i><\/p>\n

In other words, the BLM doesn\u2019t have a leg to stand on, not that they care of course. Congress? Who cares about them? Certainly not the Obama run bureaucracies.<\/i><\/p>\n

As to what kind of standoff might Texas might be facing with the BLM on this matter, Abbott said, \u201cI think that we should be able to resolve this from a legal standpoint because, I believe, what the BLM is doing clearly violates the law. They don\u2019t have any legal standing whatsoever to do this and that\u2019s why I have issued this letter today.\u201d<\/i><\/p>\n<\/blockquote>\n

Read the article<\/a> for the issues Attorney General Abbott lists. It\u2019s a bit technical, but you should be able to understand the gist of it.<\/p>\n

\n

\u201cThe letter today,\u201d Abbott explained, \u201cis the first shot in the legal process. We expect answers from them and based upon their answers we will decide what legal action to take.\u201d<\/i><\/p>\n

\u201cWhat Barack Obama\u2019s BLM is doing,\u201d Abbott continued, \u201cis so out of bounds and so offensive that we should have quick and successful legal action if they dare attempt to tread on Texas land and take it from private property owners in this state.\u201d<\/i><\/p>\n

Abbott told Breitbart Texas he wants to make sure the BLM understands that what they appear to be attempting to do is completely illegal. \u201cThis is Texas land. It belongs to Texas and the private property owners here,\u201d Abbott firmly stated. \u201cIf we have to, we will assert quick and effective legal action to put a stop to it.\u201d<\/i><\/p>\n<\/blockquote>\n

And Obama doesn\u2019t care. The Progressive Liberal Fascist Democrats don\u2019t care. In fact, anything that hurts Texas, Americans and the country is a good thing to them. It furthers their goals of ending freedom and instituting a socialist style government run by them. The good news is that AG Abbott isn\u2019t alone in fighting the latest attempt by the Government to steal the property of States and citizens. Retiring governer Rick Perry has thrown his whole hearted support to Attorney General Abbott. According to Fox News<\/a>:<\/p>\n

Texas Gov. Rick Perry joined his state\u2019s top attorney on Wednesday in blasting the federal Bureau of Land Management over concerns that it may be looking at laying claim to thousands of acres of property in northern Texas.<\/i><\/p>\n<\/blockquote>\n

Perry has been at loggerheads with Obama for years, along with most of the governors in that part of the country.<\/p>\n

\n

\u201cThe federal government already owns too much land,\u201d Perry told Fox News. Perry told Fox News he stands with Abbott on this issue. \u201cIt\u2019s not a dare, it\u2019s a promise that we\u2019re going to stand up for private property rights in the state of Texas,\u201d Perry said, calling the federal government \u201cout of control.\u201d<\/i><\/p>\n<\/blockquote>\n

The BLM is denying everything of course.<\/p>\n

\n

The BLM argues that any land in question was long ago determined to be public property anyway.<\/i><\/p>\n

\u201cThe BLM is categorically not expanding Federal holdings along the Red River,\u201d a BLM spokeswoman said in a written statement on Tuesday.<\/i><\/p>\n

The spokeswoman referred to a 140-acre plot \u201cdetermined to be public land in 1986\u201d \u2013 an apparent reference to a 1986 federal court case. Texas landowner Tommy Henderson lost 140 acres to BLM in that case, and he claims the agency is now using that decision as precedent to pursue more property.<\/i><\/p>\n<\/blockquote>\n

The Supreme Court has shown it\u2019s hostility to property rights with this culminating in the horrendous Kelo decision ((Kelo v. City of New London<\/a>)). They would not have a problem letting the Federal Government and the BLM come in and kick the property owners off the land they\u2019ve held for over 100 years.<\/p>\n

\n

Perry claimed private property would be affected here, and questioned the BLM\u2019s position.<\/i><\/p>\n

\u201cIs the federal government going to come back in and say, \u2018you know what, Mexico used to own the state of Texas so let\u2019s have a conversation of where the rightful ownership of this is\u2019?\u201d he said.<\/i><\/p>\n<\/blockquote>\n

Actually, I think they would. King Putt and the PLFD ((PLFD: Progressive Liberal Fascist Democrats)) hate the independent nature of people in the southwest and will do anything they can to crush them. Giving Texas back to Mexico and ordering everyone else out is something they might do if they thought they could get away with it. The BLM isn\u2019t saying much.<\/p>\n

\n

It\u2019s unclear how seriously BLM might be looking at laying claim to additional boundary land.<\/em><\/p>\n

BLM said it is merely in the \u201cinitial stages of developing options for management of public lands,\u201d as part of a \u201ctransparent process with several opportunities for public input.\u201d<\/em><\/p>\n<\/blockquote>\n

Transparent? Please! Don\u2019t make me laugh. Der Fubar has painted over the windows so no one can see what they are doing. As to that \u201cPeriod for comments?\u201d That\u2019s just window dressing on the painted over windows. They\u2019ve already made their decision. I expect to see BLM thugs moving into Texas with their paramilitary forces and dozens of MRAPS ((Mine-Resistant Ambush Protected<\/a>)) soon after the midterm elections. I think if they do, they might find the reception even less inviting then they did in Nevada. Not only would Patriot groups show up to stop them, I wouldn\u2019t be at all surprised if the governor deployed the Texas National Guard as well as sending in a single Texas Ranger ((“One Riot, One Ranger”<\/a>)). (The latter will take care of the BLM in very short order) As the old saying goes, and the Obama and his thugs at the BLM should listen to, you just \u201cDon\u2019t mess with Texas.\u201d<\/p>\n
