Yesterday was an interesting day for Supreme Court decisions. They literally smacked Obama upside the head, ruling 9-0 that he had far exceeded his authority when he appointed new members to the National Labor Relations Board.<\/p>\n<p style=\"margin-bottom: 0in; line-height: 100%;\"><!--more--><\/p>\n<p style=\"margin-bottom: 0in; line-height: 100%;\">If you don\u2019t recall the story behind that, basically Obama was trying to appoint a new board and staff it with essentially communists and union flunkies who intended to force people into unions. Since the chances of getting those moonbats through the senate approached zero, Der Fubar didn\u2019t even bother sending up their names. Instead, he waited until the Senate left town, then he declared them in recess and made what are called \u201cRecess Appointments.\u201d A recess appointment is perfectly constitutional under certain circumstances. And that\u2019s where that SCoaMF ran into trouble.<\/p>\n<p style=\"margin-bottom: 0in; line-height: 100%;\">President \u201cI\u2019m a Constitutional Scholar\u201d decided that HE was the one to say when the Senate was in recess, not the U.S. Senate. He put his cronies on the board and they promptly started issuing rulings that were designed to destroy companies and individual workers. Even Harry Reid had serious issues with that one. The case was not brought by the Senate, but by a company that had been ruled against by the Obama cronies. Here are some of the details from <a href=\"http:\/\/apnews.myway.com\/article\/20140626\/us-supreme-court-recess-appointment-801860b033.html\" target=\"_blank\" rel=\"noopener noreferrer\">My Way<\/a>:<\/p>\n<blockquote>\n<p style=\"margin-bottom: 0in; line-height: 100%;\"><i>The Supreme Court on Thursday limited the president&#8217;s power to fill high-level vacancies with temporary appointments, ruling in favor of Senate Republicans in their partisan clash with President Barack Obama. The high court&#8217;s first-ever case involving the Constitution&#8217;s recess appointments clause ended in a unanimous decision holding that Obama&#8217;s appointments to the National Labor Relations Board in 2012 without Senate confirmation were illegal. Obama invoked the Constitution&#8217;s provision giving the president the power to make temporary appointments when the Senate is in recess. Problem is, the court said, the Senate was not actually in a formal recess when Obama acted.<\/i><\/p>\n<p style=\"margin-bottom: 0in; line-height: 100%;\"><i>Obama had argued that the Senate was on an extended holiday break and that the brief sessions it held every three days \u2014 what lawmakers call &#8220;pro forma&#8221; \u2014 were a sham that was intended to prevent him from filling seats on the NLRB.<\/i><\/p>\n<p style=\"margin-bottom: 0in; line-height: 100%;\"><i>The justices rejected that argument Wednesday.<\/i><\/p>\n<\/blockquote>\n<p style=\"margin-bottom: 0in; line-height: 100%;\">This is a MAJOR slap at Obama. It also shows just how arrogant and incompetent he and his cronies are. This is, to my limited knowledge, the first time the court has ruled on a separation of powers and what powers a president has. (Others far more knowledgeable then I am can speak to this) For decades presidents have tried to avoid cases like this ending up in front of the Supreme Court, usually working out some sort of deal with Congress. What Obama has done is destroy that \u201carrangement\u201d for himself and future presidents with his refusal to talk to Congress and basically act as if he were the king.<\/p>\n<p style=\"margin-bottom: 0in; line-height: 100%;\"><a href=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2012\/11\/king-putt.png\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-medium wp-image-10027\" src=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2012\/11\/king-putt-261x300.png?resize=261%2C300\" alt=\"king putt\" width=\"261\" height=\"300\" srcset=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2012\/11\/king-putt.png?resize=261%2C300&amp;ssl=1 261w, https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2012\/11\/king-putt.png?resize=130%2C150&amp;ssl=1 130w, https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2012\/11\/king-putt.png?resize=400%2C458&amp;ssl=1 400w, https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2012\/11\/king-putt.png?w=431&amp;ssl=1 431w\" sizes=\"auto, (max-width: 261px) 100vw, 261px\" \/><\/a><\/p>\n<p style=\"margin-bottom: 0in; line-height: 100%;\">Now what does this mean right now? It means that all those ruling made by the NLRB during the period the Recess Appointees were in place are essentially invalid and illegal. Here are some details on what might happen now from <a href=\"https:\/\/web.archive.org\/web\/20151017160552\/http:\/\/www.foxnews.com\/politics\/2014\/06\/27\/labor-board-scrambles-after-hundreds-decisions-thrown-into-doubt-by-court\/\" target=\"_blank\" rel=\"noopener noreferrer\">Fox News<\/a>:<\/p>\n<blockquote>\n<p style=\"margin-bottom: 0in; line-height: 100%;\"><i>The Supreme Court ruling on Thursday that invalidated three appointments made by President Obama to the National Labor Relations Board has thrown hundreds of the board&#8217;s decisions into question. The board that rules on labor disputes is now scrambling to determine the impact of the high court decision. At issue is whether board decisions made when the now-invalid appointees were participating will have to be re-decided under the current NLRB. <\/i><\/p>\n<\/blockquote>\n<p style=\"margin-bottom: 0in; line-height: 100%;\">I think I can safely say that Yes, they WILL have to rehear all those cases.<\/p>\n<blockquote>\n<p style=\"margin-bottom: 0in; line-height: 100%;\"><i>By one count, more than 430 cases could be in doubt, including a decision to protect workers from being fired for complaining about their companies on social media sites. <\/i><\/p>\n<\/blockquote>\n<p style=\"margin-bottom: 0in; line-height: 100%;\">I don\u2019t know anything about that last case, but I have been <a href=\"http:\/\/www.angry.net\/news\/2006.htm#june1906\" target=\"_blank\" rel=\"noopener noreferrer\">terminated due to Anger Central<\/a> in the past, even though I had made no mention of what I did or the company I worked for. Needless to say, a decision saying they can\u2019t do that is something I would probably support.<\/p>\n<p style=\"margin-bottom: 0in; line-height: 100%;\"><i>Board Chairman Mark Gaston Pearce put out a brief statement on Thursday acknowledging the possibility these cases will have to be revisited. <\/i><\/p>\n<blockquote>\n<p style=\"margin-bottom: 0in; line-height: 100%;\"><i>&#8220;We are analyzing the impact that the Court&#8217;s decision has on Board cases in which the January 2012 recess appointees participated,&#8221; he said. &#8220;The Agency is committed to resolving any cases affected by today&#8217;s decision as expeditiously as possible.&#8221; <\/i><\/p>\n<p style=\"margin-bottom: 0in; line-height: 100%;\"><i>He noted that the board, as it&#8217;s now constituted, has five Senate-confirmed members. But that was not the case between January 2012 and mid-2013, when the board contained members whom the Supreme Court has determined were improperly appointed. <\/i><\/p>\n<\/blockquote>\n<p style=\"margin-bottom: 0in; line-height: 100%;\"><a href=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2012\/08\/double-facepalm.jpg\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-medium wp-image-8876\" src=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2012\/08\/double-facepalm-300x240.jpg?resize=300%2C240\" alt=\"double-facepalm\" width=\"300\" height=\"240\" srcset=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2012\/08\/double-facepalm.jpg?resize=300%2C240&amp;ssl=1 300w, https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2012\/08\/double-facepalm.jpg?resize=150%2C120&amp;ssl=1 150w, https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2012\/08\/double-facepalm.jpg?resize=400%2C320&amp;ssl=1 400w, https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2012\/08\/double-facepalm.jpg?w=640&amp;ssl=1 640w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p style=\"margin-bottom: 0in; line-height: 100%;\">You know, all this could have been avoided if King Putt had simply followed the constitution and submitted his choices to the Senate for confirmation. But Nooo, he thought the constitution and the laws don\u2019t apply to His Majesty and now he has just received the judicial equivalent of a 2&#215;4 to the back of the head.<\/p>\n<p style=\"margin-bottom: 0in; line-height: 100%;\">And finally, in a stunningly tone deaf statement, <a href=\"https:\/\/web.archive.org\/web\/20211113162827\/https:\/\/www.washingtonpost.com\/politics\/supreme-court-rebukes-obama-on-recess-appointments\/2014\/06\/26\/e5e4fefa-e831-11e3-a86b-362fd5443d19_story.html\" target=\"_blank\" rel=\"noopener noreferrer\">Harry Reid had this to say<\/a> on the decision:<\/p>\n<blockquote>\n<p style=\"margin-bottom: 0in; line-height: 100%;\"><i>Senate Majority Leader Harry M. Now perhaps they would have been blocked, perhaps not. But to say that it\u2019s all the Republican\u2019s fault when it\u2019s Obama\u2019s demonstrates why Reid is utterly unfit for anything other then an <a href=\"http:\/\/en.wikipedia.org\/wiki\/Ankle_monitor\" target=\"_blank\" rel=\"noopener noreferrer\">ankle bracelet tracking device<\/a>.
