This came out yesterday in California. A federal judge has ruled that the 10 day waiting period to buy a gun is not constitutional. However, before pro-second amendment people start jumping for joy, there are a few little details.<\/p>\n

The ruling only covers those who have already been granted permission to exercise their right to keep and bear arms in California. First time buyers still have to go through the waiting period. Here are some details from Fox News<\/a>:<\/p>\n

A federal judge in California has struck down a law that requires a 10-day waiting period for gun purchases, but only for current gun owners who have already passed a background check and those who have a permit or certificate of eligibility to own a gun. Eastern District of California Judge Anthony W. Ishii said Monday that the waiting period provision violates the Second Amendment rights of those who have already been approved to own a gun. This includes those who have previously undergone a background check and own a gun, people with concealed-carry permits and people who have a state certificate of eligibility to own a gun. <\/i><\/p>\n<\/blockquote>\n

Now the fly in the ointment here is that this doesn\u2019t outright cancel the waiting period. The judge refused to make this a ruling on the constitutionality of the waiting period.<\/p>\n

First-time gun buyers would still be subject to the waiting period, which Ishii emphasized in his ruling.<\/em><\/p>\n

\u201cGiven the nature of the challenges made, the Court emphasizes that it is expressing no opinion on the constitutionality of the 10-day waiting period in general or as applied to first time California firearms purchasers,\u201d he said.<\/em><\/p>\n<\/blockquote>\n

This case was brought by a pair of gun owners in California along with a pair of gun rights groups. The plaintiffs see this as a big win, and considering that California pretty much refuses to acknowledge the constitution, or the rights of American citizens, this is a fairly big slap in the face. However, it doesn\u2019t go far enough. California is one of the most hostile states in the union when it comes to the Second Amendment. The entire democratic caucus of the state legislature, when they aren\u2019t running guns themselves<\/a>, wants to confiscate all firearms in private hands.<\/p>\n

\"Texas_Flag_Come_and_Take_It\"<\/a><\/p>\n

This may seem to be an over the top view, but the state legislature is constantly putting out bills and laws that not only strip people of their Second Amendment rights, they also go after a good chunk of the Bill of Rights as well. Little things like being secure in your home and papers, (4th<\/sup> amendment<\/a>), due process, (5th<\/sup> amendment<\/a>) and having your day in court (6th<\/sup> amendment<\/a>). It seems that in California, the ones who have rights are not even supposed to be in the United States in the first place<\/a>.<\/p>\n

Recently, there was a lawsuit regarding the issuance of Concealed Carry permits. The 9th<\/sup> Circus<\/i><\/span> Circuit court, in a surprising ruling<\/a>, said that California had to stop playing games and issue permits to people who have not lost their right to own a gun through due process. The counties decided not to appeal, however the state attorney general is pushing the issue. (There are questions of standing I believe)<\/p>\n

California, actually any state that is run by the Democrats, despises the Second Amendment. (They aren\u2019t all that thrilled with the rest of the Constitution for that matter) They will do literally anything to take guns away from private citizens, with the notable exception of the \u201cDemocrat Elite\u201d of course.<\/p>\n

There is a reason people are looking to lawfully carry guns these days. It can be summed up in one word. Crime.<\/p>\n

The Progressive Liberal Fascist Democrats, along with a few RINO\u2019s would have you believe that the police will protect you. Nothing could be further from the truth. Repeated decisions by the Supreme Court have ruled that the individual cannot expect to be protected by police. Most states understand this which is why they are rolling back all the anti-gun laws they passed over the last century or so. This is why you see people like the James Craig, the Chief of Police in Detroit are saying that more people should be armed. They know that while a police officer will, generally, do his best to stop a criminal, they can\u2019t be everywhere. People in Detroit took his message to heart and hardly a week goes by where you see a criminal being stopped by a citizen with a gun.<\/p>\n

In California, along with other \u201cBlue\u201d states, you only right you have is to be robbed, beaten, raped and murdered. If you dare do anything to defend yourself, they will do what they can to punish you and not the actual criminal. Well, people have had enough of that nonsense and this is why you\u2019re seeing more and more challenges to overturn gun control laws. Personally, I\u2019m waiting for the case where a person uses the previous court rulings on police protection and say that the State, (or city, whatever), isn\u2019t required to protect someone, then they have no right to prevent that person from seeking and carrying the tools need to defend themselves.<\/p>\n
