As we all know, The Affordable Care Act, also known as Obamacare, was rammed down the throats of Americans a few years ago. It was unwanted then and is even more unwanted now. One of the tools the PLFD’s used to shove this through was a program of subsidies for those who couldn’t afford the \u201cNearly Free\u201d health insurance everyone is mandated to buy.<\/p>\n
The problem arose when it was found that there was a plain language statement that said that the subsidies were only available to states that had their own exchanges. As we’ve seen from day one of the Obamacare fiasco, most of the state run exchanges, even those in states that love socialism and backed Obamacare wholeheartedly, collapsed completely. Some of them never worked and others were so bad people couldn’t use them. In any case, states with no exchanges, or those whose exchanged failed, had to send their residents to the federal exchange to by obamacrap<\/i><\/span> Obamacare insurance.<\/p>\n And that is where the latest challenge originated. That section of the Obamacare law stated clearly that the subsidies were only for the state exchanges. The Internal Revenue Service, on orders from Obama, and in apparent violation of the law, handed out subsidies to everyone who thought they qualified.<\/p>\n Now the states that didn’t set up their exchanges are suing over actions of the Obama regime. The case has progressed through the courts, and it looks like Obama is going to lose and all those people will have to give back the subsidies. This will render Obamacare to expensive, and this is why Obama went on a tear against the Court. Here are some of the details from Fox News:<\/p>\n President Obama bluntly challenged the Supreme Court over a pending ruling on the validity of ObamaCare subsidies, complaining Monday that the court should never have taken up the case — and warning that a ruling against subsidies would be a “twisted interpretation” of the law.<\/i><\/p><\/blockquote>\n Consider that Obama has a very loose relationship with the law and the Constitution, this statement isn’t at all surprising. In fact, it’s something you would hear from your average dictator right before he rounded up the justices and had them shot.<\/p>\n The president’s comments on Monday, during a press conference on the sidelines of the G-7 summit in Germany, were perhaps his toughest to date. He strongly suggested the court would be running afoul of established legal guidance if it rules against the administration, and took the rare step of saying the court should have stayed out of this fight.<\/i><\/p><\/blockquote>\n Once again we see Obama having an issue with that pesky 1st<\/sup> Amendment, specifically the part about seeking redress for grievances.<\/p>\n Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances<\/strong>.<\/i><\/p><\/blockquote>\n “This should be an easy case. Frankly, it probably shouldn’t even have been taken up,” Obama said.<\/i><\/p><\/blockquote>\n And here Obama is both very right and very wrong at the same time. It is an easy case if the justices follow the law and Constitution. The section of Obamacare law is plainly written. So plainly anyone can understand it. This is why the courts took up the case. Obama was outright ignoring the law that he signed.<\/p>\n I can’t say how the Supreme Court will rule. When they had a chance to rule this disaster unconstitutional, Chief Justice John Roberts caved in to the pressure from the New York Times and rewrote the law from the bench. (Frankly, he and the other four who did this should have been impeached and removed, but with this ruling backing the Democrats power grab, that wasn’t going to happen)<\/p>\n This time, if the court follows the plain language of the law, they will have no choice but to rule that the subsidies going to states without exchanges is unconstitutional. I think that Obama realizes this and that it will finally start the death spiral of his namesake law. Of course, being Obama, he could just ignore the courts the same way he ignores Congress and do what he wants.
