This is case regarding the Obamacare subsidies. In a nutshell, the way the Obamacare law is written, only the states that set up and run their own Obamacare exchanges are entitled to a taxpayer subsidy. The plan was to force states into creating exchanges so they could get their free money. In fact, this was exactly what Jonathon Gruber had in mind when he helped write this abomination.

There was just one or two small problems. More then half the states decided not to set up exchanges, instead forcing people into the federal exchange, and of those states that did set up their own exchanges, most failed miserably and either didn’t work or have been shut down.

According to the Obamacare law as written, people in those states were not entitled to a subsidy. After people heard the arguments given to the justices, and their questions, it doesn’t look good for the subsidies. That has set off the Obama minions as they begin to realize that the court won’t just rewrite the law to help them out. To refresh your memory, here is the section in question:

The monthly premiums for such month for 1 or more qualified health plans offered in the individual market within a State which cover the taxpayer, the taxpayer’s spouse, or any dependent (as defined in section 152) of the taxpayer and which were enrolled in through an Exchange established by the State under 1311 of the Patient Protection and Affordable Care Act.

The key part there is “an Exchange established by the State.” In the United States, referring to “The State” has a very specific meaning. It doesn’t refer to the central Federal Government and it never has. For the Supreme Court to rewrite this would be to toss the entire foundation of this country out the window. Considering that to do so would probably mean states outright refusing to acknowledge the court, this could set up a full blown constitutional crises that the court would lose.

It’s beginning to sink in to the Obama regime that the odds are they will lose this case, especially after the hammering Chief Justice John Roberts took after his last bad decision on Obamacare. Thanks to that decision, the court is being held in the lowest regard since the Civil War. Now, in preparation to the anticipated crushing defeat, Obama and his thugs are trying to make it look like this is the Republicans fault and that they have to fix the mess Obama, Pelosi and Reid made. Here are some of the details from Fox News:

President Obama’s top health official testified Wednesday that if the Supreme Court issues a ruling that upends the Affordable Care Act, it’s up to Congress and the states to figure out a solution. Health and Human Services Secretary Sylvia Mathews Burwell, testifying before the House Ways and Means Committee, addressed questions over what will happen if the court rules against the administration on the health law. Burwell made clear that the administration is not offering an alternative plan at this point, and instead wants Congress and the states to work it out.

In other words, “If we can’t have it our way, then Eff You!
