Good day all. The other day I wrote a post<\/a> regarding Cankles IT Systems Administrator. He as called to testify at a civil trial regarding Hillary Clinton\u2019s email. He refused to testify citing his 5th<\/sup> Amendment right not to on the grounds it could incriminate him.<\/p>\n

This struck me as odd since Bryan Pagliano was granted immunity from prosecution by the Department of Justice. Since he was granted immunity, anything he said could not be used against. Well, it seems the judge in the case, Emmet Sullivan, is wondering about this as well. He\u2019s ordered Pagliano, to produce the agreement. Here are some of the details from The Hill<\/a>:<\/p>\n

A federal judge has ordered a former State Department IT expert to hand over the immunity agreement he has reportedly reached with the Justice Department as part of the investigation connected to Hillary Clinton<\/a>\u2019s private email server. <\/b><\/p>\n

The order late on Friday afternoon postpones Bryan Pagliano\u2019s deposition with conservative watchdog organization Judicial Watch until further notice. The interview had been scheduled to take place on Monday. Pagliano\u2019s lawyers have said that he had been planning to assert his<\/a> Fifth Amendment rights against self-incrimination.<\/b><\/p>\n

The case that Pagliano is trying to avoid testifying in is a civil Freedom of Information case against Cankles Clinton and her staffers. It was this case that really blew open the doors on the Clinton team\u2019s, well call it what it is, attempts to cover up the fact that she had broken a number laws with her personal Email server.<\/p>\n

\"Hillary-Clinton-liar\"<\/a><\/p>\n

As I mentioned above, Pagliano, who set up and maintained the server, was given immunity from prosecution and apparently has been testifying on the server. Since he was granted immunity, most people thought that he could be forced to testify in this civil case as well. Apparently, so does the judge and he wants to see the agreement.<\/p>\n

But on Friday, Judge Emmet Sullivan declared that Pagliano\u2019s lawyers need to file a legal memorandum outlining the legal authority for him to claim plead the Fifth, \u201cincluding requisite details pertaining to the scope of Mr. Pagliano’s reported immunity agreement with the government.\u201d <\/b><\/p>\n

The order will likely shed some light on the terms of Pagliano\u2019s agreement with the Justice Department, which was seen as a potential vulnerability<\/a> for Clinton in the FBI\u2019s probe. <\/b><\/p>\n

In other words, Judge Sullivan is telling Pagliano\u2019s lawyers to put up or shut up. If the agreement also covers civil cases, then Pagliano can\u2019t assert his rights under the 5th<\/sup> Amendment. He may consume a 5th<\/sup> however. In the meantime, the judges order prevents any attempt by the Judicial Watch lawyers from questioning Pagliano, at least until Judge Sullivan can read the agreement and make a ruling on it.<\/p>\n

I have a suspicion that Pagliano and his lawyers may be playing games. We don\u2019t know what he has told the FBI, however, there are rumors that he may have been required to testify before a Federal Grand Jury. There is a blog post by someone purporting to be a college student and a Comrade Bernie supporter on Cankles and her tribulations. This post goes into very lengthy detail and basically ties all the questions and allegations into one fairly neat package.<\/p>\n

I recommend taking a look at it. It was there that I read about the probability that a Grand Jury has already been empaneled and is looking into Hillary Clinton\u2019s criminal career. If you do go through it, make yourself comfortable, it\u2019s a good 20 pages long.<\/p>\n
