It didn\u2019t take long for the first use of the \u201cCankles Defense\u201d to be made. Here are some of the details from McClatchy DC<\/a>:<\/p>\n The FBI recommendation not to prosecute Hillary Clinton and her staff on charges of mishandling classified information will give those accused of flouting national security rules a new line of defense even as it highlights a dual standard in how senior government officials are treated, several experts said Wednesday.<\/b><\/p>\n Gee, ya think?<\/p>\n FBI Director James Comey recommended Tuesday that no charges be filed <\/a>against Clinton or her team for their handling of classified information while she was secretary of state, even though she was \u201cextremely careless\u201d in using a private email address and servers. Attorney General Loretta Lynch announced Wednesday that she agreed with Comey\u2019s assessment.<\/b><\/p>\n As Donald Trump said that night and last night in campaign appearances, since Clinton said she would like to keep Lynch on, and we have Bill Clinton secretly meeting with here, it looks an awful lot like some quid pro quo is taking place. Now lawyers are champing at the bit. They can\u2019t wait to try this out in a courtroom.<\/p>\n Lawyers who specialize in representing government and military officials who\u2019ve had security clearances revoked said Comey\u2019s recommendation offered them a new tactic in seeking to rehabilitate their clients, especially if Clinton is elected president in November. <\/b><\/p>\n \u201cI intend to use the Hillary defense,\u201d said Sean M. Bigley, a lawyer whose firm handles dozens of cases a year involving national security clearances. \u201cI really question how any agency can say someone is a security risk if the president of the United States did something similar. <\/b><\/p>\n He added, \u201cWe\u2019ve had people lose 20-year careers for doing less than what she did.\u201d<\/b><\/p>\n Mark F. Riley, a former military intelligence officer who became a lawyer defending those accused of national security violations, said he, too, would invoke the Clinton recommendation.<\/strong><\/p>\n \u201cI\u2019m going to use it every chance I get, particularly in oral arguments. I\u2019m going to bring it up over and over and over,\u201d Riley said, adding that he thinks Clinton and her team engaged in \u201can egregious, egregious security violation.\u201d<\/strong><\/p>\n \u201cAny other person would have had their security clearance revoked,\u201d he said.<\/strong><\/p>\n It didn\u2019t take long for the first use of this new defense, provided by the cowardly and incompetent James Comey to be used. Brezler faces a possible discharge after emailing a classified document. Attorneys for people who allegedly mishandled classified information say the outcome of the FBI\u2019s investigation into Hillary Clinton could be good news for their clients. <\/b><\/p>\n The argument that a free pass for Clinton should allow leniency for others soon will be tested in federal court as attorney Michael Bowe argues Marine Reserves Maj. Jason Brezler should not be separated from the military. <\/b><\/p>\n Brezler used a personal email account to send a classified report about an alleged child-raping, drug-dealing Afghan police official to a fellow Marine as a warning, two weeks before one of the man\u2019s apparent rape victims murdered three Marines. He reportedly knew the document was classified, but felt its status may have changed with time. <\/b><\/p>\n So a United State Marine, trying to protect American forces, sent a classified report to another marine outside of classified channels. Hmm, sounds like he did the wrong thing for all the right reasons, unlike Hillary Rodham Clinton who did all the wrong things for all the wrong reasons.<\/p>\n Bowe intends to argue that Brezler deserves leniency and that his recommended punishment<\/a> is arbitrary and capricious, particularly in light of Clinton’s conduct. He expects a ruling this fall. <\/b><\/p>\n \u201cWe intend to cite the treatment of Secretary Clinton as one of the many — and most egregious — examples of how the severe treatment of Major Brezler was the very definition of an arbitrary and capricious double standard,\u201d Bowe says. <\/b><\/p>\n He adds: \u201cIt is impossible to reconcile the commander-in chief\u2019s statement [in April] that Secretary Clinton\u2019s intentional act of setting up a secret, unsecured server on which rested the most sensitive classified information did not \u2018detract from her excellent ability to carry out her duties\u2019 with the completely opposite finding for Major Brezler based on an allegedly inadvertent mistake involving infinitely less sensitive and limited information.\u201d<\/b><\/p>\n Congratulations Director James \u201cYou incredible cowardly moron\u201d Comey, you have just tossed decades of legal precedent right out the window because you were to gutless to do your job. This Marine broke the law in order to try and save lives. The criminal you are protecting did what she did in order to protect herself from Congress, and the general public. With your refusal to do your job, you have just opened up a can of worms under the equal protection clause of the United States Constitution.
