Last week, the 9<sup>th<\/sup> Circuit court of Appeals lived down to its nickname as the 9<sup>th<\/sup> Circus. They upheld the blatantly unconstitutional temporary restraining order issued by a federal judge to prevent President Trump from putting a temporary hold on travelers from certain countries.<\/p>\n<p><a href=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2016\/11\/totally-shocked.jpg\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-medium wp-image-22809\" src=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2016\/11\/totally-shocked-300x200.jpg?resize=300%2C200\" alt=\"\" width=\"300\" height=\"200\" srcset=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2016\/11\/totally-shocked.jpg?resize=300%2C200&amp;ssl=1 300w, https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2016\/11\/totally-shocked.jpg?w=400&amp;ssl=1 400w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p><!--more--><\/p>\n<p>Since the order was upheld, it\u2019s come out that neither the original judge, nor the judges on the 9<sup>th<\/sup> Circus even bothered with the actual statutes that President Trump was working with when he issued the Executive order. This is nothing new for the 9<sup>th<\/sup> Circuit. It\u2019s the most overturned appellate court in the United States, being constantly slapped down by the Supreme Court.<\/p>\n<p><a href=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2016\/03\/shocked-face.png\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-medium wp-image-20636\" src=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2016\/03\/shocked-face-300x225.png?resize=300%2C225\" alt=\"\" width=\"300\" height=\"225\" srcset=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2016\/03\/shocked-face.png?resize=300%2C225&amp;ssl=1 300w, https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2016\/03\/shocked-face.png?w=400&amp;ssl=1 400w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p>There has been talk on what to do with the moonbats on the bench out there. One of the ideas is to break the court up into smaller districts. Currently, the 9<sup>th<\/sup> Circuit handles cases in Guam, Hawaii, Alaska, the coastal states, Idaho, Montana, Nevada and Arizona. There have been a number of plans to create two or more courts, but until recently, the idea has always been shot down. Now, Congress might decide the time to act has arrived. Here are some details <a href=\"https:\/\/web.archive.org\/web\/20180725043150\/http:\/\/www.foxnews.com\/politics\/2017\/02\/09\/bill-to-split-nutty-9th-circuit-gains-momentum.html\" target=\"_blank\" rel=\"noopener noreferrer\">from Fox News<\/a>:<\/p>\n<p style=\"padding-left: 30px;\"><b>As judges on the 9<sup>th<\/sup> Circuit Court of Appeals weigh the legality of President Trump\u2019s immigration executive order, a Republican push to split up the controversial court &#8212; and shrink its clout &#8212; is gaining steam on Capitol Hill. Republican Sens. Jeff Flake and John McCain of Arizona introduced legislation last month to carve six states out of the San Francisco-based court circuit and create a brand new 12th Circuit. <\/b><\/p>\n<p style=\"padding-left: 30px;\"><b>They argue that the 9<sup>th<\/sup> is too big, too liberal and too slow resolving cases. If they succeed, only California, Oregon, Hawaii and two island districts would remain in the 9th&#8217;s judicial fiefdom. Right now, Flake said, the circuit is far too sprawling.<\/b><\/p>\n<p style=\"padding-left: 30px;\">\u201c<b>It represents 20 percent of the population &#8212; and 40 percent of the land mass is in that jurisdiction. It\u2019s just too big,\u201d <a href=\"http:\/\/video.foxnews.com\/v\/5315583740001\/?#sp=show-clips\" target=\"_blank\" rel=\"noopener noreferrer\">Flake told Fox News<\/a> on Wednesday. \u201cWe have a bedrock principle of swift justice and if you live in Arizona or anywhere in the 9<\/b><sup><b>th<\/b><\/sup><b> Circuit, you just don\u2019t have it.\u201d <\/b><\/p>\n<p>One of the things that would happen, if the court is broken up, is that the moonbats on the bench will find their influence reduced. A second, and far more important thing would be the speeding up of decisions.<\/p>\n<p style=\"padding-left: 30px;\"><b>Flake says it typically takes the court 15 months to hand down a decision. <\/b><b>\u201cIt\u2019s far too long,\u201d he added<\/b>.<\/p>\n<p>I believe the phrase, \u201cJustice delayed is justice denied\u201d would apply here. We also have the contempt for the constitution these knotheads have. One of the reasons the court is constantly overridden by the Supreme Court, in many cases unanimously, is the utter contempt the judges seem to have for, pretty much everything this country stands for.<\/p>\n<p style=\"padding-left: 30px;\"><b>Conservatives have mocked the 9<sup>th<\/sup> Circuit for years, often calling it the \u201cNutty 9<sup>th<\/sup>\u201d or the \u201c9<sup>th<\/sup> Circus,\u201d in part because so many of its rulings have been overturned by the U.S. Supreme Court.<\/b><\/p>\n<p style=\"padding-left: 30px;\"><b>The court has a reputation as one of the most liberal in the country, in large part because of its makeup. Eighteen of the court\u2019s 25 active judges have been appointed by Democrats. Former President George W. Bush appointed six justices, while former President Barack Obama appointed seven.<\/b><\/p>\n<p><a href=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2013\/01\/constitution-Void-where-prohibited-by-Obama.jpg\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-10616\" src=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2013\/01\/constitution-Void-where-prohibited-by-Obama.jpg?resize=300%2C235\" alt=\"\" width=\"300\" height=\"235\" srcset=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2013\/01\/constitution-Void-where-prohibited-by-Obama.jpg?w=300&amp;ssl=1 300w, https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2013\/01\/constitution-Void-where-prohibited-by-Obama.jpg?resize=150%2C117&amp;ssl=1 150w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p>Liberal doesn\u2019t describe it. Some of their rulings, later overturned, have been in direct opposition to things like the Bill of Rights. Honestly, if we had a real, honest congress, a number of these judges would have been invited to step down, and if they refused, impeached and removed. Since we don\u2019t have an honest congress, (Thanks primarily to the Democrats). We have to move to the next step, breaking them up.<\/p>\n<p style=\"padding-left: 30px;\"><strong>Under Flake\u2019s bill, the new circuit would cover Nevada, Washington, Idaho, Montana, Arizona and Alaska, leaving the 9<sup>th<\/sup> with three Pacific states as well as the Northern Mariana Islands and Guam. A separate House version introduced by Rep. Andy Biggs and four other Arizona Republicans would leave Washington state in the 9<sup>th<\/sup> Circuit.<\/strong><\/p>\n<p>I would suggest these two get together and hammer out just what they want to do, instead of leaving it up to a reconciliation committee. It sounds like they\u2019re of the same mind, but need to work out a few details. Of course, this means they actually have to do their jobs, and we know that Senators and Representatives hate anything that cuts into their golf time, cocktail parties and <span style=\"text-decoration: line-through;\"><i>solicitations for bribes<\/i><\/span>, campaign fund raising. The other problem is that the court will fight being broken up.<\/p>\n<p style=\"padding-left: 30px;\">\u201c<b>The problem is the judges in the 9<sup>th<\/sup> Circuit, particularly the liberal judges, don\u2019t want to give up any of their jurisdiction,\u201d Flake said.<\/b><\/p>\n<p><a href=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2013\/11\/give-a-damn.gif\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-13455\" src=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2013\/11\/give-a-damn.gif?resize=100%2C100\" alt=\"\" width=\"100\" height=\"100\" \/><\/a><\/p>\n<p style=\"padding-left: 30px;\"><b>Democratic strategist Joe Lestingi pushed back on accusations the court leans left. <\/b><\/p>\n<p style=\"padding-left: 30px;\">\u201c<b>We don\u2019t complain about courts being too conservative,\u201d he told Fox News. \u201cThe truth is\u2026 the liberal side of that court provides the conflict we need to settle our most basic disagreements.\u201d <\/b><\/p>\n<p><a href=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2016\/01\/steaming_pile_of_horseshit.jpg\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-medium wp-image-20194\" src=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2016\/01\/steaming_pile_of_horseshit-300x223.jpg?resize=300%2C223\" alt=\"\" width=\"300\" height=\"223\" srcset=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2016\/01\/steaming_pile_of_horseshit.jpg?resize=300%2C223&amp;ssl=1 300w, https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2016\/01\/steaming_pile_of_horseshit.jpg?w=500&amp;ssl=1 500w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p style=\"padding-left: 30px;\"><b>He added that the 9<sup>th<\/sup> Circuit\u2019s track record of rulings being overturned &#8212; sometimes unanimously by the U.S. Supreme Court &#8212; is all part of the judicial process. <\/b><\/p>\n<p style=\"padding-left: 30px;\">\u201c<b>If the Supreme Court wasn\u2019t going to overturn lower courts&#8217; decisions, then we don\u2019t need a Supreme Court anymore,\u201d Lestingi argued.<\/b><\/p>\n<p><a href=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2012\/04\/bullshit-meter.jpg\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-7298\" src=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2012\/04\/bullshit-meter.jpg?resize=256%2C175\" alt=\"\" width=\"256\" height=\"175\" srcset=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2012\/04\/bullshit-meter.jpg?w=256&amp;ssl=1 256w, https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2012\/04\/bullshit-meter.jpg?resize=150%2C102&amp;ssl=1 150w\" sizes=\"auto, (max-width: 256px) 100vw, 256px\" \/><\/a><\/p>\n<p>The 9<sup>th<\/sup> Circus\u2019s record for being overturned is not part of the process. Yes, courts do get overturned. However, the 9<sup>th<\/sup> Circus\u2019s record indicates to the average person, (Those who pay attention to these things), that there is something really wrong here. I fully agree that we should break up the court, and perhaps not into two districts, but perhaps into three or even four.<\/p>\n<p>I also think it\u2019s long past time to start limiting the time judges can be on the bench. It used to be, a very long time ago, that becoming a federal judge was seen as the final step in a long career. A person would be on the bench for 5 to 10 years, then step down. Today, thanks to a lot of things, about the only way a judge leaves the bench is either feet first or in handcuffs.<\/p>\n<p>Term limits and a recall system may be what else is needed, and that means an amendment to the constitution. The first step though, breaking up the 9<sup>th<\/sup> Circuit and showing the black robed tyrants who is really in charge of the country.
