The usual <span style=\"text-decoration: line-through;\"><i>morons<\/i><\/span> suspects from the student body promptly spent three days protesting the arrests and accusing the bakery of racism.<\/p>\n<p>Rather then pull these young skulls full of progressive sewage back from the edge, the college flat out backed them. Sadly for the moonbats in the student body and the college, the accusations were demonstrably false and the bakery sued the college. Well, the verdict is in and it isn\u2019t good for Oberlin. Here are the details <a href=\"https:\/\/www.foxnews.com\/politics\/oberlin-college-to-pay-bakery-over-11-m-after-accusing-it-of-racial-profiling\" target=\"_blank\" rel=\"noopener noreferrer\"><b>from Fox News<\/b><\/a>:<\/p>\n<p style=\"padding-left: 40px;\"><b><a href=\"https:\/\/www.foxnews.com\/us\/oberlin-college-accused-of-bullying-small-business-over-students-arrests\" target=\"_blank\" rel=\"noopener noreferrer\">Oberlin College<\/a> in Ohio will have to pay <a href=\"https:\/\/www.foxnews.com\/food-drink\/gibsons-bakery-sues-oberlin-college-over-racism-protests\" target=\"_blank\" rel=\"noopener noreferrer\">a nearby bakery<\/a> more than $11 million in damages because it libeled the store, tagging it as racist, and interfered with its business, a jury said on Friday. <\/b><\/p>\n<p><a href=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2016\/03\/shocked-face.png\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-medium wp-image-20636\" src=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2016\/03\/shocked-face-300x225.png?resize=300%2C225\" alt=\"\" width=\"300\" height=\"225\" srcset=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2016\/03\/shocked-face.png?resize=300%2C225&amp;ssl=1 300w, https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2016\/03\/shocked-face.png?w=400&amp;ssl=1 400w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p style=\"padding-left: 40px;\"><b>Gibson&#8217;s Bakery came under fire after Allyn Gibson, the owners&#8217; son, got into <a href=\"https:\/\/www.foxnews.com\/us\/oberlin-college-accused-of-bullying-small-business-over-students-arrests\" target=\"_blank\" rel=\"noopener noreferrer\">a physical altercation<\/a> with a black student who reportedly tried shoplifting and using a fake ID at the store, <a href=\"http:\/\/www.chroniclet.com\/Local-News\/2019\/06\/07\/Gibson-s-Bakery-v-Oberlin-College-More-than-11-million-awarded.html\" target=\"_blank\" rel=\"noopener noreferrer\">The Chronicle-Telegram said<\/a>. Two other black students got involved, appearing to prompt accusations of racial profiling. <\/b><\/p>\n<p>There was just one small problem with all this. The students were guilty as hell.<\/p>\n<p style=\"padding-left: 40px;\"><b>The three students eventually pleaded guilty to misdemeanor charges and read statements defending Allyn Gibson&#8217;s right to detain them. They also read statements claiming that his actions weren&#8217;t racially motivated, but within days of the incident, students were turning out for protests fueled by accusations of racist intent. <\/b><\/p>\n<p>Never underestimate the stupidity of students attending a Progressive college. The one thing that they are never taught is actual thinking. As for the college administration? Instead of trying to explain things to these young skulls full of raw sewage, they joined in on the attacks. Gibson\u2019s Bakery then decided to do something highly unusual. This could be up to $22 million dollars on top of the original $11 million dollar judgment. Rather than pulling back, Oberlin doubled down on their stupidity. According <a href=\"https:\/\/legalinsurrection.com\/2019\/06\/oberlin-college-mass-email-criticizing-jurors-could-influence-punitive-damages-hearing-in-gibsons-bakery-case\/\" target=\"_blank\" rel=\"noopener noreferrer\"><b>to Legal Insurrection<\/b><\/a>:<\/p>\n<p style=\"padding-left: 40px;\"><b>As <a href=\"https:\/\/legalinsurrection.com\/2019\/06\/verdict-jury-awards-gibsons-bakery-11-million-against-oberlin-college\/\" target=\"_blank\" rel=\"noopener noreferrer\">mentioned<\/a> numerous times, \u201c<a href=\"https:\/\/legalinsurrection.com\/2017\/12\/oberlin-college-lashes-out-at-gibsons-bakery-in-court-filing-portrays-itself-as-victim\/\" target=\"_blank\" rel=\"noopener noreferrer\">from the start of this case<\/a> I have questioned the aggressive and demeaning attacks on the Gibsons as a defense strategy,\u201d <a href=\"https:\/\/legalinsurrection.com\/2019\/05\/gibsons-bakery-v-oberlin-college-trial-day-12-defense-says-bakery-worth-only-35k-less-than-one-semester-at-oberlin-college\/\" target=\"_blank\" rel=\"noopener noreferrer\">and<\/a> \u201cI\u2019m still shaking my head at the tone-deafness of the defense in belittling this family business.\u201d The jury seems to have agreed, rendering a combined <a href=\"https:\/\/legalinsurrection.com\/2019\/06\/verdict-jury-awards-gibsons-bakery-11-million-against-oberlin-college\/\" target=\"_blank\" rel=\"noopener noreferrer\">$11.2 million<\/a> compensatory damages verdict against Oberlin College and its Dean of Students, Meredith Raimondo. <\/b><\/p>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-medium\" src=\"https:\/\/i0.wp.com\/i.pinimg.com\/originals\/35\/3b\/cd\/353bcd3d24ce03c0b3d66439c851b4c7.jpg?resize=276%2C182&#038;ssl=1\" width=\"276\" height=\"182\" \/><\/p>\n<p style=\"padding-left: 40px;\"><b>The next stage is a punitive damages hearing, since the jury found the defendants acted with intent and malice. A separate punitive damages hearing is required under the Ohio Tort Reform legislation that passed several years ago. The point is to keep some of the more inflammatory evidence that does not go to liability or compensatory damages away from the jury during the initial deliberations. That additional evidence relevant to punitive damages could include information as to the wealth of the defendants, but also additional information supporting the need for punishment. <\/b><\/p>\n<p>So you would think that the school and the lawyers for the school would try to do as much as they could to minimize the damages. You would be incorrect.<\/p>\n<p style=\"padding-left: 40px;\"><b>In this context, there is nothing more baffling than a statement sent to alumni after the verdict by Donica Thomas Varner, Oberlin College\u2019s Vice President and General Counsel. <\/b><\/p>\n<p style=\"padding-left: 40px;\"><b>Dear Members of the Oberlin Community:<\/b><\/p>\n<p style=\"padding-left: 40px;\"><b>I am writing to update you on the lawsuit that Gibson Bros., Inc. filed against Oberlin College and Vice President and Dean of Students Meredith Raimondo in the Lorain County Court of Common Pleas in November 2017.<\/b><\/p>\n<p style=\"padding-left: 40px;\"><b>Following a trial that spanned almost a full month, the jury found for the plaintiffs earlier today.<\/b><\/p>\n<p style=\"padding-left: 40px;\"><b>We are disappointed with the verdict and regret that the jury did not agree with the clear evidence our team presented.<\/b><\/p>\n<p style=\"padding-left: 40px;\"><b>Neither Oberlin College nor Dean Meredith Raimondo defamed a local business or its owners, and they never endorsed statements made by others. Rather, the College and Dr. Raimondo worked to ensure that students\u2019 freedom of speech was protected and that the student demonstrations were safe and lawful, and they attempted to help the plaintiffs repair any harm caused by the student protests.<\/b><\/p>\n<p style=\"padding-left: 40px;\"><b>As we have stated, colleges cannot be held liable for the independent actions of their students. Institutions of higher education are obligated to protect freedom of speech on their campuses and respect their students\u2019 decision to peacefully exercise their First Amendment rights. Oberlin College acted in accordance with these obligations.<\/b><\/p>\n<p style=\"padding-left: 40px;\"><b>While we are disappointed with the outcome, Oberlin College wishes to thank the members of the jury for their attention and dedication during this lengthy trial. They wondered why someone with Varner\u2019s experience would do something like this.<\/p>\n<p style=\"padding-left: 40px;\"><b>Someone with such deep experience as Varner should have known better than to send out such a statement in the middle of trial, particularly on the cusp of a punitive damages hearing. I understand the college felt the need to say something, but first do no harm. Simply send out a mass email, since alumni were going to hear about the verdict through the news, indicating that college cannot comment since the trial is ongoing, and that more information will be provided after the trial is over. Or express a vague regret at the verdict and respect for the jurors.<\/b><\/p>\n<p>Which would make sense of course.<\/p>\n<p style=\"padding-left: 40px;\"><b>But for heaven\u2019s sake, don\u2019t make things worse. <\/b><\/p>\n<p style=\"padding-left: 40px;\"><b>Don\u2019t accuse the jurors of disregarding the \u201cclear evidence,\u201d don\u2019t repeat the same failed claim that the college administrators were simply keeping the peace and protecting free speech when numerous witnesses testified otherwise, and don\u2019t claim the college was held liable vicariously when in fact the college\u2019s own conduct was at issue. <\/b><\/p>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-medium\" src=\"https:\/\/i0.wp.com\/i.pinimg.com\/originals\/fb\/7f\/4b\/fb7f4beea9787acd0fe3a770ffd695bb.jpg?resize=292%2C360&#038;ssl=1\" width=\"292\" height=\"360\" \/><\/p>\n<p>I think saying \u201cDon\u2019t make things worse\u201d is, in the case, like closing the door after the horse has left. Oberlin\u2019s insurance carrier has told them that they won\u2019t cover this judgment. According to the <a href=\"https:\/\/www.americanthinker.com\/blog\/2019\/06\/ohoh_oberlin_colleges_insurance_company_says_their_policy_doesnt_cover_the_huge_verdict_against_them_.html\" target=\"_blank\" rel=\"noopener noreferrer\"><b>American Thinker<\/b><\/a>:<\/p>\n<p style=\"padding-left: 40px;\"><b>The insurer that covers Oberlin College for liability, Lexington Insurance Company, filed documents with court last month indicating that its umbrella liability policy would not cover costs of any judgment for the plaintiffs. That means that if, after the appeals process has run its course, the plaintiffs move to collect the $11 million a jury just awarded them (plus whatever punitive damages \u2013 up to $22 more \u2013 are awarded next week), Lexington likely won\u2019t pay and Oberlin would have to sue for reimbursement.<\/b><\/p>\n<p><a href=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2014\/01\/nelson2.gif\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-14000\" src=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2014\/01\/nelson2.gif?resize=300%2C217\" alt=\"\" width=\"300\" height=\"217\" \/><\/a><\/p>\n<p>Now granted, there is a long way to go with this. There is no doubt at all that Oberlin is going to appeal this case as far up as they can. I have a suspicion that it isn\u2019t going to work. While the appeals are underway, interest is accruing on the judgment. Since this could be going on for a few more years, and if Oberlin loses all the way up, that maximum of $33 million dollars is probably going to hit $40 or more million dollars.<\/p>\n<p>If the insurance company also wins, and doesn\u2019t have to cover the judgment, well, that money has got to come from somewhere, and I assume that tuitions will go up and worthless classes will and staff will be cut.. As to the individuals that were sued and lost, I don\u2019t know if the college will indemnify them and cover those judgments. The worst case scenario for the individuals is that Oberlin College walks away from them and they have to cover their share, if any, of the judgments.<\/p>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-medium\" src=\"https:\/\/i0.wp.com\/i.pinimg.com\/originals\/d1\/5c\/37\/d15c37640c8fc05e03c5acc6c678bece.jpg?resize=297%2C261&#038;ssl=1\" width=\"297\" height=\"261\" \/><\/p>\n<p>The next phase should be interesting and very entertaining. As you can imagine, the Left wing Progressives are already screaming about how this \u201cChills the right of free speech.\u201d Of course, these collectivist ninnys have absolutely no problem suppressing the rights of anyone they don\u2019t agree with.
