Good day all. I saw this story Sunday, (March 23rd<\/sup>), and it made my blood boil. The Department of Justice is asking congress for the ability to basically revoke the constitutional rights of the American people.<\/p>\n

They are dressing this up as \u201cWell in case of national emergency and all\u201d, but considering the past history of the DoJ, you know they will abuse this. Here are the details from Reason<\/b><\/a>:<\/p>\n

The Justice Department is using the COVID-19 outbreak to press for sweeping new powers that include being able to detain Americans indefinitely without a trial, Politico<\/em> reports<\/a>.<\/p>\n

The department is asking Congress to allow the U.S. attorney general to ask courts to suspend court proceedings. These include “any statutes or rules of procedure otherwise affecting pre-arrest, post-arrest, pre-trial, trial, and post-trial procedures in criminal and juvenile proceedings and all civil process and proceedings,” reports Betsy Woodruff Swan, citing DOJ documents presented to Congress. <\/b><\/p>\n

In other words, the Justice Department would be able to postpone trials, hearings, and other procedural steps that follow arrest. That represents a potentially huge violation of the constitutional right to a speedy trial.<\/b><\/p>\n

Gee, ya think? This plan, if passed would basically shut down most of the Bill of Rights and several sections of the Constitution. It would also be considered unconstitutional on it\u2019s face. The constitution lays out very specific terms for revoking Habeas Corpus. It requires either a civil war or an invasion, and even then, it has to be done with a great deal of thought. What this looks like is that they can revoke your rights any time they decide to declare some sort of emergency.<\/p>\n

Those powers would apply “whenever the district court is fully or partially closed by virtue of any natural disaster, civil disobedience, or other emergency situation,” Woodruff Swan writes, and would remain in place for “one year following the end of the national emergency.”<\/b><\/p>\n

“The DOJ proposal is deeply troubling and would raise a whole host of constitutional concerns,” says Scott Bullock, president and general counsel for the Institute for Justice, a libertarian law firm<\/b>. “<\/b><\/em>History demonstrates again and again that governments use a crisis to expand power and violate vital constitutional principles. And when the supposed emergency is over, the expanded powers often become permanent.”<\/b><\/p>\n

See the Patriot Act as an example. This was passed right after the 9\/11 attack, without any real thought. We\u2019re seeing just how bad it is now, with President Trump himself being a target of abuse. (The attempted coup by the DoJ and other Deep State parties)<\/p>\n

Clark Neily, vice president for criminal justice at the Cato Institute, says the Justice Department should not be trusted with more expansive powers. <\/b><\/p>\n

“If history is any indication, it’s a near certainty that these powers will be abused and that DOJ will try to hide those abuses when they occur,” says Neily. “This is simply not an agency that has earned the kind of trust implied by these requests for increased authority and discretion.”<\/b><\/p>\n

Of course they will be abused. We see it happen all the time, and of late, we\u2019re starting to see reactions to these sorts of things. The last time was the actions of the Bureau of Land Management with regards to the Bundy Ranch incident. The BLM was observed, repeatedly, abusing their authority and trampling all over the constitution.<\/p>\n

This led to several thousand people showing up, armed to the teeth and setting up camp. Everything came to a head when it was discovered that the BLM had started destroying the Bundy\u2019s property, (Their cattle), with no legal justification. From what I\u2019ve heard, it was a very near thing. The militia groups started preparing to put a stop to the BLM, and someone in authority figured out that massacre of federal agents was in the cards and order the everyone out and fast.<\/p>\n

Then they started the next phase, lawfare. That also blew up in the faces of the Federal government with juries refusing to convict the Bundy\u2019s and others of the shopping cart full of charges the DoJ threw at them. They finally gave up. I\u2019m not sure what civil actions may be underway towards the federal government actions.<\/p>\n

In the end, when this story exploded all over the internet, most in congress were furious and told the DoJ to not even bother submitting this disgrace. What I want to know is, was this approved of by Attorney General William Barr, or was it put out by some low level Obama holdover? If the latter, this person should be promptly shown the door and stripped of their law license if he or she has one.<\/p>\n

If the former, then William Barr must go. He was brought into the Justice Department to fix the abuses committed under the previous administration(s), not add to them. We need to find out what idiot dreamed this up. Sadly, the CommuNazi Propaganda Corps can\u2019t be bothered, so someone else will have to do it.<\/p>\n
