Good day all. The Flynn Affair continues to wind it\u2019s way through the courts thanks to the corrupt judge, Emmett Sullivan. After a three judge appeal issued a write of Mandamus, Sullivan, who has decided that he is Judge Dredd, appealed the decision.<\/p>\n

The dispute over the Department of Justice’s<\/a> move to dismiss criminal charges against former Trump national security adviser Michael Flynn<\/a> will get a rehearing by the entire District of Columbia Circuit Court of Appeals<\/a>, the latest twist in the long-running legal drama that stemmed from the FBI’s investigation into possible collusion between the Trump campaign and Russia in 2016. <\/b><\/p>\n

The order was issued Thursday by the court. Called an “en banc” hearing, all 11 judges on the appeals court will sit in on a rehash of arguments that were made before a three-judge panel in June, which led to a 2-1 ruling in favor of Flynn. The former Trump aide had requested the appeals court to order the judge in the case to approve of a Department of Justice (DOJ) motion to dismiss charges against him. <\/b><\/p>\n

The District of Columbia Circuit Court of Appeals was stacked with Obama judges thanks to Dingy Harry Reid. We have seen the contempt for the Constitution and the Rule of Law most of the Obama judges have, with some of these leftist thugs issuing rulings they have no right to do. They have been generally overturned by the United States Supreme Court, but being good little black robed tyrants, they continue to abuse their position.<\/p>\n

D.C. District Court Judge Emmet Sullivan, however, did not immediately grant the unusual request motion by the DOJ to drop the charges of lying to investigators after Flynn pleaded guilty. Flynn had sought to withdraw the guilty plea. Sullivan made his own unusual move of his own to appoint an “amicus curie” — Latin for “friend of the court” — to argue against the position taken by Flynn and the DOJ.<\/b><\/p>\n

And this is patently illegal. In fact, just a month before Sullivan went Judge \u201cI AM…The LAW!\u201d Dredd<\/a>, the United States Supreme Court, in a unanimous ruling, slapped down the 9th<\/sup> Circus for doing the same thing. Sullivan had to know about that ruling. Sullivan had to know about it. He just decided that he is the law and that he can do whatever he wants. (FYI, this moonbat Judge is a Clinton Appointee)<\/p>\n

Flynn’s legal team, opposing a rehearing, submitted a fiery brief to the court last week. <\/b><\/p>\n

“Judge Sullivan\u2019s stubborn disagreement with the Government\u2019s decision to dismiss the case does not confer the right to contest it himself or through his amicus,” Flynn’s lawyers, including Sidney Powell, said. “His actions smack of vindictive animus against General Flynn and judicial overreach that have no place in America\u2019s justice system. No precedent even suggests a ‘hearing’ on a substantial government motion to dismiss. Not one.” <\/b><\/p>\n

There is actually a discussion, (More like a flat out virtual beating with a crowbar), going on at Baen\u2019s Bar in Politics. A troll has come in and started arguing that the judge has the right to pursue the case even though the Department of Justice is dropping it. Most people in that forum are Americans or are familiar with the American judicial system. Since this bozo is a hardcore leftist he is insisting that he is right and everyone else, including some lawyers, are wrong. (He also gives the appearance of not being an American) Hence, the virtual clubbing with facts.<\/p>\n

Flynn’s lawyers added: “The umpire cannot force the teams to play extra innings after the game is over. He, the players, and the spectators need to go home and turn off the floodlights.” <\/b><\/p>\n

“Judicial decisions are supposed to be based on the record before the court, not speculation about what the future may hold. All the district court has done is ensure adversarial briefing and an opportunity to ask questions about a pending motion,” a brief for Sullivan said. “Considering both sides of an issue before ruling is not [beyond a judge’s authority]\u2014it is sound judicial practice.” <\/b><\/p>\n

Emmett Sullivan has forgotten that it is the executive branch that investigates and brings criminal cases to the court. The court hears the evidence, along with the jury, and issues rulings and if needed, issues the sentence. Since the sentencing has not occurred, and the Department of Justice has dropped the charges, (Mostly due to the flat out fraud perpetrated on the Court by the prosecutor and the FBI), Flynn is free to go about his business.<\/p>\n

It now appears that Sullivan\u2019s sole job in all this was to make sure Flynn was jailed, come Hell or high water. The entire case against General Flynn hasn\u2019t just fallen apart, it has exploded in the faces of the Deep State. Now there is a very good chance that the people going to jail will be those that tried to frame General Michael Flynn. I think we need to add judge Emmett Sullivan to the list of conspirators.<\/p>\n
