Good day all about a month ago, US District Court judge Roger Benitez overturned Kalifornistan\u2019s 30 year ban on rifles and other firearms stating that the law was flat out unconstitutional. He also knew that Kalifornistan would appeal to the 9th<\/sup> Circus and stayed his ruling for 30 days. He also knew what the 9th<\/sup> Circus would do.<\/p>\n

Right on schedule, the 9th<\/sup> Circus overturned Judge Benitez\u2019s ruling, reinstating the ban on the United States Constitution Here are the details of that corrupt court\u2019s actions from Fox News<\/b><\/a>:<\/p>\n

The 9th Circuit Court of Appeals temporarily blocked a federal district court ruling that would have repealed California’s assault weapons ban.<\/strong><\/p>\n

In a Monday panel decision in Miller v. Bonta, the appellate court put the June 4 order from District Court Judge Roger Benitez old hold as the court awaits the outcome of another case. Benitez had ruled that the ban violated the Second Amendment. <\/b><\/p>\n

“The district court\u2019s June 4, 2021 order and judgment are stayed pending resolution of Rupp v. Bonta,” the court said. “The stay shall remain in effect until further order of this court.” <\/b><\/p>\n

The Rupp case, which also deals with the assault weapons ban and has already been briefed before the Ninth Circuit, had also been put on hold as the court handles other Second Amendment cases that could effect it. <\/b><\/p>\n

I have been trying to find information on this other case, Rupp v. Bonta and haven\u2019t found much. I\u2019m sure there are a lot of places with all the details of that case floating around, but Big Tech is probably censoring them. In any case, the 9th<\/sup> Circus has a long history of judicially repealing the 2nd<\/sup> Amendment. (Actually, they\u2019ve had no problem repealing the entire constitution) Now as to the details of the Miller case.<\/p>\n

Benitez’s district court order had ruled the assault weapons ban to be unconstitutional, stating that people had a right to possess modern weapons. \u00a0Benitez likened the AR-15 rifle to a Swiss Army Knife as being “a perfect combination of home defense weapon and homeland defense equipment,” in contrast to militaristic, “extraordinary” weapons like bazookas and machineguns. <\/b><\/p>\n

“Under no level of heightened scrutiny can the law survive,” Benitez said. <\/b><\/p>\n

Judge Benitez\u2019s ruling is good in many parts, but he also makes the standard mistake that true military weapons, such as rocket launchers and crew served weapons can be controlled. The founders fully intended the people to have all the tools they needed at their disposal. At the time the 2nd<\/sup> Amendment was adopted, people owned their own artillery and warships. Technically, I could buy a fully equipped aircraft carrier battle group\u2026.If I had a $100 billion I wanted to spend.<\/p>\n

While the court awaits a decision in the Rupp case, briefing in the Miller case is put on hold, although the Ninth Circuit did grant a request by the State of Arizona to file an amicus brief opposing California’s motion to stay Benitez’s ruling for the entire duration of the Miller appeal. <\/b><\/p>\n

For now, the 9th Circuit is telling the parties to stand by and file a status report 14 days after the court issues a ruling in the Rupp case. <\/b><\/p>\n

As I mentioned before, I tried looking up the Rupp case and ran into either sites using lawyerspeak or other issues that prevented me from properly researching it. In any case, assuming that it is a 2nd Amendment case, and considering the history of the 9th<\/sup> Circus Court of Appeals, I expect them to rule in favor of the slave owners and continue tearing up the constitution.<\/p>\n

This is the same pack of idiots that recently ruled that you have no right to bear arms. (Completely ignoring the \u201cRight to keep AND bear arms part of the 2nd<\/sup> Amendment) Currently that case is going to the Supreme court, and I fully expect this case to go there as well. The Progressive Ruling Elites refuse to accept that \u201cThe People Have Spoken\u201d on this, and are speaking with their wallets. Millions of people who never owned a gun are buying them and they are NOT going to surrender them to likes of Dementia Joe and Heels Up Harris.<\/p>\n

Frankly, we need a way to remove judges who flagrantly ignore the plain text of the Constitution. We could see their impeachment, but that will never happen unless a judge is sitting in prison after being convicted of a crime.
