I\u2019ve written about the States bypassing Congress to amend the Constitution to fix issues that have cropped up in the last century or so. The tool that would be used is would be Article V of the United States Constitution. There has been a lot of talk about this for decades, but recently the calls for using Article V have grown.<\/p>\n<p><a href=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2013\/07\/constitution.jpg\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-medium wp-image-12294\" src=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2013\/07\/constitution-300x198.jpg?resize=300%2C198\" alt=\"\" width=\"300\" height=\"198\" srcset=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2013\/07\/constitution.jpg?resize=300%2C198&amp;ssl=1 300w, https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2013\/07\/constitution.jpg?resize=150%2C99&amp;ssl=1 150w, https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2013\/07\/constitution.jpg?resize=400%2C264&amp;ssl=1 400w, https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2013\/07\/constitution.jpg?w=426&amp;ssl=1 426w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p><!--more--><\/p>\n<p>Amending the Constitution is intentionally difficult, but not impossible. The usual method has been to have Congress propose and pass potential amendments and then send them to the states to be ratified. However, it\u2019s almost impossible to get congress to pass any amendments that would, to put it bluntly, strip them of their own power.<\/p>\n<p>This is why the founders of the United States came up with an alternative method that bypasses Congress. <a href=\"https:\/\/constitution.congress.gov\/constitution\/article-5\/\" target=\"_blank\" rel=\"noopener\"><b>Here is what Article V says<\/b><\/a>:<\/p>\n<p style=\"padding-left: 40px;\"><b>The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as Part of this Constitution, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress; Provided that no Amendment which may be made prior to the Year One thousand eight hundred and eight shall in any Manner affect the first and fourth Clauses in the Ninth Section of the first Article; and that no State, without its Consent, shall be deprived of its equal Suffrage in the Senate. <\/b><\/p>\n<p>The key section here is \u201cThe Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, <i><b>or, on the Application of the Legislatures of two thirds of the several States.<\/b><\/i>\u201d<\/p>\n<p>This section is what grants the states the right to propose and pass amendments. Now, thanks to the massive overreach of the Federal Government many states have already approved the call for an Article <b>Convention and more are looking into it. <a href=\"https:\/\/www.foxnews.com\/politics\/states-one-step-closer-in-uphill-unconventional-approach-to-amend-constitution-limit-federal-govt-power\" target=\"_blank\" rel=\"noopener\">Here are the details from Fox News<\/a>: <\/b><\/p>\n<p style=\"padding-left: 40px;\"><b>A state senator calling for constitutional amendments said that &#8220;overreach on the part of the federal government&#8221; has forced states to attempt reform in a way never accomplished before.\u00a0<\/b><\/p>\n<p><a href=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2014\/11\/Reagan_toasting.jpg\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-medium wp-image-16344\" src=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2014\/11\/Reagan_toasting-199x300.jpg?resize=199%2C300\" alt=\"\" width=\"199\" height=\"300\" srcset=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2014\/11\/Reagan_toasting.jpg?resize=199%2C300&amp;ssl=1 199w, https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2014\/11\/Reagan_toasting.jpg?resize=500%2C753&amp;ssl=1 500w, https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2014\/11\/Reagan_toasting.jpg?w=597&amp;ssl=1 597w\" sizes=\"auto, (max-width: 199px) 100vw, 199px\" \/><\/a><\/p>\n<p style=\"padding-left: 40px;\"><b>The Nebraska Legislature passed a resolution Jan. 28 calling on states to begin the formal process to pass constitutional amendments that would limit the federal government&#8217;s spending and jurisdiction, as well as set term limits for members of Congress. <\/b><\/p>\n<p style=\"padding-left: 40px;\"><b>&#8220;What&#8217;s driving this as much as anything is overreach on the part of the federal government,&#8221; Nebraska state Sen. Steve Halloran, who sponsored the resolution, told Fox News. <\/b><\/p>\n<p style=\"padding-left: 40px;\"><b>&#8220;The Founding Fathers had anxiety that that might happen,&#8221; he said. &#8220;I don&#8217;t believe they imagined that it would get to this point.&#8221; <\/b><\/p>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter \" src=\"https:\/\/i0.wp.com\/i.pinimg.com\/originals\/56\/f4\/04\/56f404f50ea6f9d5432ab8ed31a0f03b.jpg?resize=334%2C347&#038;ssl=1\" width=\"334\" height=\"347\" \/><\/p>\n<p>That would be a bit of an understatement. I suspect the founders would have been breaking out the muskets shortly after FDR blackmailed the supreme court into backing his New Deal program. Since then, things have only gotten worse. As to exactly what Sen, Halloran is proposing, it would basically gut a good chunk of the bureaucratic state that has come into being over the last 90 years.<\/p>\n<p style=\"padding-left: 40px;\"><b>Halloran&#8217;s resolution, <a href=\"http:\/\/nebraskalegislature.gov\/bills\/search_by_number.php?DocumentNumber=LR14&amp;Legislature=107th\" target=\"_blank\" rel=\"noopener\">LR14<\/a>, is Nebraska\u2019s application for a convention that would discuss amendments to &#8220;impose fiscal restraints on the federal government, limit the power and jurisdiction of the federal government, and limit the terms of office for its officials and for members of Congress.&#8221; <\/b><\/p>\n<p style=\"padding-left: 40px;\"><b>&#8220;It&#8217;s become abundantly clear with the history of Congress that they have no sense of limiting their spending and the accrued debt that&#8217;s happening upon our nation,&#8221; Halloran said, calling the U.S.\u2019s $30 trillion national debt &#8220;unsustainable.&#8221;\u00a0 <\/b><\/p>\n<p>I\u2019m guessing a balanced budget amendment with a line item veto. Perhaps a revisit of the 16<sup>th<\/sup> Amendment limiting the amount of money the Federal Government can actually steal from the taxpayers, and, of course, term limits for the Grand Poobahs of the Deep State.<\/p>\n<p style=\"padding-left: 40px;\"><b>It takes 34 states to call the convention and 38 states are needed to ratify an amendment. Nebraska was the 17th state \u2013 marking the half-way point \u2013 to pass such a resolution since the effort started in 2013. <a href=\"https:\/\/www.foxnews.com\/category\/us\/us-regions\/midwest\/wisconsin\" target=\"_blank\" rel=\"noopener\">Wisconsin<\/a> passed one the week prior. <\/b><\/p>\n<p><a href=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2016\/12\/schadenboner.jpg\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-medium wp-image-23127\" src=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2016\/12\/schadenboner-246x300.jpg?resize=246%2C300\" alt=\"\" width=\"246\" height=\"300\" srcset=\"https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2016\/12\/schadenboner.jpg?resize=246%2C300&amp;ssl=1 246w, https:\/\/i0.wp.com\/angry.net\/blog2\/wp-content\/uploads\/2016\/12\/schadenboner.jpg?w=442&amp;ssl=1 442w\" sizes=\"auto, (max-width: 246px) 100vw, 246px\" \/><\/a><\/p>\n<p style=\"padding-left: 40px;\"><strong>The resolution has passed one chamber in eight states, and legislation is pending in 15 more state legislatures. A convention of states under Article V has never been called.<\/strong><\/p>\n<p>I recall that there have been threats from the states to call an Article V convention in the past for various reasons, and when it appeared that they would actually do this, Congress got off their collective fat asses and passed the proposed Amendments and sent them out to the states. I don\u2019t see this happening this time.<\/p>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-medium\" src=\"https:\/\/i0.wp.com\/i.pinimg.com\/originals\/0f\/74\/78\/0f747819e7935e2b8aa85010accb84ed.jpg?resize=580%2C419&#038;ssl=1\" width=\"580\" height=\"419\" \/><\/p>\n<p>If the States do start closing in on the magic number, I expect the Federal Government, especially if the Democratic Communazis are <span style=\"text-decoration: line-through;\"><i>ruining<\/i><\/span> running things to do whatever it takes to shut the convention down. They will say things like \u201cThis will override the Will of the People!,\u201d and \u201cRacist!\u201d not to mention their favorite, \u201cThis is a Threat to Democracy!\u201d Of course, they will fail. If you think this is a good idea, I would strongly recommend contact your state legislators and tell them to get their rears in gear and vote for the Article V convention.<\/p>\n<p>I have located <a href=\"https:\/\/conventionofstates.com\/states-that-have-passed-the-convention-of-states-article-v-application\" target=\"_blank\" rel=\"noopener\"><b>a site that lists the current status of the call for an Article V convention votes<\/b><\/a>. (New Hampshire has passed it in one chamber of the legislature)<\/p>\n<p style=\"padding-left: 40px;\"><b>States considering the Convention of States Resolution in 2022:<\/b><\/p>\n<p style=\"padding-left: 40px;\"><b>Hawaii, Illinois, Iowa, Kansas, Kentucky, Massachusetts, Michigan, Minnesota, New Hampshire, New Jersey, New York, North Carolina, Ohio, Pennsylvania, South Carolina, South Dakota, Vermont, Virginia, Washington, West Virginia.<\/b><\/p>\n<p>I doubt that any of the Blue States would actually support this, since the goal is to strip power away from the Federal Government. Still, you never know. (They might be considering this as a way to actually push amendments stripping rights way from the people.
