Good day all. I just woke up to some interesting news. It seems that a draft copy of a decision to overturn the Roe vs Wade ruling was leaked to Politico last night.<\/p>\n

The draft is just that, a draft. Needless to say, the left and pro-choice groups are going absolutely berserk over what they see as the potential end of Abortion in the United States. Now I\u2019m not going into that tar pit. What interest me, and frankly a lot of people on both sides of the aisle is how Politico<\/a> was able to get this draft of the decision.<\/p>\n

If it was one of the clerks, then his or her legal career is over before it even starts, and it\u2019s possible that there could be criminal charges brought. Honestly, I don\u2019t see one of the clerks doing that. It\u2019s possible that a copy was somehow misplaced and someone picked it up and handed it to Politico. There is also the possibility that one of the Justices intentionally leaked the draft.<\/p>\n

There is no way that Politico will give up the source of course, not unless extra legal means are used to coerce them. (That would be water boarding, among other things) However, one possibility would be Justice Sotomayor leaked it. According to Steven Hayes on Powerline blog<\/b><\/a>:<\/p>\n

A complete draft opinion has never leaked from the Supreme Court before, and it has long been understood that anyone (especially a law clerk) who leaked an opinion would be kissing their legal career goodbye. This is why I think the leak probably came from one of the Justices. And my money is on Sonia Sotomayor, who is by far the most politicized Justice on the Court, though she will soon have company when Ketanji Brown-Jackson joins the Court. <\/b><\/p>\n

Neither Sotomayor or Brown-Jackson should have even been nominated. They are both unqualified to be on the court. In Sotomayor\u2019s case, she was put on the bench to protect Obamacare. (Whatever they had on Roberts helped too) Sotomayor is not considered all that bright, and is very political. As to the reason for the leak? Obviously to stir up trouble.<\/p>\n

A leak of the opinion is surely a desperate attempt to stir up a public firestorm (so the left hopes) that will cause a Justice to switch his or her vote at the last minute. This suggests the Court\u2019s vote was 5 \u2013 4, likely with Roberts once again defecting. <\/b><\/p>\n

A leak like this, as mentioned previously, is unprecedented. Without question, most of the justices are going to be very unhappy with this, including two of the three \u201cliberal\u201d justices, Breyer and Kagen. Now the \u201cMole hunt\u201d to find out how this draft decision was released two months before it was meant to be is underway. One person on Twitter has, for lack of a better word, accused a clerk for Sotomayor of being the one who leaked the draft.<\/p>\n

I won\u2019t name the person, but the individual is a Yale graduate and blasted the nomination of Justice Kavanaugh. If this person is the one who leaked the draft he needs to be escorted from the Supreme Court offices and out into the street. His personal possessions can be shipped to him later. He also needs to be disbarred. If laws were broken, he needs to be prosecuted.<\/p>\n

Now, if it turns out that it was Sotomayor herself who leaked the draft, she needs to be impeached and removed from the bench. It would be an interesting conundrum for the Democrats. If the evidence is solid enough, and I would say it would have to be similar to what is used in a criminal case, then protecting her would probably blow up in the Democrats faces. If they actually did impeach and remove her, well, that too would blow up in their faces.<\/p>\n

This is a breaking story of course so stay tuned. As to my opinion on the alleged draft decision? I\u2019ve always said the best way to deal with abortion was to render it obsolete. Women won\u2019t have them because they won\u2019t need or want them. Yeah, the devil is in the details, but you have to start somewhere.<\/p>\n
