In 6-3 split decision, the Progressives in favor of unconstitutional spending and the Constitutionalists upholding the separation of powers, the Court told Biden that no, you can\u2019t do that. Here are the details from Fox Business News<\/b><\/a>:<\/p>\n The Supreme Court ruled Friday that the Biden administration<\/a> cannot go forward with its student loan debt handout program. <\/b><\/p>\n In a 6-3 decision, the court held that federal law does not allow the Secretary of Education to cancel more than $430 billion in student loan debt.<\/a>\u00a0 <\/b><\/p>\n “The Secretary\u2019s plan canceled roughly $430 billion of federal student loan balances, completely erasing the debts of 20 million borrowers and lowering the median amount owed by the other 23 million from $29,400 to $13,600,” Chief Justice John Roberts wrote<\/a> for the majority. “Six States sued, arguing that the HEROES Act does not authorize the loan cancellation plan. We agree.” <\/b><\/p>\n Dementia Joe was not happy of course, announced that he wasn\u2019t happy, that the sky had puppies and Goldilocks is a stack of waffles, then returned to eating some ice cream.<\/p>\n President Biden strongly disagreed with the court’s decision and will make an announcement later today detailing new actions to protect student loan borrowers, a White House source told Fox News Digital.\u00a0<\/b><\/p>\n Which will also not be constitutional. Estimates from the Congressional Budget Office said Biden’s plan would cost taxpayers roughly $400 billion. Republicans were outraged at the total, arguing the forgiveness would be unfair to those who either paid their way through college, repaid their loans or never attended college in the first place. <\/b><\/p>\n You don\u2019t think the Progressives give a damn about responsible borrowers do you? Of course not! Their goal was to flat out by votes from all those who have degrees ending in \u201cStudies\u201d and are pouring coffee in Starbucks and whining about how unfair it is that they aren\u2019t being paid 6 figure salaries.<\/p>\n Biden’s administration had relied on a federal statute, called the HEROES Act, to enact the plan, claiming the law gave the secretary of education power to “waive or modify any statutory or regulatory provision applicable to the student financial assistance programs \u2026 as the secretary deems necessary in connection with a war or other military national emergency.”<\/strong><\/p>\n I looked up the act. According to the ever so accurate Wikipedia<\/b><\/a>, the act was basically meant to help people affected by military operations.<\/p>\n The Act allows the U.S. Secretary of Education<\/a> to grant waivers or relief to recipients of student financial aid<\/a> programs under Title IV of the Higher Education Act of 1965<\/a>, <\/b>in connection with a war or other military operation or national emergency.<\/b> It allows waiving of statutory or regulatory requirements related to federal student loans for three categories of individuals: active-duty military or National Guard officials, those who reside or are employed in a declared disaster area, or those who have suffered direct economic hardship as a result of wars, military operations, or national emergencies. <\/b><\/p>\n Biden and his cronies tried to use this to waste $400 billion+ on all the deadbeats who got garbage degrees that aren\u2019t worth the parchment they\u2019re printed on. The Supreme Court basically said \u201cNot so fast there bud.\u201d<\/p>\n The court majority shot down that argument. “The authority to \u2018modify\u2019 statutes and regulations allows the Secretary to make modest adjustments and additions to existing regulations,” Roberts wrote, “not transform them.”\u00a0 <\/b><\/p>\n Roberts went on to say the Department of Education’s “modifications” to the law “created a novel and fundamentally different loan forgiveness program” than what Congress intended in the HEROES Act. This program effectively granted loan forgiveness “to nearly every borrower in the country,” Roberts said.\u00a0 <\/b><\/p>\n “The Secretary’s comprehensive debt cancelation plan cannot fairly be called a waiver \u2014 it not only nullifies existing provisions, but augments and expands them dramatically,” the chief justice wrote. “It cannot be mere modification, because it constitutes \u2018effectively the introduction of a whole new regime’ \u2026 And it cannot be some combination of the two, because when the Secretary seeks to add to existing law, the fact that he has \u2018waived\u2019 certain provisions does not give him a free pass to avoid the limits inherent in the power to \u2018modify.'” <\/b><\/p>\n “However broad the meaning of \u2018waive or modify,\u2019 that language cannot authorize the kind of exhaustive rewriting of the statute that has taken place here.”\u00a0 <\/b><\/p>\n I\u2019m no expert, but I suspect this was designed to help those who enlisted in the military after 9\/11 and weren\u2019t able to pay back their loans since they were busy getting shot at by Islamic Terrorists. What the Biden Maladministration wanted to do was rewrite the law without bothering with little details like presenting a bill to Congress.<\/p>\n The court’s three liberal justices dissented. “The majority overrides the combined judgment of the Legislative and Executive Branches, with the consequence of eliminating loan forgiveness for 43 million Americans.
