Good day all. I\u2019ve gone over this many times, but we have yet another judge who is usurping authority she doesn\u2019t have. In this case we have a Biden judge interfering with ICE and rounding up all the illegal aliens that the Democrats and the Biden maladministration let into the country.<\/p>\n

In this case, we have a judge who has decided that if ICE wants to pick up an illegal alien, they must have a warrant. Here are the details from Fox News<\/b><\/a>:<\/p>\n

A California judge on Tuesday demanded Border Patrol agents allow people they think are living in the U.S. illegally<\/a> to stay in the country, unless authorities have a warrant or reason to believe the person may flee before they can get a warrant. <\/b><\/p>\n

U.S. District Judge Jennifer L. Thurston ruled on Tuesday that Customs and Border Protection (CBP) agents in the Eastern District of California<\/a> cannot stop illegal immigrants without reasonable suspicion, or deport them via “voluntary departure,” unless that person is explained their rights and agrees to leave, according to a report from The Associated Press. <\/b><\/p>\n

As I mentioned above, Thurston is a Biden Judge with all that entails. She is flagrantly violating the constitutional separation of powers and has decided to protect millions of criminals. There is plenty of law on this that she is ignoring. Well, I think she\u2019s going to be very disappointed when ICE ignores her court order.<\/p>\n

The decision comes after dozens of people were arrested in January during Border Patrol’s<\/a> “Operation Return to Sender.” <\/b><\/p>\n

The American Civil Liberties Union (ACLU) filed a lawsuit against Department of Homeland Security (DHS)<\/a> Secretary Kristi Noem and CBP officials, claiming Border Patrol agents unconstitutionally detained people who looked like farmworkers, regardless of their actual immigration status or “individual circumstances,” over the span of a week, according to the report. <\/b><\/p>\n

First, I don\u2019t know the circumstances regarding Operation Return to Sender. Second, did a few American Citizens or legal aliens get detained briefly? Possibly. That would have been very quickly sorted out of course. For the legal aliens, simply presenting their documents, (Green Card for instance), and they would be thanked and sent on their way. For any Americans, same deal.<\/p>\n

As for the ACLU, after a short hiatus lasting about 10-20 years, they\u2019ve returned to the Communist roots and are trying to use the American Constitution and U.S. laws to bring down the United States. (Think I\u2019m kidding? Take a look at when and why they were founded back in the 1920\u2019s)<\/p>\n

Detainees were allegedly taken by bus to the border, held without being able to communicate with family or legal representation, and forced to sign documents that stated they waived their right to see an immigration judge and voluntarily agreed to leave the U.S.<\/a>, the ACLU said. <\/b><\/p>\n

I suspect there was a bit more to this then the ACLU is going to admit to. However, with regards to illegal aliens, they have no rights other then to be removed as quickly as possible from the United States. They are not citizens and they are not legal resident aliens. They are criminals in the commission of a crime. (Crossing the border without permission? A crime. Being a foreign national in the United States without permission? Also a crime)<\/p>\n

Thurston wrote that the evidence showed Border Patrol agents “engaged in conduct that violated well-established constitutional rights,” The AP reported.\u00a0 <\/b><\/p>\n

CBP claimed Thurston did not have jurisdiction to make the ruling, but said it wouldn’t matter if she did because the agency had already issued new guidance and training to its agents, “detailing exactly when people may be stopped or arrested without warrants, and what rights detainees have after their arrest,” according to the report. <\/b><\/p>\n

Oh that should be a very interesting read. The policies and procedures for rounding up illegal aliens have been around for decades. Perhaps this Biden Judge might want to review what happened during \u201cOperation Wetback\u201d under Eisenhower. The Federal government rounded up who knows how many illegals and booted them across the border.<\/p>\n

We\u2019re now at the very beginning of both states and the Federal Government starting to ignore these corrupt Liberal Democrat judges. This looks like it will be another case where the judge is flat out told she has crossed a line and that her order will be ignored. I think we may also be looking at some form of major overhaul of the United States Judiciary.<\/p>\n

One thing Congress can do is shut down all the \u201cInferior\u201d courts. (Those below the Supreme Court) All those judges would be \u201cRetired\u201d as surplus to needs. Then they could rebuild the entire system from the ground up including confirming new judges. That is totally within Congress\u2019s rights under the Constitution. If they actually did that, just watch the Leftard\u2019s head explode.<\/p>\n
