James has secured a lawyer of course. You would think that her lawyer, one Abbe Lowell, who is reputed to be a very good defense attorney, would advise James to refuse to comment on the investigation. If he did, she isn\u2019t listening. She decided to try and \u201cExplain\u201d the problems with her mortgage applications. Here are the details from Lifezette<\/b><\/a>:<\/p>\n New York Attorney General Letitia James is now the subject of a federal investigation into multiple allegations of mortgage fraud. <\/b><\/p>\n The probe includes claims that James made false statements on legal and financial documents related to real estate transactions, including a property purchase in Virginia and an earlier mortgage dating back to the 1980s. <\/b><\/p>\n So she is alleged to be making these \u201cmistakes\u201d for over 40 years? (I checked her age. I thought she was younger then she is so yes, she was able to sign contracts and purchase property in the 1980\u2019s)<\/p>\n The investigation comes in the wake of James\u2019 high-profile legal actions against current President Donald Trump, whom she sued in a civil case resulting in a $454 million judgment. <\/b><\/p>\n I don\u2019t need to go over that travesty. She just decided to file suit and made sure she got a corrupt judge to rig the case. The bank that issued the loan publicly stated that there was no fraud and that they were paid in full with interest. Basically, there was no actual victim. The case has been appealed but is hung up in the appellate court. It\u2019s been heard and the judges weren\u2019t to thrilled with Letitia James\u2019s claims.<\/p>\n In public remarks following news of the investigation, James denied<\/a> wrongdoing and described the probe as politically motivated retaliation.<\/strong><\/p>\n \u201cThis investigation into me is nothing more than retribution,\u201d she said. <\/b><\/p>\n \u201cIt\u2019s baseless.\u201d James explained that the focus of the federal inquiry stems from a power of attorney she signed for a property purchase in Virginia for her niece, who has children. <\/b><\/p>\n And therein is her problem. She listed that house as being her primary residence in order to get a better mortgage and insurance rate. James had no intention of making it her primary residence. If she had, she would have become ineligible to hold the office of Attorney General in New York.<\/p>\n James claimed the power of attorney mistakenly indicated that she was a resident of Virginia, while asserting that elsewhere in the mortgage application she clearly stated she was not. <\/b><\/p>\n \u201cThey just took the power of attorney, and they are using that as the basis for enforcement for their investigation,\u201d James said. <\/b><\/p>\n From what I understand, there was a lot more to this then a single wrong document. As I recall, it wasn\u2019t the Government that found these issues, it was a private citizen\/group. It was then published and that led the appropriate agency to start reviewing this and other documents. They found something and said, \u201cHmm, this looks fishy\u201d and handed it over to the DoJ. They are now reviewing everything to see if there actually is a \u201cThere\u201d there.<\/p>\n James went on to say that she helped her niece purchase the home out of a desire to support family, adding, \u201cBecause I am a good aunt, I wanted her to have a home.\u201d <\/b><\/p>\n That wouldn\u2019t have been an issue if you hadn\u2019t made a claim that you were going to make the house your primary residence. Besides, this isn\u2019t the only thing they\u2019re looking into.<\/p>\n The federal investigation reportedly involves more than the Virginia incident. Authorities are also examining claims that James falsely listed her father as her husband on a 1983 mortgage document. <\/b><\/p>\n What is it with Progressive Liberal Democrats and incest? Letitia James, Ilhan Omar, etc.<\/p>\n Additionally, she allegedly misrepresented the number of units she owned on a rental property in New York, which reportedly allowed her to obtain more favorable mortgage terms. <\/b><\/p>\n I\u2019ve already written a post<\/a> on that little white fraud. What this looks like to me is a pattern, and I think that\u2019s what the DoJ is looking into.<\/p>\n The case is being reviewed by officials with the Department of Justice, though the timeline for any potential charges or further legal action remains unclear. <\/b><\/p>\n These white collar crimes always take some time to be investigated and to determine if there are actual crimes involved. Considering that most Progressive Liberal Democrats literally believe that the laws do not apply to them, I have a suspicion that she is looking at sitting in a courtroom and in the defendent\u2019s chair.<\/p>\n Despite this, James has continued to serve as New York\u2019s top legal officer and has maintained strong support among Democrats in the state. <\/b><\/p>\n As part of her defense, James emphasized that she never intended to mislead any financial institutions and that the details under review are being misrepresented. <\/b><\/p>\n Now James has yet to be criminally charged, and under our system, something she holds in utter contempt, at least for anyone she considers her enemy, you are presumed innocent until proven guilty in a court of law. If when that happens though, Letitia James is going to be in a real world of hurt, even if she manages to avoid prison time.<\/p>\n A conviction on mortgage fraud could potentially affect her ability to serve in public office, depending on the outcome of the investigation and any ensuing legal proceedings. <\/b><\/p>\n If she\u2019s convicted, she is instantly disqualified to be Attorney General of New York and will either have to resign or removed from her position. Theoretically, if she is indicted, she should be removed or step aside. I doubt she will though. She is far to arrogant. Now we are in a waiting game. Hopefully, we will have an answer soon.
