Good day all. Ok, I will state for the record that I did not see this one coming. Since President Trump\u2019s glorious return to the White House, the Democrats have been using their pet Biden and Obama judges to try and overthrow the will of the electorate.<\/p>\n

These judges have been issuing Temporary Restraining Orders as well as other ruling that flat out violate the constitutional separation of powers. Many people, myself included, have been saying that these judges need to be dealt with. The ideas out there have been impeachment, disbanding the circuit courts, getting SCOTUS to actually do it\u2019s job and reign in these black robed tyrants or potentially and indicting and arresting some of them. What I didn\u2019t see was suing them. Here are the details from Fox News<\/b><\/a>:<\/p>\n The Department of Homeland Security (DHS)<\/a> is suing all 15 judges on the Maryland federal bench, arguing the court’s policy of automatically pausing certain immigration cases that come before it is unlawful. <\/b><\/p>\n Attorneys for the Trump administration argued to the very court they are suing that the policy, imposed through an order the court issued in May, is an “egregious example of judicial overreach.” <\/b><\/p>\n “A sense of frustration and a desire for greater convenience do not give Defendants license to flout the law,” the attorneys wrote in a filing Tuesday. “Nor does their status within the judicial branch.”\u00a0 <\/b><\/p>\n As I mentioned, I didn\u2019t see this as a possibility. I honestly don\u2019t know how this would work since judges allegedly have limited immunity. Personally, I think indicting them would be the better option. (with the follow up, \u201cResign or be prosecuted) Now as to the reason why? It looks like these judges didn\u2019t want to be bothered with all the fiddly bits like actually doing their jobs on each case.<\/p>\n The Maryland court’s standing order requires clerks to immediately enter temporary administrative injunctions in cases brought by alleged illegal immigrants who are challenging their detention. <\/b><\/p>\n The automatic injunctions in these cases, known as habeas corpus cases, temporarily bar the DHS from deporting<\/a> or changing the legal status of the immigrant in question for two business days. <\/b><\/p>\n Well, that\u2019s a load of bovine droppings. Even I know that setting up an automatic injunction is not legal. A judge is supposed to have a hearing on each case and then make a determination. I\u2019m now back up to congress disbanding that court and \u201cRetiring\u201d all the judges on it.<\/p>\n In its order, the court said it did this out of scheduling convenience to make sure the “status quo” is preserved when a case is filed. The order cited a higher volume than usual of cases involving detained immigrants who are attempting to prevent the government from keeping them detained or deporting them.\u00a0 <\/b><\/p>\n “The recent influx of habeas petitions concerning alien detainees purportedly subject to improper and imminent removal from the United States that have been filed after normal court hours and on weekends and holidays has created scheduling difficulties and resulted in hurried and frustrating hearings in that obtaining clear and concrete information about the location and status of the petitioners is elusive,” the court order stated. <\/b><\/p>\n So, once again, a bunch of judges decided that they aren\u2019t required to abide by the rules that everyone else has to. We\u2019re seeing this in the case of that Milwaukee judge who tried to help an illegal alien escape ICE. She\u2019s now going through all the pretrial stuff, and one of those was her statement, with over 100 other judges, (Allegedly retired), that she has absolute immunity and can do pretty much whatever she wants.<\/p>\n The Trump administration also asked the court in a follow-up motion that all the judges-turned-defendants recuse themselves from the case and bring in an outside judge to take over or transfer the case to a different court district. <\/b><\/p>\n Now that\u2019s twisting the knife. If these judges refuse to recuse themselves and throw out the lawsuit, it will confirm what most Americans already think. That the Judicial Branch has decided that they are the law and not the upholders of the law. Personally, I think they are arrogant enough to refuse to recuse themselves and to issue a ruling that dismisses the suit, with prejudice.<\/p>\n In Maryland, Judge Paula Xinis, who is now one of the named defendants in the new case, ordered the Trump administration to return to the United States a Salvadoran national named Kilmar Abrego Garcia. Abrego Garcia was mistakenly deported to a prison in El Salvador in March before he was returned months later to face trafficking charges. <\/b><\/p>\n This Biden Judge not only needs to be removed from the bench, she needs to be prosecuted. She basically wanted to send in the Marines to raid the prison to get this piece of trash. Well, she got what she wanted, just not in the way she expected. Also, when is the legacy media going to realize that Garcia was not mistakenly deported? He is an illegal alien and should have been deported the first time he was caught.<\/p>\n Now the fun begins. I have no idea how this is going to play out. I think that whichever way it goes, it will end up in the Supreme Court, much like the question on Birthright Citizenship did. (And SCOTUS apparently waffled, wiffled and wimped on) While I do agree that judges should have some, very limited immunity, when they are shown to repeatedly abuse their authority, then that immunity should end.
