The case in question was against Douglas Mackey. Back during the 2016 election, he reposted a few some memes regarding Felonia von Pantsuit. As you would expect, Felonia von Pantsuit took offense. However, she lost the election and the Trump DoJ ignored it. However, thanks to the Tainted Election of 2020 and Merrick Garland becoming Attorney General, and his weaponizing the DoJ against all enemies of the Democrat Party, Joe Biden and the Democrat elite, Douglas Mackey was charged and convicted for daring to exercise his 1st<\/sup> Amendment rights. Now, thanks to a successful appeal, his conviction hs been thrown out. Here are the details from the Federalist<\/b><\/a>:<\/p>\n D<\/b>ouglass Mackey, the man sentenced<\/a> to seven months in federal prison for reposting some Hillary Clinton-themed memes in 2016, told The Federalist it \u201cfeels incredible\u201d to learn his conviction has been vacated and he will be acquitted. He was on vacation with his wife and baby and had no idea a decision<\/a> was coming on Wednesday in his appeal case, which has been languishing in the United States Court of Appeals for the 2nd Circuit since late 2023. <\/b><\/p>\n I have a vague memory of this case when it occurred, but didn\u2019t write about it. Reviewing the details, it was a blatant assault on Mr. Mackey\u2019s constitutional rights.<\/p>\n It is a victory for free speech, and yet another sickening reminder of how, under former President Joe \u201cAutopen\u201d Biden, the Department of Justice (DOJ) spent much of its time going after average citizens for political speech, such as Catholics, Trump supporters, parents at school board meetings, and pro-lifers, as my colleague Brianna Lyman previously reported<\/a>.<\/b><\/p>\n Looking back, it\u2019s terrifying how close we came to the institution of a full blown police state. Garland and Wray\u2019s actions came close to causing really bad things to happen. People, and not the whackos, were starting to consider that it might be time to fire on Federal agents, especially the FBI. (Most people still want the FBI disbanded) Now here are the details on how this nightmare started.<\/p>\n The DOJ charged Mackey in 2021 \u2014 five years after he posted the memes \u2014 with a post-Civil War era law, Conspiracy Against Rights (18 U.S. Code \u00a7 241<\/a>), which can lead up to 10 years in prison. <\/b><\/p>\n To say this was a stretch is a classic understatement. It shows that the DoJ just decided to get Mackey and went looking for anything they could use.<\/p>\n The law delineates a felony offense that \u201cmakes it unlawful for two or more persons to agree to injure, threaten, or intimidate a person in the United States in the free exercise or enjoyment of any right or privilege secured by the Constitution or laws of the United States or because of his or her having exercised such a right.\u201d <\/b><\/p>\n Does that include the Attorney General of the United States, the Director of the FBI and assorted U.S. Attorneys?<\/p>\n In 2016, using the Twitter handle \u201cRicky Vaughn,\u201d Mackey tweeted (and retweeted) joke advertisement memes telling voters they could vote for Hillary Clinton for president via text message. A ridiculous claim, especially when coupled with the hashtag #MAGA. <\/b><\/p>\n Mackey\u2019s retweet purportedly showed two people working together, \u201ctrying to trick people out of voting,\u201d the DOJ said in court papers. <\/b><\/p>\n To say that was weak would be an understatement. Anyone with two functioning brain cells would know that this was a load of horseshit. (Well that does let out most Democrats. They installed someone into the Oval Office who had no functioning brain cells) Mackey also reposted other memes as well.<\/p>\n \u201cBut the government did not contend at trial that Mackey ever communicated with members of the War Room offline, or that he participated in any online discussions with them outside of the War Room related to the conspiracy,\u201d the decision reads. \u201cAnd the government effectively conceded at oral argument that it had offered no direct evidence that Mackey was aware of the dozen War Room postings that the government relied on at trial to tie him to a conspiratorial agreement.\u201d<\/b><\/p>\n So much for any alleged conspiracy. However, it didn\u2019t matter to the judge handling this travesty. If the judge, one Ann M. Donnelly had an ounce of honesty, should would have dismissed this case with prejudice. However, recall who nominated her for her judgeship.<\/p>\n Mr. Mackey was convicted on this joke of a case and the corrupt judge, probably on instructions from Felonia von Pantsuit, sentenced him to 7 months in a federal prison. Mackey appealed and the 2nd<\/sup> Circuit Court of appeals was not amused with the Government or Judge Donnelly. They threw the case out and ordered the lower court to enter a judgment of acquittal. With this, Douglas Mackey is a free man.<\/p>\n Mackey, now 38, calls the decision \u201ca tremendous blow to the government weaponization of justice and complete and total vindication to the argument I made all along: I never joined any conspiracy to steal votes, and I never intended for anyone\u2019s vote to be stolen. Memes are not crimes.\u201d <\/b><\/p>\n They are if they don\u2019t support Democrats. They could even be considered capital cases if they attack Felonia von Pantsuit or Bubba Horndog. Frankly, Mr. Mackey is lucky that he isn\u2019t the latest addition to the Clinton Body count.<\/p>\n This case, along with hundreds, if not thousands of others, has caused tremendous damage to the trust Americans need to have in the Courts of this country. Something needs to be done to deal with Judges who flat out ignore the Constitution, the Rule of Law and simply act as rubber stamps for the Deep State\u2019s requirements. I don\u2019t know what can be done via legislation, but if things like this blatant miscarriage of justice that a judge should have put a stop to continue, bad things could happen.
