Good day all. If it\u2019s a day ending in a \u201cY\u201d, then yet another Obama or Biden judge has issued an order that tears up the Constitution.<\/p>\n

Generally, these have been blatant attempts to usurp President Trump\u2019s powers under article II. Now we have one that has also issued an order telling Congress that they will provide funds to Planned Parenthood. Here are some of the details from the Associated \u201cWith Terrorists\u201d Press<\/b><\/a>:<\/p>\n

A federal judge on Monday ruled Planned Parenthood clinics nationwide must continue to be reimbursed for Medicaid funding as the nation\u2019s largest abortion provider fights President Donald Trump\u2019s administration over efforts to defund the organization in his signature tax legislation. <\/b><\/p>\n

\"\"<\/a><\/p>\n

The new order replaces a previous edict handed down by U.S. District Judge Indira Talwani in Boston last week. Talwani initially granted a preliminary injunction specifically blocking<\/a> the government from cutting Medicaid payments to Planned Parenthood members that didn\u2019t provide abortion care or didn\u2019t meet a threshold of at least $800,000 in Medicaid reimbursements in a given year. <\/b><\/p>\n

\u201cPatients are likely to suffer adverse health consequences where care is disrupted or unavailable,\u201d Talwani wrote in her Monday order. \u201cIn particular, restricting Members\u2019 ability to provide healthcare services threatens an increase in unintended pregnancies and attendant complications because of reduced access to effective contraceptives, and an increase in undiagnosed and untreated STIs.\u201d <\/b><\/p>\n

This all started a few weeks ago when this commie judge issued a TRO ordering the treasury to disburse funds that had not been approved in the recently passed \u201cBig Beautiful Bill.\u201d (We can argue about that bill another day) The bill, which has been SIGNED INTO LAW in accordance with the United States Constitution stopped any payments to Planned Parenthood and other organizations for a year.<\/p>\n

Although Planned Parenthood is not specifically named in the statute, which went into effect July 4, the organization\u2019s leaders say it was meant to affect their nearly 600 centers in 48 states. However, a major medical provider in Maine<\/a> and likely others have also been hit. <\/b><\/p>\n

In her Monday, July 28th<\/sup>, order, Talwani said that the court was \u201cnot enjoining the federal government from regulating abortion and is not directing the federal government to fund elective abortions or any healthcare service not otherwise eligible for Medicaid coverage.\u201d <\/b><\/p>\n

Oh yes you are.<\/p>\n

Instead, Talwani said that her decision would block the federal government from excluding groups like Planned Parenthood from Medicaid reimbursements when they have demonstrated a substantial likelihood of success in their legal challenge. <\/b><\/p>\n

They have no likelihood of success in their challenge. None whatsoever. Why do I say this? This bitch is issuing an order to the United States Congress to continue funding something they have chosen not to. This will require a new bill be written, passed through both houses of Congress and signed into law by the President. That\u2019s not going to happen.<\/p>\n

In its lawsuit<\/a>, Planned Parenthood had argued that they would be at risk of closing nearly 200 clinics in 24 states if they are cut off from Medicaid funds. They estimated this would result in more than 1 million patients losing care. <\/b><\/p>\n

\u201cWe\u2019re suing the Trump administration over this targeted attack on Planned Parenthood health centers and the patients who rely on them for care,\u201d said Planned Parenthood\u2019s president and CEO Alexis McGill Johnson in a statement on Monday. \u201cThis case is about making sure that patients who use Medicaid as their insurance to get birth control, cancer screenings, and STI testing and treatment can continue to do so at their local Planned Parenthood health center, and we will make that clear in court.\u201d <\/b><\/p>\n

<\/p>\n

Planned Parenthood is what is called a Non-Governmental Organization, or NGO. I\u2019m going to stay away from discussions of what they\u2019re best known for since this isn\u2019t really germane to the issue at hand, which is yet another progressive judge deciding that she is in charge and not the executive and legislative branches of the United States.<\/p>\n

Planned Parenthood is registered as a nonprofit charitable organization under 501(c)(3)<\/a> of the federal tax code. Basically, you can donate money to them and get a write off for the donation. What they and other NGO\u2019s are not, is entitled to one red cent of taxpayer funds. This is something that this corrupt, judicial tyrant doesn\u2019t seem to understand.<\/p>\n

A health department spokesperson reiterated Monday that the agency strongly disagreed with the judge\u2019s order, repeating previous arguments that her decision \u201cundermines state flexibility and disregards longstanding concerns about accountability.\u201d <\/b><\/p>\n

\u201cStates should not be forced to fund organizations that have chosen political advocacy over patient care,\u201d said the department\u2019s communication director, Andrew Nixon, in an email. <\/b><\/p>\n

That is one of the major issues with Planned Parenthood and any number of other 501(c)(3) organizations. They use that money for political reasons as well as just medical care. The organization itself is highly controversial for reasons we already know. As to following this illegal order, the response to the judge is simple and straightforward.<\/p>\n

\u201cI\u2019m sorry your honor, we are unable to comply. We have no funds appropriated for this purpose by Congress.\u201d<\/p>\n

I would love to see how this commie judge deals with that. Would she order some sort of receiver to take over the health department with instruction to redirect funding from whatever Congress provided to Planned Parenthood? That would be such a massive violation of the Separation of Powers and the Constitution that she would have to be removed from the bench. I don\u2019t think even the Democrats would stand for a judge usurping Congresses powers.<\/p>\n

<\/p>\n

This will, like almost all of the other garbage decisions from the District Courts, be overturned at the appellate level. If it makes it to SCOTUS, they will have no choice but to hammer this judge and hard. The way things are going, there is a better then even chance that, at some point, Congress is going to take direct action and simply shut down all the inferior courts and start from scratch.<\/p>\n
