Good day all. As the title says, I found a story that isn\u2019t one you see every day, especially out of San Francisco. As anyone who doesn\u2019t live under a bridge know, San Francisco is, for all intents and purposes, a failed third world city courtesy of the Progressive Liberal Democrats who have been running the place…right into the ground.<\/p>\n


\n<\/p>\n

I\u2019ve written about all the problems that have come to my intention, including the \u201cCrap Map\u201d showing all the places the homeless, I\u2019m sorry I mean the \u201cHousing Challenged,\u201d relieve themselves. The City is also not all that welcoming to businesses and property owners, especially those who rent apartments.<\/p>\n

This is where the fun begins. It seems that one landlord has posted rental properties available, but with a catch. They\u2019re only available to MAGA voters and supporters of Israel. Here are the details from Fox News<\/b><\/a>:<\/p>\n

A\u00a0<\/b>San Francisco<\/b><\/u><\/a> lawyer says a landlord has the right to only allow “MAGA voters and Israel supporters” to attend an open house.\u00a0 <\/b><\/p>\n

One of the things that Kalifornistan and San Francisco are really big on is slamming landlords who \u201cDiscriminate.\u201d They have a whole list of \u201cSpecial protected classes\u201d that, even if a potential landlord suspects they will be a problem, have to rent to. Then, when the expected happens, the courts make it all but impossible to evict them.<\/p>\n

“From the tenant perspective, there isn’t a violation here of California or federal law because political orientation is not a protected class,” Joseph Tobener, a\u00a0<\/b>partner at Tobener Ravenscroft<\/b><\/u><\/a> and tenant rights lawyer, told Fox News Digital on Thursday.\u00a0 <\/b><\/p>\n

“So things that it might touch upon that are protected class would be ethnicity, source of income, religion,” he added. “So there’s some things that skirts around, but the words were such that they are all political orientation, which isn’t a protected class and not a violation of the Fair Employment and Housing Act in California. Now, with that said, I think what rubs people the wrong way is that we have a new housing shortage in San Francisco because of the AI boom.”\u00a0 <\/b><\/p>\n

<\/p>\n

Personally, I think it\u2019s absolutely brilliant. The Landlord knows, probably from past experience, that some of the worst tenants are on the political left. They don\u2019t respect other people\u2019s property and think they are all owed things, such as housing and the dwelling of their choice. On the flip side, those who are more conservatively minded tend to be more respectful of other people\u2019s property and don\u2019t think that the world owes them anything. Those requirements have probably reduced the landlords potential headaches to near zero. Like I said, absolutely brilliant.<\/p>\n

The San Francisco Standard\u00a0reported<\/a> Tuesday that\u00a0Alexander Baran, 48, owns a two-bedroom apartment in Sunnyside\u00a0and had listed it on Zillow, which has since been taken down.\u00a0 <\/b><\/p>\n

I hope he took it down because he found the right person or people to rent it and not because of threats from the \u201cUsual Suspects\u201d.<\/p>\n

The listing, which went up Aug. 5 and was removed on Sunday, allegedly said that “Only\u00a0<\/b>MAGA voters<\/b><\/u><\/a> and Israel supporters are invited” to the open house.\u00a0 <\/b>When the San Francisco Standard went to visit Baran to speak to him about the listing, he allegedly said, “Get the f— away from here. Don\u2019t make me repeat myself.” <\/b><\/p>\n

I don\u2019t know that newspaper, but I wouldn\u2019t be at all surprised if it was just another typical legacy fake news rag. I suspect that Mr. Baran knows them a lot better, hence his reaction.<\/p>\n

Tobener, the\u00a0tenant rights lawyer, said that the City by the Bay is “about a month into a major housing crisis where people are lining up 20 deep for a unit to try and get one unit or showing up and the unit’s already rented.”<\/i> <\/b><\/p>\n

The reason for the housing issues can be laid right at the feet of both the city and state governments. It\u2019s almost impossible to build new housing due to the regulations and taxes, so potential builders just don\u2019t bother.<\/p>\n

The concern that people have, he said, is landlords rejecting people that need housing due to their political views.\u00a0 <\/b><\/p>\n

“<\/b><\/strong>Landlords have a lot of power right now. And so I think that’s the concern from the tenant perspective,”\u00a0Tobener said. “Everybody should get a fair shake regardless of their political orientation. Everyone should be able to get access to housing. Housing is a fundamental right. Everyone needs housing. Everyone needs a roof over their heads. And so are we gonna start down this road where only certain people from certain political leanings can get access to certain housing.” <\/b><\/p>\n

<\/p>\n

To change the law and make political affiliation a protected class,\u00a0Tobener said that the California state legislature would have to add political affiliations to the Fair Employment and Housing Act as a protected category.\u00a0 <\/b><\/p>\n

And that will probably be hit under the 1st<\/sup> Amendment, and probably other parts of the Constitution as well.<\/p>\n

That move, he said, would certainly be challenged and likely end up in the Supreme Court.<\/strong><\/p>\n

I can see how such a case would go. The state courts, which don\u2019t bother with things like the Constitution, will rule in favor of the government. Then it would go to the 9th<\/sup> Circus which, like the state courts, can\u2019t be bothered with pesky little things like the Constitution, property rights and free association. Then it goes to the Supreme Court. They will probably rule 6-3 in favor of the landlords with Associate Justice Ketanji Brown Jackson ruling to support the state and saying something incredibly stupid in her dissenting opinion.<\/p>\n

<\/p>\n

Of course, you will have some Leftist landlords who will do the opposite and ban anyone who isn\u2019t a communist, socialist, liberal, progressive or Democrat. (Not that there is any difference between the groups) Where you are seeing the Leftards wailing about what Mr. Baran did to filter potential renters, you really won\u2019t see all that much from the Right. Why? They\u2019ve all been fleeing Kalifornistan as fast as they can get the U-Haul\u2019s loaded. As for the types of tenants the Leftard Landlords would get using similar criteria, they deserve them, good and hard.<\/p>\n
