Good day all. The layoffs and Reduction In Force of federal employees has begun. Tens of Thousands of government employees, unionized government employees are being sent home, and many won\u2019t be coming back.<\/p>\n

These layoffs and RIF\u2019s are panicking not just the government employees, but also the unions. If all these workers are laid off, or worse, RIF\u2019d, then that means union dues drop and significantly. This is unacceptable to the Union Leadership and they have decided to do something about it. Here are the details from The Hill<\/b><\/a>:<\/p>\n

Federal government labor unions sued Tuesday<\/a> to block the Trump administration from conducting mass layoffs during the potential upcoming government shutdown.\u00a0 <\/b><\/p>\n

Employees are usually temporarily furloughed during a shutdown, except for exempted workers, and receive back pay after a shutdown ends. But Trump and the White House budget office have suggested permanent firings<\/a> could be on the table if government funding expires at midnight.\u00a0 <\/b><\/p>\n

It\u2019s called a Reduction in Force and is something that happens in the Dreaded Private Sector all to often. In the past, those laid off were called back, (And some will be), and then give back pay for what amounted to a vacation. They certainly weren\u2019t doing any actual work. (Not that a lot of them do anything useful now) This is something that only happens in the Government and this appears to be something that may finally end. If they aren\u2019t working, then they don\u2019t get paid. They can collect unemployment like everyone else.<\/p>\n

The lawsuit, filed in federal court in San Francisco, alleges the Office of Management and Budget (OMB) misinterpreted federal law governing shutdowns when it issued a memo<\/a> suggesting agencies should \u201cuse this opportunity\u201d to consider layoffs for programs with lapsed funding and that aren\u2019t priorities of the president.\u00a0 <\/b><\/p>\n

\u201cOMB\u2019s Lapse Memorandum is a partisan attempt to pressure members of Congress to accede to the Trump administration\u2019s demands in negotiations over a CR, and to punish federal employees and the labor unions that represent them if those members of Congress do not surrender to the President\u2019s demands,\u201d the lawsuit states.\u00a0 <\/b><\/p>\n

Allow me to guess what will happen. Some Obama, Biden or RINO judge will side with the union and prevent the layoffs. It will go to the 9th<\/sup> Circus where a the judge panel will rule. Depending on the makeup of the panel, it will either be overturned or upheld. If the former, look for the Unions to demand an en banc hearing, which with then overturn the three judge panel. After that, it goes to SCOTUS. I suspect that this will be another nail in the coffin of the deep state and SCOTUS will rule 6-3 for the Administration.<\/p>\n

UPDATE on that<\/strong><\/em>. A commie judge did back the union and said that President Trump can’t actually do his job and fire federal employees. More on that in another post<\/p>\n

The lawsuit was brought by the American Federation of Government Employees (AFGE), two of its local units and the American Federation of State, County and Municipal Employees.\u00a0 <\/b><\/p>\n

\u201cAnnouncing plans to fire potentially tens of thousands of federal employees simply because Congress and the administration are at odds on funding the government past the end of the fiscal year is not only illegal \u2013 it\u2019s immoral and unconscionable,\u201d\u00a0AFGE National President Everett Kelley\u00a0said in a statement.\u00a0 <\/b><\/p>\n

No moron, it\u2019s a warning to start preparing for the inevitable. The government can no longer legally spend money that hasn\u2019t been appropriated. The Office of Management and Budget can and will move money around to handle critical functions. However, things like the Department of Silly Walks isn\u2019t critical.<\/p>\n

President Trump warned the Democrats that this would happen and once again, he\u2019s doing what he said he would. Unlike Obama and the Democrats, President Trump is doing what he can to minimize the disruption for the average person. It\u2019s UpChuck Schumer and the Communist who are trying to force President Trump to go back on his word to the people who voted for him. It\u2019s not going to work. He is here for one term, and he intends to make the most of it.<\/p>\n

This lawsuit should be tossed of course, but the Unions are judge shopping and we\u2019ve seen just how corrupt the District Court judges are, at least those who were put in place by Obama and Biden\u2019s handlers. They will not just bend over backwards, these corrupt judges will flat out ignore the law, the Constitution and the Supreme Court. If the judge acts as I expect for a Democrat judge, it will be one more nail in the coffin of the Judicial branch. In the meantime?<\/p>\n
