Good day all. I recently posted a story<\/a> about how the Government Employee unions were going judge shopping to keep President Trump from firing them from their phony baloney jobs.<\/p>\n

I had barely finished the story when the news came out that, once again, a Democrat judge has decided that the President of the United States is not the one running the country, but that the judges are the ones in charge. This judge has issued an order preventing the Trump Administration from laying off federal employees. Here are the details from Fox News<\/b><\/a>:<\/p>\n

A federal judge in San Francisco<\/a> on Wednesday blocked the Trump administration from continuing government reduction in force (RIF), granting a temporary restraining order sought by labor unions that argued layoffs were unlawful during the ongoing government shutdown. <\/b><\/p>\n

\"\"<\/a><\/p>\n

U.S. District Court Judge Susan Illston, a Clinton appointee, ordered the administration not to issue any reduction in force notices to federal employees in “any program, project or activity,” including any bargaining unit or member represented by the unions during, or because of, the shutdown.<\/a> <\/b><\/p>\n

“The evidence suggests OMB and OPM have taken advantage of the lapse in government spending<\/a>\u2013function to assume all bets are off and that the laws don’t apply to them,” Illston said.<\/b><\/p>\n

She further claimed the administration<\/a>‘s actions were “illegal and is in excess of authority and is arbitrary and capricious.”\u00a0 <\/b><\/p>\n

There is so much to unwind with this ruling. First, it is a TRO, (Temporary Restraining Order), not a permanent injunction. Second, it strips authority from the Administration to actually administer the Federal Government. Third, it\u2019s basically ordering the federal government to spend money. Fourth, this judge is basically saying that federal employees are guaranteed jobs for life. Finally, the last section where she calls the firing illegal and capricious pretty much shows that she had made up her mind before the case was even heard.<\/p>\n

In a court filing Tuesday night, an official with the Office of Management and Budget<\/a> (OMB) said more than 4,000 government workers had already received reduction in force notices.<\/b><\/p>\n

<\/p>\n

This order will be appealed of course, however it will be the 9th<\/sup> Circus that will probably hear it. (Hence the comment that the Unions were judge shopping) I fully expect the 9th<\/sup> Circus to uphold the TRO, which will then be appealed to the Supreme Court. I expect them to slap it down, again, 6-3. I think we have reached the point where something massive must be down to reign in these out of control judges.<\/p>\n

I know that Rep. Jim Jordan has been talking about impeaching these judges, but that will fail in the Senate thanks to the Democrats. There is also talk of just shutting down all the courts below the Supreme Court and either making the justices \u201cRide the circuits,\u201d or start rebuilding the inferior courts from the ground up. If something isn\u2019t done soon, several things might happen.<\/p>\n

<\/p>\n

First, the Trump Administration may start ignoring the rulings when they blatantly violate the Constitution. To date he hasn\u2019t been and the Supreme Court has generally backed the administration. However, there may come a point where the administration simply says, Enough is enough!\u201d<\/p>\n

Second, since these judges, and it\u2019s not a large number, but a small group, are issuing orders that are obviously unconstitutional and appear to be usurping power from the Executive, and to some extent, the legislative branches, it isn\u2019t impossible to consider that a few of these judges could be criminally charged with attempting to overthrow the elected government of the United States.<\/p>\n

All of these ways of dealing with these judges aren\u2019t just off the radar, you would need sonar to find them, they are so deep. What I do think is going to happen is that, once the TRO is overturned, we are going to see a move to end government unions. Even the Progressive Liberal Democrats favorite tyrant<\/i><\/span> president, Franklin Delano Roosevelt, thought unionized government workers was a stupid idea. As for the government employees who are going to be RIF\u2019d? If you want to save your phony jobs, then call the Senate and tell the Democrats to approve the clean continuing resolution, otherwise, good luck in your job searches.<\/p>\n
