Good day all. For the last month or so, President Trump has been activating National Guard unites and sending them in to back up Federal Agents and protect federal facilities.<\/p>\n

The blue cities and states have been running to assorted Biden and Obama judges to slow the process down, knowing that the soldiers will not hesitate to kick ass and chew bubblegum, provided they were issued bubblegum. However, there is one Trump appointed Judge who was put on the bench who seems to have nearly drowned in the Progressive Kool-Ade. She has been ruling that the Commander in Chief can\u2019t exercise his duties as Commander in Chief. Here are some of the details from the Populist Times<\/b><\/a>:<\/p>\n

A federal judge in Oregon ruled<\/a> Sunday that President Donald Trump likely lacked the authority to federalize the Oregon National Guard to assist federal agents protecting the U.S. Immigration and Customs Enforcement (ICE) facility in Portland, which has faced near-daily unlawful demonstrations since early June. <\/b><\/p>\n

U.S. District Court Judge Karin J. Immergut, who was appointed by President Trump, issued an order extending a preliminary injunction that temporarily prevents the federalization of the state\u2019s National Guard. <\/b><\/p>\n

Has anyone explained to this stupid judicial bitch that she has just crossed many constitutional lines? She has just ignored Article II, Section 2, Clause 1<\/b><\/a>:<\/p>\n

The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States<\/i>; he may require the Opinion, in writing, of the principal Officer in each of the executive Departments, upon any Subject relating to the Duties of their respective Offices, and he shall have Power to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment.<\/b><\/p>\n

The National Guard are, for all intents and purposes, reserve units of the United States Army. He can call up the Guard at any time for any reason. For all intents and purposes, this judge has declared herself the Commander in Chief.<\/p>\n

In her ruling, Immergut determined that the administration had not met the necessary legal threshold under Title 10, Section 12406 of the U.S. Code, which allows for federalization under specific conditions such as invasion, rebellion, or when the enforcement of federal laws becomes impossible. <\/b><\/p>\n

On the second day of testimony in Oregon v. Trump, et al., Department of Homeland Security officials defended<\/a> the decision to deploy National Guard troops to assist federal agents at the Immigration and Customs Enforcement (ICE) facility in Portland, Oregon. <\/b><\/p>\n

Two witnesses from the Department of Homeland Security\u2019s Federal Protective Service (FPS) testified Thursday, describing the ICE facility as a target of ongoing violence since early June. Both witnesses criticized the Portland Police Bureau (PPB) for failing to respond to repeated calls for assistance during critical incidents. <\/b><\/p>\n

The Portland Police have not only not backed up the Federal Agents, they are arresting people who Antifa has attacked.<\/p>\n

The first witness, identified in court as \u201cR.C.,\u201d serves as the FPS Deputy Regional Director for Region 10 and has acted as incident commander at the ICE site multiple times since June. R.C. testified that the facility has been under \u201csustained attack\u201d by organized groups engaging in criminal conduct, including assaults on federal agents, blocking government vehicles, and attempting to breach the facility with improvised battering rams. R.C. estimated that at least 180 law enforcement officers are required to properly secure the property each night. <\/b><\/p>\n

And this is why President Trump wants and needs to call up and deploy National Guard troops. This is a flat out insurrection by the terrorist organization known as Antifa. The Federal Agents are overstretched, both having to deal with the terrorists and protecting the federal facility. This is what that stupid bitch of a Karen judge, along with the Democrat, Obama and Biden judges are ignoring. Returning to the Populist Times story<\/b><\/a>:<\/p>\n

The three-day hearing took place at the Mark O. Hatfield U.S. Courthouse in downtown Portland. Judge Immergut heard testimony from multiple federal officials with firsthand knowledge of the protests at the ICE facility on Macadam Avenue. <\/b><\/p>\n

These included incident commanders from FPS and ICE officials who described the events as sustained and violent demonstrations linked to Antifa-affiliated groups. <\/b><\/p>\n

The Populist Times story goes into even more details explaining why the troops are needed and how stretched the federal agents are. The Guard troops wouldn\u2019t be used for law enforcement. Their job would be to protect the federal facilities. If the terrorists do something stupid, and considering they are stupid so they probably will, the troops won\u2019t arrest them. They will stop them and hand them over to federal law enforcement authorities to do the actual arrests.<\/p>\n

In this, they would be no different then the average citizen who caught and stopped someone in the commission of a crime. They would hand over the \u201cSuspect,\u201d provide information to the police and let the proper authorities deal with the situation from that moment on. The only way the military acts with law enforcement authority is if martial law is declared, the civilian authorities are removed or otherwise missing from their positions and society has broken down. We aren\u2019t at that point just yet.<\/p>\n

The preliminary injunction will remain in effect until at least November 7, when Judge Immergut is expected to issue a final decision on whether the president\u2019s order to federalize the Oregon National Guard was lawful under federal statute. <\/b><\/p>\n

I have no doubt this barking moonbat is going to rule in favor of Antifa and usurp presidential authority. I suspect the might be the breaking point in the whole lawfare system that the Democrats have been employing since 2017 against President Trump, his administration and pretty much anyone who stands in the way of the Deep State and Democrat party.<\/p>\n

I see one of two things happening. First, President Trump obeys the order, for now and starts the appeals process. In all probability, the judge is going to get slammed by SCOTUS and the guard troops will be deployed.<\/p>\n

However, while that process is going on, I have no doubt that Antifa is going to continue escalating. At some point, shots will be fired, either by the federal agents defending themselves or by Antifa terrorists again firing on federal agents. At that point, order or no, the troops go in and you might just see martial law declared.<\/p>\n

The second scenario is that the Trump Administration ignores the order. He invokes the Insurrection act and sends in the military and the take down Antifa and their supporters. In that situation, I suspect that Judge Immergut will be told to resign or be prosecuted. If the first and in my opinion, the more likely scenario happens, (At least with regards to the appeals process), and one or more federal agents are shot, then in go the troops and without question Judge Immergut will be criminally charged as an accessory. You might also see a sedition charge or, potentially, and I consider this to be very unlikely, (But not impossible), an actual charge of treason.<\/p>\n

<\/p>\n

Judges like Judge Immergut are the reason that a large segment of the country has lost all respect for the judicial branch of the United States. This is a bad thing, but the judges have only themselves to blame for this. Now there is a chance that this judge will see that she is crossing a line and pull back, but I won\u2019t hold my breath. When she issues her bad ruling, we will just add her to the list of judges that congress needs to remove.<\/p>\n
