Good day all. If this is a day ending in a \u201cY\u201d then we have yet another stupid, illegal and unconstitutional order from the district courts. I\u2019ve already posted about the moron judge<\/a> in Rhode Island who has decided he is in charge of the nations finances. Now we have yet another one who thinks she\u2019s the Commander in Chief.<\/p>\n

Then we have Judge Karin Immergut. She was one of the few mistaken appointments to the bench by President Trump in his first term. She has shown herself to be a Democrat operative. As we have been seeing and I have written about, Antifa has been ramping up attacks on Federal Agents and Federal facilities. It\u2019s reached the point that President Trump has been looking to send in the National Guard to protect the federal facilities so the ICE agents can do their job.<\/p>\n

This has led the usual suspects, (The Democrats), to try and stop President Trump from activating and deploying the troops. They know what that would mean. These men and women wouldn\u2019t be playing around. (Not that the Federal Agents have been) Now Karin Immergut has decided that she is in charge of the military and when they can be deployed. Here are the details from Fox News<\/b><\/a>:<\/p>\n

A federal judge on Friday ruled that the Trump administration\u2019s attempt to deploy National Guard troops<\/a> to Portland, Oregon, was unconstitutional. <\/b><\/p>\n

On Sunday, U.S. District Court Judge Karin Immergut, a Trump appointee, temporarily extended an order blocking the administration from deploying troops to The Rose City, saying the government had failed to justify the move. <\/b><\/p>\n

In the Sunday evening order, Immergut temporarily blocked “Defendant Secretary of Defense [Pete] Hegseth from implementing” memorandums that authorized the federalization and deployment of National Guard members from Oregon, Texas and California into Portland. <\/b><\/p>\n

Has this bitch bothered watching the videos of what has been happening in Portland? It\u2019s nothing short of an Act of God that the federal agents haven\u2019t been forced to use lethal force on the Antifa terrorists. The agents on the ground are tired and overstretched. The Guard troops would be in place to protect federal property, which is one of the things the military does. But no, this bitch has decreed that she is now the \u201cGeneral-Marshal of the Armies\u201d and she will decide when and where they will be deployed.<\/p>\n

Friday\u2019s 106-page ruling makes the order permanent. <\/b><\/p>\n

Immergut said in the ruling that the “evidence demonstrates that these deployments, which were objected to by Oregon\u2019s governor<\/a> and not requested by the federal officials in charge of protection of the ICE building, exceeded the President\u2019s authority” because he wasn\u2019t able to demonstrate there was a rebellion or threat of rebellion that couldn\u2019t be enforced without the military. <\/b><\/p>\n

The entire city government is aiding and abetting the attack on the agents and the facilities. The Portland Police have ignored calls for help and have refused to move against the Antifa terrorists. That is about as close to a rebellion as you can get without actually announcing it.<\/p>\n

The administration can appeal the decision. It also faces a temporary injunction in Chicago,<\/a> where a judge has barred the administration from deploying troops. <\/b><\/p>\n

They can also ignore it and we are just about at that point now. I honestly don\u2019t think this judge and the others understand just how precarious their positions are. It\u2019s not impeachment they\u2019re going to have to worry about, it will be actual criminal charges which, under certain, very specific circumstances, could lead to one or more of them being tried with the potential for capital punishment of convicted.<\/p>\n

As it is, I expect this to be appealed and it will go to the 9th<\/sup> Circus Court of Appeals. They will probably uphold it since they are one of the courts that regularly ignore the plain wording of the Constitution. Then it will go to the Supreme Court. However, it\u2019s also entirely possible that the whole thing will be rendered moot. Something bad will happen and the President won\u2019t be sending in the National Guard, it will be the regular Army and the Marines and they will be armed to the teeth. If or when that happens, Immergut is going to find herself in a world of legal hurt.<\/p>\n

As I was putting the finishing touches on this post, I saw a news report that some moron in Chicago had fired on ICE agents. We are slowly inching to the point where the Administration will have no choice but to not just send in the National Guard, but go the full route. Declare an insurrection\/rebellion and institute martial law. If that happens, it will be the Judicial Branch that is blamed.<\/p>\n
