Good day all. Recently, the alleged Chinese spy, Eric Swalwell announced that he was running fro Governor in Kalifornistan. This also meant he was leaving the House of Representatives. However, there might be an issue with his plans.<\/p>\n

Earlier this year, investigations into several members of Congress for mortgage fraud were opened. One of these was Eric Swalwell. Generally, the people involved in this sort of swindle were listing their Washington home as their primary residence in order to get mortgage rate and tax benefits. However, doing so causes issues regarding a persons actual state he is a resident of. It looks like Swalwell might have run afoul of this. Here are the details from the New York Post<\/b><\/a>:<\/p>\n

Lefty California Rep. Eric Swalwell<\/a> isn\u2019t qualified to run for governor of the Golden State \u2014 because he doesn\u2019t officially live there, according to a bombshell new court claim.<\/b><\/p>\n

Right-wing pundit and filmmaker Joel Gilbert said in a court complaint filed in Sacramento that Swalwell (D-Calif.), considered the likely successor to Democratic Gov. Gavin Newsom<\/a>, actually lives in Washington, DC, and is prohibited from running for the top state office under California law.<\/b><\/p>\n

As I recall from the other cases of alleged mortgage fraud, the individuals, Letitia James, Adam Schiffhead, etc, actually have homes or apartments in the states they allegedly represent. It appears this isn\u2019t the case with Swalwell.<\/p>\n

\u201cPublic records searches reveal no current ownership or leasehold interest held by Eric Swalwell in California, nor any history of any ownership of leasehold interest based on available public records,\u201d said the petition filed by Gilbert<\/a> on Jan. 8.<\/b><\/p>\n

\u201cSwalwell\u2019s congressional financial disclosers from 2011 to 2024 list no California real estate ownership.\u201d<\/b><\/p>\n

Yes, that would be a bit of a problem. It might also explain why nothing further was done with regards to his alleged mortgage fraud. If he doesn\u2019t actually own a house or other property in Kalifornistan, then he didn\u2019t commit mortgage fraud. His D.C. home is his primary residence. This begs the question, how was he elected to represent a district he didn\u2019t actually live in, in a state that he also didn\u2019t live in?<\/p>\n

Gilbert said in the filing that the California address Swalwell claimed in a campaign filing Dec. 4 is actually the office of the congressman\u2019s lawyer and not a residence.<\/b><\/p>\n

Now this is where things get really interesting. The Kalifornistan constitution has very specific rules for someone to be qualified to be governor of the state.<\/p>\n

According to Article V, section II, of the California constitution, \u201cThe governor shall be an elector who has been a citizen of the United States and a resident of this state for 5 years immediately preceding the governor\u2019s election,\u201d the filing said.<\/b><\/p>\n

Gilbert said that because of his findings, he wants Swalwell, a vocal critic of President Trump, to be knocked off the ballot.<\/b><\/p>\n

\u201cEither he\u2019s guilty of mortgage fraud in Washington, DC, or he\u2019s ineligible to run for governor of California,\u201d the conservative activist told the Daily Mail<\/a>. \u201cHe can\u2019t have it both ways.\u201d<\/b><\/p>\n

If this all proves out, it will throw a major wrench in the works for Comrade Chinese Spy Swalwell. If he admits that he isn\u2019t technically a resident, then he doesn\u2019t get charged with mortgage fraud. If he says that he is and can show his current residence in Kalifornistan, then he is a criminal who needs to be arrested.<\/p>\n

Now the real question is, will the courts uphold the California constitution and force Swalwell to prove he has been a resident, or will they try and waffle their way out of this? I suspect we all know the answer to that question.<\/p>\n
