Good day all There is a lot going on these days and many things are slipping under the radar. One is a recent announcement by the Florida Attorney General that laws that require racial discrimination are unconstitutional.<\/p>\n


\n<\/p>\n

Now an Attorney General having to say this is both disappointing and also enlightening. For most people any law that favors one group over another because of their skin color is wrong. Now the Florida AG, James Uthemeier has said that such laws won\u2019t be enforced by his office. Here are the details from Fox News<\/b><\/a>:<\/p>\n

Florida<\/a> Attorney General James Uthemeier issued an opinion in which he declared that state laws that call for race-based discrimination are unconstitutional and will not be enforced by his office.<\/b><\/p>\n

“Racial discrimination is wrong. It is also unconstitutional. Yet Florida maintains several laws on its books that promote and require discrimination on its face,” Uthmeier asserted in the opinion<\/a>.<\/b><\/p>\n

\"\"<\/a><\/p>\n

“The question of law presented here is: Are Florida laws that mandate discrimination based on race by giving preferences to certain racial groups, using race-based classifications, or employing racial quotas, constitutional? In short, the answer is no. Any laws requiring race-based state action are presumptively unconstitutional under the Fourteenth Amendment’s Equal Protection Clause and Article I, section 2, of Florida’s Constitution,” he noted.<\/b><\/p>\n

“As Attorney General, I and my office must honor the U.S. and Florida Constitutions’ guarantee of equal protection under the law. Because enforcing and obeying these discriminatory laws would violate those bedrock legal guarantees, those laws are unconstitutional,” he noted. “My office, therefore, will not defend or enforce any of these discriminatory provisions.”<\/b><\/p>\n

\"\"<\/a><\/p>\n

Unfortunately, the Fox story doesn\u2019t list what laws that Attorney General Uthemeier has identified as being discriminatory. I suspect they are old laws that are still on the books but aren\u2019t enforced. However, it\u2019s both good and proper that Attorney General Uthemeier is making it official policy that his office won\u2019t defend or enforce such laws. Hopefully, he is notifying the State Legislature on the problematical laws and they will do the right thing and repeal them as soon as possible.<\/p>\n
