Good day all. We have seen a few Federal judges unhappy with a few acting U.S. Attorneys being in place. They were there handling things until the confirmation process was done and the new U.S. Attorney could be appointed. Some of these jumped up losers have removed the acting U.S. Attorney\u2019s and then appointed their own.<\/p>\n

<\/p>\n

When this happened, President Trump promptly dismissed the judicial appointee. Now another black robed tyrant has decided that he is in charge and not the president and has issued a ruling that the President of the United States may not fire the acting U.S. Attorney appointed by the judge. Here are the details from Fox News<\/b><\/a>:<\/p>\n

An Obama-appointed judge blocked President Donald Trump from firing court-appointed U.S. Attorney for the Western District of Washington Roger Rogoff, ordering the Justice Department to recognize Rogoff as the rightful officeholder and restore his ability to serve.<\/b><\/p>\n

Judge Stanley Bastian, who was first nominated by Obama in 2013, issued a preliminary injunction reinstating Rogoff and barring the administration from treating him as having been lawfully removed. The ruling sets up a legal fight over whether a president can fire a U.S. attorney appointed by federal judges. A 1979 Justice Department opinion and a 2000 federal appeals court ruling both concluded that the president has that authority.<\/b><\/p>\n

That is a blatantly illegal order and violates the separation of powers in the Constitution. The U.S. Attorneys are under the Attorney General and by extension, the President of the United States. They serve at the pleasure of the President and this corrupt, power mad judge has just rocketed over a very big line.<\/p>\n

“This is yet another ruling from an activist judge trying to thwart President Trump\u2019s agenda and undermine his constitutional authority. U.S. attorneys serve at the pleasure of the President,” White House spokesperson Lauren Bis told Fox News Digital.<\/b><\/p>\n

We have been seeing this for years and it has to be stopped. The DoJ is already taking action.<\/p>\n

“We disagree with the decision and intend to seek an immediate stay and will appeal,” the DOJ Rapid Response account wrote.<\/b><\/p>\n

Not just a stay, but sanctions must be brought against this walking judicial diaper stain.<\/p>\n

Some legal experts and conservative attorneys took to social media to sharply criticize the ruling, arguing it infringes on the president’s constitutional authority over the executive branch.<\/b><\/p>\n

“Another lawless and dangerous ruling. Violating the separation of powers. By another Democrat activist judge. This time? Seattle Obama Judge Stanley Bastian,” wrote Article III founder and president Mike Davis<\/a>.<\/b><\/p>\n

The COB, (Clinton, Obama, Biden), judges aren\u2019t even trying to follow the constitution. In many cases they have been pushing the lines regarding the Separation of Powers. Now this clown is just flat out ignoring them.<\/p>\n

“Democrat judges handpicked their own U.S. attorney. The President, through his attorney general, fired him. Under Article II of the Constitution<\/a>, the President clearly has the executive power to fire Justice Department officials,” Davis added.<\/b><\/p>\n

Not according to the COB judges. Especially when it\u2019s regarding anything from the Trump Administration. They\u2019ve also issued orders forbidding the executive branch<\/a> from submitting a proposed rule change to Congress. It also turns out that not only is this black robed tyrant constitutionally illiterate, he\u2019s also personally illiterate.<\/p>\n

“The Federal Judge misspelled his own name in his order. That’s how you know it’s quality legal work,” wrote one user.<\/b><\/p>\n

“Now Judge Bastian created an unnecessary constitutional crisis by essentially ordering a coup at the Justice Department, by ordering the removal of the President\u2019s pick and putting in Bastian\u2019s judicial puppet. The Ninth Circuit must fix this. Or the Supreme Court will have to step in. Again,” Mike Davis concluded.<\/b><\/p>\n

Yes, he has and like all of these arrogant COB judges, he doesn\u2019t care. He knows that while he will be overturned, nothing will happen to him. This is what needs to be changed and sooner rather than later. If we had a functioning congress this jumped up thug would already be told that he will resign or be impeached in the House and convicted in the Senate. The problem is, we don\u2019t have a functioning congress. The Democrat Party put these judges in place for one reason. To serve the Democrat Party.<\/p>\n

<\/p>\n

Now the precedent regarding the removal of executive office holders by the President was decided a century ago in Myers v. United States<\/a>. This involved Woodrow Wilson firing the Postmaster General. The court ruled that the president generally has the constitutional authority to remove executive branch officers and Congress can\u2019t do anything about it.<\/p>\n

More recently, the Justice Department\u2019s Office of Legal Counsel concluded in a 1979 opinion that the president\u2019s statutory authority to remove “each United States attorney” also extends to prosecutors appointed by federal judges.<\/b><\/p>\n

<\/p>\n

This has been going on for some time in Trump\u2019s second term. Because of the incompetence of Senate Majority leader Thune, it\u2019s taking far to long to confirm presidential appointments, especially involving U.S. Attorneys. Because of this, President Trump has reappointed a few people and the judges have removed them and put their own choices into place. As soon as they were sworn in, they were fired by President Trump.<\/p>\n

Rogoff\u2019s case goes a step further, directly testing whether a president can remove a U.S. attorney appointed by federal judges under the statutory process for filling a vacancy.<\/b><\/p>\n

And this needs to be stomped on now. I won\u2019t be surprised if the 9th<\/sup> Circus upholds this judge. This means it goes to the Supreme Court. I would expect it to be shut down there with a 6-3 split. The three liberals will probably rule in favor of judges having more power than prescribed by the Constitution.<\/p>\n

It is possible that Kagan and possibly Sotomayor might actually rule against Bastian the illiterate, but it\u2019s almost a safe bet that the Biden DEI hire will rule against the Trump administration. I\u2019m also sure that her dissent will be a multi-page rant once again demonstrating her complete unfitness to be on any court, including a basketball court.<\/p>\n

<\/p>\n

Something has to be done regarding these out of control judges. Most of them are on the Left side of the political aisle, but there are a few on the Right who also suffer from the delusion that their feces has no unpleasant aromas. Eventually, there will be a reckoning, and it will not end will for the Judicial Branch.<\/p>\n
