Good day all. As you probably know, our so called representatives seem hellbent on taking away our rights, in this case the Second Amendment one. They are pushing through a so-called background check system that even the ACLU, no friend of the Second Amendment, has some concerns over.
All the usual suspects have been saying that “Of course this won’t be a back door registration system and we won’t be coming to confiscate your guns.” Well, guess what? It’s already started. In New York there have been two incidents in the last couple of weeks of a blatantly illegal act by the Police and State Government. Here are some details from Fox News:
A New York resident got into a high-profile fight with the state government this week after officials ordered him to turn over his gun license and his firearms — a dispute that exposed potential problems with the recently passed gun law.
Buffalo-area resident David Lewis has since gotten his license reinstated in what was apparently a case of mistaken identity under the state’s new SAFE Act. The case drew outrage on gun-rights blogs warning that the state was exploiting the law to seize weapons.
Now, one issue right off the bat. Where does it say that I, or anyone else, must have PERMISSION to enjoy MY RIGHTS? As far as I’m concerned, any form of licensing that could preclude you from exercising your Second Amendment right to Keep and Bear Arms is illegal and unconstitutional.
Lewis initially received a notice on April 1 from the Erie County clerk saying that his license was being immediately suspended. He was ordered to surrender it along with his seven registered handguns. “Based on the information received from the New York State Police, your pistol license [redacted] has been suspended by direction of the Licensing Officer for Erie County,” reads the letter sent to Lewis and obtained by Fox News. “Failure to comply with this court directive upon receipt of this letter will be sufficient grounds for the revocation of your pistol license.”
Lewis, who does not have a criminal record, caught the eye of state officials because it was believed that because of a prescription for psychotropic drugs that he was a danger to others, his attorney claims.
Lewis, after receiving the notice, contacted his lawyer Jim Tresmond, who accompanied him to the police department in Amherst and filed for a local hearing to have his client’s privileges restored.
And by what right did the State of New York have to strip Mr. Lewis of his Second amendment rights? Not only that, I think we also have the suppression of Mr. Lewis 4th and 5th amendment rights, not to mention a probable violation of the FEDERAL HIPAA ((Health Insurance Portability and Accountability Act)) statutes. At least the court determined that Mr. Lewis was in the right, and restored his “Privilege” to exercise his rights.
“This court has determined that the information received from the New York State Police, which served as the basis for suspension of the Licensee’s firearms license, was in error” reads the court order from Judge Boller. “…it is HEREBY ordered, the suspension of the firearms license herein is hereby terminated, and any firearms of the licensee being held by any police agency are to be returned.”
I wouldn’t have turned them in to begin with. Worst case, I would have reported them lost in a tragic canoe accident.
The lawyer intends to file suit against the state.
I hope he intends to go for two things. Cold, Hard, Cash, and also to have these unconstitutional laws tossed once and for all.
Then we have another man, John Mayer. Here are the details from Right Wing News:
New York state resident John Mayer was stunned when the police showed up at his home and demanded that he hand over all of his guns. Mayer’s pistol license was also suspended.
You might wonder what happened.
Did Mayer commit some sort of felony? Was he implicated in a terrorist attack? Did he threaten to go shoot up the local school?
No.
It seems that his 10 year old son heard about some of his friends being bullied by some other boys at school. Mayer’s son then discussed bringing a water pistol, a paintball gun and a BB gun to the home of the bullies.
Excuse me? I don’t see any mention of bringing an AR15, .357 magnum or a shotgun in to school and blowing away the bullies. (The BB gun might be problematical)
None of the boys actually owned any of these weapons and nothing came of the discussion, but word did get back to the school’s principal. He suspended Mayer’s son for two days and filed a police report.
How about we sue this principle for everything he has? I see so many issues here it isn’t funny.
Afterwards, the police showed up at Mayer’s house to confiscate his weapons and he was told his permit was revoked until his son turns 18 years of age
And I would have told these Gestapo ((Geheime Staatspolizei)) thugs to get the Hell of my property. If they tried to bulldoze there way into my house, I would have demanded to see their warrant. I would also have someone else on the phone to my lawyer.
Mayer has hired a lawyer, James Murtha, who says that his client will be filing charges against both the Suffolk County Police and Hauppauge School District in federal court.
I hope it’s both a civil suit and a criminal complaint for civil rights violations.
Congratulations to John Mayer for refusing to meekly lie down and take it when the local police violated his constitutional rights. You can actually fight city hall and win, but the first step is to fight back. Let these guys get a little bad press and, let’s hope, a judgment against them in court and you will be surprised how fast they’ll start to respect the 2nd Amendment.
One of the problems I see with these police state tactics is the probability of a major “incident” when police forget their role and try to storm someone’s house. There will be shooting, and a high probability of police fatalities. The worst case scenario, (From the government point of view), will be a home owner successfully holding off the initial raid and calling his neighbors for help. Before the police, (Or federal agents” realize what’s happening, they will be surrounded. Then it will be a choice for them of surrender or being wiped out.
Then we have California. They are about to outlaw pretty much all guns and ammunition in the state. What these tyrants have in mind is staggering.
- Banning the possession — not just manufacture and sale — of magazines holding more than 10 rounds.
- Making possession of hollow point bullets and similar “assault bullets” a felony.
- Requiring anyone wishing to buy ammunition to first get a permit by passing a background check.
- Requiring the registration and reporting of all ammo purchases. Limits the number of rounds anyone can have at one time to 500 rounds.
- Requiring all gun owners will have to be licensed like drivers, and will be forced to carry gun liability insurance.
- Banning any gun that has a detachable magazine, and requires a 100% prohibition of all fixed magazines greater than 10 rounds.
- Making all previous grandfathered magazines become illegal, and it will become a felony if you keep one.
- Prohibiting anyone barred from owning a weapon from living in a home where weapons are kept
- Expanding the list of crimes that would bar a person from gun possession.
- Letting the state Justice Department use money from the state’s Dealer’s Record of Sale system to eliminate the backlog of people identified as no longer allowed to own guns but not yet investigated and contacted by law enforcement.
I can’t see where ANY of this is constitutional. Lets start with hollowpoints. These are used for defensive purposes. The reason? Primarily to prevent over-penetration. Banning the possession of magazines over 10 rounds? Banning any gun that has a detachable magazine? That is pretty much 90% of guns out there today. This is the signs of a totalitarian government moving to enslave the citizens. Of course, this is California, and I have no doubt they will pass this and Governor Moonbat will sign it. Then they will begin the process of kicking down doors and murdering anyone who resists. This is not going to end well in California.
Then we have an idiot in Iowa who wants to start confiscations. Here is the stupidity from Cityview:
State Rep. Dan Muhlbauer ((Dan Muhlbauer)), D-Manilla, says Iowa lawmakers should ban semi-automatic guns and “start taking them” from owners who refuse to surrender any illegal firearms through a buy-back program.
In an interview, a fiery Muhlbauer, the chairman of the Iowa House Democratic Rural Caucus with a reputation for often voting with Republicans, said it is time to act with “radical changes” on gun laws and other issues to protect schoolchildren from shooting sprees like the one in Newtown, Conn.
“We cannot have big guns out here as far as the big guns that are out here, the semi-automatics and all of them,” Muhlbauer said. “Those are not hunting weapons.
He added, “We should ban those in Iowa.”
I have no information on this moron other then what I’ve read today. From his Wikipedia page, this is his first term in office. I suspect it will also be his last term. He is calling, for all intents and purposes, the suspension of the 2nd, 4th and 5th amendments at the very least. I think that declaring martial law and a total suspension of the constitution would be just fine as far as he’s concerned.
Muhlbauer, who did not list the specific weapons he wants outlawed in the interview, said he would like to see the ban implemented in a retroactive fashion.
“Even if you have them, I think we need to start taking them,” Muhlbauer said. “Because if they’re out there, they’re just going to get circulated around to the wrong people. Those guns should not be in the public’s hands. There are just too many guns.”
And here we see the true Progressive Liberal Democrat in full roar. Fortunately, it doesn’t look like this idiot has many people supporting him.
Templeton Mayor Ken Behrens, a Republican, said Muhlbauer’s proposal smacks of an overreach that is out of touch with much of rural Iowa.
“I would hate to see a law where it would be mandated that somebody start taking guns,” Behrens said. “I don’t think that would go over well.”
Now there is an understatement! Not go over well might include lynch mobs and a sudden surge at the local funeral homes. So what else does this clown want to do?
Muhlbauer said the state also should eye more careful screening of who enters schools, government buildings and other facilities. He also suggested consideration of steel doors to prevent entry to classrooms by gunmen. Metal detectors or armed guards at schools may be legitimate options as well, he said.
Yup, he wants a full police state. Now to be honest, some of these ideas many people agree with. Armed guards have been recommended by the NRA, although Mr. Moonbat seems to want actual police officers. How they’re going to pay for them is a good question. Far better to train the teachers and others ins the school and let them carry if they want to. Somehow, I don’t think that is what this pinhead has in mind. There may be a problem with the steel doors. The Dire Department might not permit it. (Ease of escape in case of fire you know)
Muhlbauer said promoting tough gun laws and protecting children in schools are important enough to lose an election advocating.
“We’re talking people’s lives,” Muhlbauer said. “You want to start losing children’s lives and adult lives over a gun issue because the NRA thinks we’re stepping on somebody’s toes?”
Ahh yes, the cry of the Moonbat. “It’s for the Children!”
“With all these shootings going, we have to start making radical changes and radical choices from what we’ve done in the past,” Muhlbauer said.
And if that means making the North Korea look like a free and open society, then so be it! “It’s for the Children!!”
In coming months, Muhlbauer said, he will work to unite rural and urban legislators on efforts to prevent school shooting sprees and other violence.
How about letting teachers, administrative a facilities people carry guns and shoot lunatics when they come in? Oh wait! That makes sense and would increase the number of “EVIL GUNS!” in people’s hands.
Muhlbauer also identified violent video games as a concern.
“We’ve got these video games out here for these little kids,” he said. “Maybe it’s time we start pulling them away. They’re playing some really nasty games on there that are shoot-’em-up. Evidently our culture is pointing toward this.”
So much for the 1st amendment as well I see. Now as to children playing these things, that is what Parents are for. They can simply say “No, you will not play those.”
Muhlbauer said he doesn’t know how the Legislature would go about prohibiting children from playing video games he finds objectionable.
How about summery execution of the makers and sellers of video games? No need to worry about things like a trial. That’s just a waist of time and resources. After all, “It’s for the children!”
“As parents, they’re going to have to start watching what their kids are doing more closely,” he said.
Well, he finally said something that makes sense. Have Mom and Dad look at what the kids are doing. Someone must have poured a cup of common sense into his Cheerios. It won’t last of course.
And finally we have this moron, Mike Martinez of Austin, Texas. He is a city council member and is running for mayor. He made the mistake of telling people that Obama’s long term goal was banning the private ownership of firearms. Here’s a video of his remarks. Now from what I understand, Austin is where Texas puts all it’s Progressive Liberals. I gather it’s so that North Korea can wipe them out more easily ((Austin makes North Korea’s target list)). Most Texans are gun owners and will use those guns if the Federal Government tries to suppress the Second Amendment.
So, there is no plan to confiscate people’s guns. If you believe that, I have a bridge I want to sell you. The Progressive Liberal Democrats will stop at nothing to take away the rights and property of the American people. Nothing with dissuade them until the violent reactions start, and by that point, it will be to late. A number of people, myself included, think that point is going to be reached by the end of the summer, if not sooner.
