Holder and Obama claim Executive Privilege

In the words of somebody somewhere, the solid brown biological waste matter has impacted the rotating atmospheric impeller. Eric Holder is claiming Executive Privilege in Fast & furious fiasco.

For those who have been getting their propaganda news from the so called Main Stream Media, allow me to bring you up to date.

A few years ago the Bureau of Alcohol, Tobacco, Firearms and Explosive, (BATFE), ran an operation that allowed hundreds and probably thousands of guns to be smuggled into Mexico. The stated idea was to track the guns to the end buyers, probably drug lords, and arrest them. The major flaws in this plan was that the Mexican Government wasn’t aware of this happening and as soon as the guns left the gun shops, the BATFE lost track of them. This resulted in the murder of at least two federal agents and hundreds of Mexican citizens. One was Border Security Agent Brian Terry and the other was DEA agent Jaime Zapata.

Almost immediately the coverup began. Unfortunately for the Holder and the Obama regime, a number of honest federal agents came forward, either publicly or behind the scenes to tell Congress what was going on. Once the House of Representative swung back to the Republican party, the investigations began. (Under Queen Nancy, no serious investigations were going to happen)

Rep. Darrell Issa, chairman of the House Oversight and Government Reform Committee, began looking into this and discovered that Operation Fast & Furious was apparently designed to give the Obama regime the means to start restricting the Second Amendment and restart their plan for universal gun confiscation. Rep. Issa asked for documents from Attorney General Eric Holder as well as having him testify under oath about what the hell was going on.

AG Holder refused to supply the requested documents. Rep. Issa at this point had enough of Holder’s stonewalling and issued a subpena for the documents. Holder continued to refuse to supply them. Last week Issa announced that he would be holding a vote to hold Attorney General Eric Holder in Contempt of Congress. Over the weekend, Issa gave holder one last chance to come clean. The answer from Holder came this morning. He is claiming Executive Privilege and continuing to refuse to turn over the documents.

Now, what exactly is Executive Privilege? From Wikipedia:

In the United States government, executive privilege is the power claimed by the President of the United States and other members of the executive branch to resist certain subpoenas and other interventions by the legislative and judicial branches of government. The concept of executive privilege is not mentioned explicitly in the United States Constitution, but the Supreme Court of the United States ruled it to be an element of the separation of powers doctrine, and/or derived from the supremacy of executive branch in its own area of Constitutional activity.

The Supreme Court confirmed the legitimacy of this doctrine in United States v. Nixon, but only to the extent of confirming that there is a qualified privilege. Once invoked, a presumption of privilege is established, requiring the Prosecutor to make a “sufficient showing” that the “Presidential material” is “essential to the justice of the case.”(418 U.S. at 713-14). Chief Justice Burger further stated that executive privilege would most effectively apply when the oversight of the executive would impair that branch’s national security concerns.

In this case, I think Obama intends to fight this tooth and nail and if ordered by the courts, may just ignore them. The big reason for all this is why? Personally, and with no information to confirm this, I think that not only did Holder know about Fast & Furious, so did Obama and most of the cabinet. I also think they are the ones, once the general idea was proposed, who approved this and let it go forth. I’m not a lawyer, but if it is the case that the whole plan was to use the murder of Mexicans as a back door way to ramp up gun control, and if Obama knew about and approved it, the whole administration is looking at serious prison time. The charge would be accessory to the murder of a Federal Agent. It may not rise to the level of the death penalty, but if it can be proven that Holder, Obama and the others were aware of and approved of this disaster, they will probably spend the rest of their lives in a maximum security prison.

Now if only that moron Romney would get his head out of his ass and start beating Obama over the head with this….
