Good day all, did you know that the Environmental Protection Agency has declared water to be a pollutant? Yes, you heard me, water. Apparently there is a court case ramping up between Virginia and the EPA.
According to Fox News:
The EPA, citing an abundance of stormwater runoff, has proposed a plan that Virginia officials say would cost them nearly half a billion dollars — and could cost homeowners and businesses their private property.
The EPA contends that water itself can be regulated as a pollutant if there’s too much of it. The agency says heavy runoff is having a negative impact on Accotink Creek and that it has the regulatory authority to remedy the situation.
Virginia is fighting this for a simple reason. It’s asinine.
Virginia Attorney General Ken Cuccinelli, a Republican, says what the EPA has proposed is “illegal,” and he’s not alone in the fight. He’s been joined in a lawsuit against the federal agency by the Democratic-controlled Fairfax County Board of Supervisors.
Cuccinelli argues that what the EPA has planned would require state and county officials to “take people’s houses, evict them, knock the houses down and plant grass.”
The EPA, of course, denies this.
In legal filings, the EPA says that its plan is “in harmony with the broader purposes” of the Clean Water Act, including “reducing the water quality impacts of stormwater.”
“There is no possibility of homes being removed in this process,” Simon Rosenberg, founder of the New Democrat Network, said. He called the claim by Cuccinelli an “overstatement.”
Considering the history of the fanatics in the EPA, I do believe they intend to force people from their homes and property. We have volumes of information ((Need another reason to close the EPA?)) ((And the EPA strikes back!)) ((The EPA finally loses one!)) on how the EPA has abused it’s authority to push their anti-human agenda on the United States. Even when Congress tells them to stop, they routinely ignore them and continue on with their plans.
The EPA has mutated from an agency meant to help clean up the air and water into a full blown anti-business, anti-human, and anti-freedom secret police agency. A few days ago, a reader of Powerline Blog commented on a posting with an interesting question. The commentator, Don Bagwell asked:
Do you envision any States vs. Washington constitutional crisis to arise from this? If so, around what points of the constitution would you imagine they would occur, and what outcome scenarios would you imagine?
I’m asking a very sincere and serious question here. I like the general concept of flanking the Federal Government from the bottom up. But Washington is unlikely to simply roll over if the states flex their muscles. At some point the Federal Government will attempt to force the states into submission. If the states refuse… then what? Lots of possibilities exist, of course… but what would you imagine to be some probable ones?
This is a very interesting question, especially with the outright power grabs by both Obama and his unelected czars and bureaucrats. The author of the post, Steven Hayward, had several ideas regarding a potential crisis. One of his answers fits with my post:
The second way this might happen would be a state—probably Texas—that refuses to implement new EPA dictates on greenhouse gas emissions under the Clean Air Act. Obama will threaten to cut off federal funds to the states, and then things might get even more interesting. Will Obama actually send in federal marshals to enforce federal regulations? Love to see federal marshals meet up with Texas rangers. (Maybe Tommy Lee Jones can play both parts in the movie version.)

One of the things a lot of pundits on the national level have missed is what’s been happening on the state levels. Even though King Putz managed to sleaze his way to a second term, and the Party of Stupid managed to blow several easy senate wins, the Conservative wing of the Republican party has been doing very well on the state level. These states are now starting to push back hard against the dictates of the SCoaMF’s regime and his bureaucratic minions. A number of states have already said they won’t sign up for these corrupt Obamacare Exchanges, which has thrown the Department of Health and Human Services into a panic. They never expected the states to refuse to implement the Obamacare exchanges.
With the EPA and their attacks against businesses and individuals, and now the new Consumer Financial Protection Bureau ramping up, we are moving into the realm of totalitarian government. For those of you who may not be aware, the Consumer Financial Protection Bureau is part of the Dodd/Frank law that was pushed through after the financial crises started a few years ago. This bureau is by far the most dangerous one to American’s freedom to come down the pike. They are designed to be self funding and have no congressional oversight. They have basically unchecked authority to do whatever they want.
Dodd/Frank was pushed through to provide cover for former senator Christopher Dodd and soon to be former representative Barney Frank. Those two were major reasons that the housing market and financial system collapsed. Rather than resign, or as should have happened, been prosecuted, these two came up with a bill that basically protects themselves and their cronies in the financial sector. This bureau is just now setting up, so there have been no court challenges to it as yet. There certainly will be in the future.
The states that have managed to weather the financial crises, primarily the so called “Red States” have been targeted by the Obama administration. First was the EPA dragging innocent companies into court to essentially ruin them, then the National Labor Relations Board threatening Boeing for planning to build a plant in South Carolina ((NLRB Sues Boeing; Seeks End to Commercial Jet Production in South Carolina)) and the Justice Department preventing states from defending their borders from Illegal Aliens coming in ((Justice Department sues Arizona over immigration law)). All these states have one thing in common. They do not support the Democrats or Obama.
Now with Obama in a second term and free to do pretty much what he wants, the states are beginning to see that they are in a fight for their lives. Obama is a totalitarian who believes in the power of the Central Government to regulate every little thing. The states are now really digging in and are fighting back against the bureaucracies and Washington. The 10th amendment ((Tenth Amendment to the United States Constitution)), after decades of being ignored, is now being used to fight the encroachment of Washington. We can’t let the totalitarians in Washington win. If they do, we lose everything.
