Civil Disobedience in New York

A couple of weeks ago, Andrew Cuomo and his minions rammed through one of the most blatantly illegal and unconstitutional gun laws in the country. The new law, scheduled to go into effect in March, essentially renders 90% of all firearms in New York illegal.

Well, resistance to this new law is already starting. Gun owners across the state are stating they will not comply with the nre law in any way, shape and form. In an article last week in the New York Post, gun owners announced a mass boycott in complying with the so called “Safe Act.”

Assault-rifle owners statewide are organizing a mass boycott of Gov. Cuomo’s new law mandating they register their weapons, daring officials to “come and take it away,” The Post has learned.

Gun-range owners and gun-rights advocates are encouraging hundreds of thousands of owners to defy the law, saying it’d be the largest act of civil disobedience in state history.

Well, the first problem here is the term “Assault Rifle.” The guns they are banning are not assault weapons. Those are fully automatic rifles which are not generally available to people. You can get them, but they cost a lot of money and you need to pay a tax to the federal government. (Frankly, that’s another violation of the 2nd Amendment, but we’ll deal with that another time) Needless to say. State officials are a might concerned about tens of thousand, or hundreds of thousands of people not complying with the orders from their masters.

State officials will be nervously watching the registration figures to see how many gun owners comply, sources said.

“I believe you will have people stepping forward, saying, ‘Here I am. See? I have what you call an assault rifle. Now come and take it away,’ ’’ said a gun-rights activist and boycott organizer.

That’s exactly what state officials are worried about.

“Many of these assault-rifle owners aren’t going to register; we realize that,’’ said a Cuomo-administration source who added that officials expect “widespread violations’’ of the new law. Owners who refuse to register could face a class-A misdemeanor — punishable by up to a year in prison.

I wouldn’t want to be a police raid team going after people who are refusing to obey what is an illegal law. Oh, it’s not only the 2nd Amendment this law violates, it’s also violates provisions on the New York State constitution as well.

Leaders of some of the state’s 300 gun clubs, gun dealers and Second Amendment organizations are organizing the boycott — and the heaviest interest is in Suffolk County, the Capital District and the Buffalo region, sources said.

The organizers point to a little-known guarantee of gun ownership contained in New York’s own “Civil Rights Law,” which was ratified the same year as the Constitution.

The state statute says the right to keep and bear arms “cannot be infringed” — stronger than the Second Amendment, which says it “shall not be infringed.’’

Obviously His Royal Shortness, King Michael Bloomberg the Last, never read that part, (or any part of), the State Constitution.

“They’re saying, ‘F— the governor! F— Cuomo! We’re not going to register our guns,’ and I think they’re serious. People are not going to do it. People are going to resist,’’ said State Rifle and Pistol Association President Tom King, a member of the NRA board of directors. “They’re taking one of our guaranteed civil rights, and they’re taking it away.’’

Cuomo and the gun grabbers in Albany are not backing down regarding this. They are issuing threats of their own right back.

Threats of imprisoning gun owners for up to a year and confiscating their weapons are already being issued by governor’s office, headed by a rabid anti-Second Amendment extremist who suggested before the bill passed that “confiscation” of all semi-automatic rifles was being considered.

Although I can’t say for sure, I am expecting a number of lawsuits to overturn this law in the next few weeks to be filed. If this goes into effect, and Cuomo’s stormtroopers start carrying out raids, there WILL be shooting. If shooting does start, it won’t be like the Branch Dividian fiasco in Waco, Texas in the mid-90’s. It will be far, far worse. Most people don’t remember that the Dividians were not looking for a fight and allowed the BATF agents to basically surrender and clear their casualties. This time, if an all out gun battle happens, and the citizens hold off the first “attack,” others will come to help them and they will cut off the raid team from any hope of escape or reinforcements. If that scenario happens, you will see the surviving members of that raid team either taken away in their own handcuffs, or wiped out to the last man and woman.

Congratulations, the second American Civil War then begins. Before the Democrats in Albany even come to grips with what has happened, they will find thousands of people, armed to the teeth, storming the state house and the governors offices/mansion and dragging them out into the streets. Then they will see what happens to the ruling class when they finally rouse the citizens. (That will be nooses being set up on trees and lamp posts)

Around the country, gun owners are chanting back at Obama and Feinstein one very old phrase. “Molon Labe.” That was the phrase used by the Spartan King, Leonidas, at Thermopylae when the Persians demanded the Spartans surrender their weapons. It means “Come and take!” ((Molon Labe)) In modern American usage, it’s evolved to “Come and take them, IF you dare/can!”

times_up_flag_zAt the federal level, Senator Diane Feinstein has submitted a bill that essentially guts the 2nd Amendment. Currently, it has little chance of making it to the Senate floor, let alone into the House. However, Obama and Feinstein are going full bore to ram it through, either legislatively or through Obama’s use of Executive Orders. Resistance to these measures is coming in from the states, with a number of local police departments stating flat out they will not comply with any federal order to enforce unconstitutional gun laws. A number of state legislatures are also preparing bills that will not only prevent local, county and state officials from enforcing federal gun laws, they are also threatening to arrest FEDERAL law enforcement officials if they try to arrest lawful gun owners.

As you might expect, so called “Constitutional Law” scholars are saying that the states can’t implement these laws. They are arguing that Supremacy Clause ((Article VI, Clause 2 of the United States Constitution)) will always trump state laws. However, there is also the 10th Amendment ((Tenth Amendment of the United States Constitution)) of the Constitution, which was passed after the original constitution was ratified. It reads:

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

So, we have states that are passing laws that are meant to enforce the Constitution and these so called scholars are saying they can’t. My response to that is, “Wanna bet Sparky?” The states have had it and so have more than half the people of the country. Don’t look at who voted and the vote tallies, they are meaningless in this debate. You need to look at what is actually happening. In New York, the people are saying “NO!” and they are saying it very loudly. Cuomo and the others flat out don’t care and aren’t listening. They may find out just how serious this is becoming.
