Chicago once again told to follow the 2nd Amendment

Good day all. Once again the courts have done the right thing and upheld the constitution and slammed the city of Chicago. What am I talking about? Another court case was just decided in favor of the 2^nd amendment and against the city of Chicago.

Now this case was about dealers being able to sell guns inside the city. The city government, run by the usual suspects and led by mayor Rahm Emanual, have done everything they can to keep the citizens of Chicago from having the means to defend themselves. This has translated into essentially outlawing the sale and possession of guns to law abiding citizens. Murderers, rapists and thieves were quite happy with this state of affairs since it reduced the likelihood of their getting killed by their intended victims. Here are some of the details from CBS Chicago:

A federal judge has potentially opened a new market to gun dealers after ruling as unconstitutional Chicago ordinances that aim to reduce gun violence by banning their sale within the city’s limits.

U.S. District Judge Edmond E. Chang said Monday that while the government has a duty to protect its citizens, it’s also obligated to protect constitutional rights, including the right to keep and bear arms for self-defense. However, Chang said he would temporarily stay the effects of his ruling, meaning the ordinances can stand while the city decides whether to appeal.

A couple of things here. First, Judge Chang made a mistake when he said the government has a duty to protect its citizens. A number of Supreme Court precedents and decisions going back over 100 years has said that the government does NOT have such a responsibility. The second issue is the stay pending appeal. I understand that stay, but the odds of Chicago winning are remote considering recent 2^nd Amendment cases from the USSC.

The decision is just the latest to attack what were some of the toughest gun-control laws in the nation. In 2010, the U.S. Supreme Court struck down Chicago’s long-standing gun ban. And last year, Illinois legislators were forced by a federal appeals court to adopt a law allowing residents to carry concealed weapons; it was the only state that still banned the practice. The resulting law largely stripped officials in the city and surrounding Cook County of their authority to regulate guns, which especially irked officials in Chicago, where residents had to apply for concealed-carry permits through the police superintendent.

The basic rule of thumb for Chicago is “Only police, criminals and special people can have guns. The rest of you serfs can just die for all we care.” Chicago has been one of the most corrupt cities in America going back decades. Like all criminals, having the citizenry able to defend themselves is not only an anathema to them, it’s also down right dangerous. The Pols in Chicago do not want to go the way of the Pols in Athens, Tennessee ((Battle of Athens (1946))).

Roderick Drew, a spokesman for Chicago’s law department, said Mayor Rahm Emanuel disagrees with Chang’s ruling and has instructed the city’s lawyer to consider options to regulate gun sales.

Rahm Emanual is nothing more then a totalitarian thug. If the courts were to say that all gun control measures that restrict law abiding people from owning any and all types of firearms, up to and including artillery, people like Emanual and Obama would simply ignore it and continue suppressing the rights of the people.

“Every year Chicago police recover more illegal guns than officers in any city in the country, a factor of lax federal laws as well as lax laws in Illinois and surrounding states related to straw purchasing and the transfer of guns,” Drew said. “We need stronger gun safety laws, not increased access to firearms within the city.”

Define illegal guns moron. Do you mean guns in the hands of those who are not legally entitled to them due to previous court actions? You know, they were convicted of a crime and lost their rights after the due process of law as defined by the 5^th Amendment of the Constitution? Somehow, I don’t think that was what you had in mind.

In his 35-page opinion, Chang said he understood Chicago enacted the gun sale ban to safeguard its residents.

“That is one of the fundamental duties of government: to protect its citizens,” he wrote. “But on the other side of this case is another feature of government: certain fundamental rights are protected by the Constitution, put outside government’s reach, including the right to keep and bear arms for self-defense under the Second Amendment.”

I’ve already made note of what I consider to be an error in this decision, the one about the government having a duty to protect people. Otherwise, I don’t have to much of an issue here.

Illinois Council Against Hand Gun Violence campaign coordinator Mark Walsh said he wasn’t surprised by the ruling.

“I’m not sure what the city’s plan is (following the ruling), but I think obviously there is a need to make sure gun dealers coming into the city are aware of those who have restrictions on gun ownership and don’t sell to them,” he said.

The misnamed Council Against Hand Gun Violence remarks don’t surprise me. Their goal has always been outright confiscation of all privately owned firearms. As to my remark that they were misnamed? They should be called the “Council for the Suppression of the Constitution and Enslavement of the American People to their Progressive Liberal Masters.” Of course, I can see why they might not like that one. It would be tough to fit on a letterhead or a business card.

Now, the real “Shove the knife in and twist” part of this ruling is Judge Chang. He was appointed by King Putt himself. Yep, this guy is a typical Progressive Liberal Moonbat who “grew” once he got on the bench. Of course, he didn’t actually grow the way Obama and his minions intended. I suspect that Rahm Emanual had a hand in his selection. This must really stick in his craw.

I can see it now. Emanual, in full tirade, screaming about how he was betrayed by Judge Chang. No doubt he was expected to always rule in favor of the Moonbat elite’s view of the State being all powerful and the people to have no rights, only privileges granted to them by their highly educated betters. Yep, nothing like finishing up a post with a nice bit of schadenfreude.
