Good day all. It seems that the IRS was not exactly accurate when they said that Lois Lerner’s email, along with other users email, had been lost. Thanks to Judicial Watch’s court actions, The Department of Justice is saying the email might still exist.
Now, as anyone who has worked in the Information Technology field, especially in Government, knows that “Losing email” these days is pretty much impossible. Now the DOJ is admitting to this. Here are the details from Fox News:
In a stunning revelation, the president of the conservative watchdog group Judicial Watch told Fox News that Justice Department attorneys have intimated that Lois Lerner’s “lost” emails likely exist in back-up computers.
Judicial Watch President Tom Fitton said the news came during a Friday phone call with Department of Justice attorneys representing the IRS in Judicial Watch’s FOIA lawsuit against the IRS. Fitton said DOJ attorneys told him the federal government backs up all computer records to ensure the continuity of government in event of a catastrophe. They told him that retrieving the emails from Lerner, a former IRS official, would be “too onerous” – a legal burden that can exempt an agency from complying with FOIA requests.
First, I’m not surprised that the DOJ lawyers finally came clean. They were being put under the perjury and contempt of court guns if they didn’t. As to the bit about being “To onerous to find?” Manure. They won’t have any real problem finding the pertinent data. After all, suppose they had to do a restore after all the servers in Washington were destroyed by the Obama Regime ISIS? Now, the Obama Maladministration is denying that there is any such backup system.
However, an administration official told Fox News Monday night, “ There was no new back-up system described last week to Judicial Watch. Government lawyers who spoke to Judicial Watch simply referred to the same email retention policy that Commissioner (John) Koskinen had described in his Congressional testimony.”
Somehow, I don’t think the judge is going to believe anything coming out of the White House regarding this. I expect the next order from the judges handling the case will be to produce all the relevant messages or else.
Earlier, in describing the phone conversation, Fitton told Fox News,”So everything we’ve been hearing about scratched hard drives about missing emails of Lois Lerner, other IRS officials, other officials in the Obama administration, it’s all been a pack of malarkey.
Pretty much, although I think the term “Bald faced lies” is a bit more accurate.
Investigators have been deeply skeptical that Lerner’s emails were truly gone. Law requires government emails be backed up. Also, data from crashed hard drives can often be recovered, and all emails have a recipient or a sender.
“Somebody in Lois Lerner’s position has an executive assistant who has access to her email just as though she did,” said Morgan Wright, a computer forensics expert. “So whatever email comes into Lois Lerner’s box goes into her administrator’s box as well.”
And the response will be “Oh, so sorry, that computer drive crashed as well and since the drive couldn’t be recovered, we had it destroyed.” Yeah, and I just watched a unicorn blow a rainbow fart outside my window. And it’s getting even worse for Lerner and the Obama Crime Family. They also destroyed Lerner’s Blackberry. In another story from Fox News:
Lois Lerner’s Blackberry was intentionally destroyed after Congress had begun its probe into IRS targeting of conservative groups, a senior IRS lawyer acknowledged in a sworn declaration.
Thomas Kane, Deputy Assistant Chief Counsel for the IRS, wrote in the declaration, part of a lawsuit filed by Judicial Watch against the IRS, that the Blackberry was “removed or wiped clean of any sensitive or proprietary information and removed as scrap for disposal in June 2012.”
Now, why is that date significant?
That date – June 2012 – is significant because by that time, ex-IRS official Lerner had already been summoned before congressional staffers who interviewed her about reports of the IRS’ targeting of conservative groups.
“We had already talked to her. Our personal staff and Oversight Committee staff had sat down with Ms. Lerner and confronted her about information we were getting from conservative groups in the state of Ohio and around the country,” Rep. Jim Jordan, R-Ohio, told Fox News.
Uh oh! That sounds like destruction of evidence to me!
“If you intentionally destroy evidence, that is a crime. If you make a statement in court saying the evidence is not available and it is, that is also a crime,” said Jay Sekulow, Chief Counsel for the American Center for Law and Justice.
Now I don’t use and never have used a Blackberry, but I do know how they work. They can be configured to access email. In fact, this is one of their main selling points. Depending on settings, any messages will be copied to the device, and usually would be so the user can access them even if they are in a dead zone. Destroying a perfectly good Blackberry reeks of “COVERUP!!!” especially after the IRS was told to preserve everything by congress. There can be only one reason to try and destroy all of the relevant email. There’s something in there that’s far worse then obstruction of justice. Perhaps a “Smoking Email” into the highest levels of the White House? Valarie Jarrett possibly? Maybe even Barack Obama? Hmmmm.
