Could Biden’s spending plan be ruled unconstitutional?

Good day all. Last December Bumbles Biden singed into law a $1.7 Trillion dollar spending bill. This bill was rammed through the House and Senate with very little in the way of understanding what was in it. Now an interesting thing is happening. The Attorney General of the State of Texas has filed a lawsuit seeking to stop the spending authorization.

Normally, there is little the American People can do when it comes to the out of control spending by both the Democrats and Republicans. There are some who try to reign things in, but with the likes of UpChuck Schumer, Cocaine Mitch McConnell and, at the time, San Fran Nan Pelosi, the American taxpayers usually get it in the shorts.

However, it seems that Ken Paxton, the A.G. of Texas may have found a way to stop the spending dead in it’s tracks. His claim is that the spending bill was not lawfully voted on in the House of Representatives. Here are the initial details from the Office of the Attorney General of Texas:

Attorney General Paxton is suing President Biden and members of his Administration over the unlawful signing and implementation of the Consolidated Appropriations Act of 2023, which was the latest omnibus spending bill. 

The U.S. Constitution requires that a quorum of members of the U.S. House of Representatives be present for the lower chamber of Congress to conduct business. When the House passed the Consolidated Appropriations Act of 2023 in December 2022, fewer than half of its members were present and more than half voted by proxy. 

Pelosi is going to go down in history as one of the most corrupt Speakers of the House in living memory, if not of all time. Her first term as Speaker gave us the disaster known as Obamacare. Most people were and still are utterly opposed to it and if it hadn’t been for the craven cowardice of John Roberts, it would have been tossed on the ash hep of history.

When the Deep State cooked up the Covid-19 panicdemic, Pelosi used this as a way to basically rig votes. She sent members of the House home and instituted measures to basically keep the House in session under what Paxton is saying were not authorized by the Constitution of the United States.

The U.S. Constitution empowers a quorum-less House only to “adjourn from day to day” or “compel the attendance of absent members.” Because “attendance” means physical presence, the U.S. Constitution does not allow voting by proxy to constitute a quorum. And because the omnibus spending bill wasn’t passed when a quorum of the House was present, it was never lawfully enacted, is unconstitutional, and the federal government should be enjoined from implementing it.  

Nowhere does the U.S. Constitution authorize the House to pass trillion-dollar bills when more than half the members are in their homes, vacationing, or are anywhere physically other than the United States Capitol Building,” said Attorney General Paxton. “Our Founders would be turning over in their graves if they could see how former Speaker Nancy Pelosi used proxy voting to upend our constitutional system. That is especially true regarding the 1.7 trillion-dollar bill that should have never been ‘passed.’ Joe Biden, who’s been in Washington for half a century, should have known he couldn’t legally sign it either. But he never seems to let the law get in the way of him doing whatever he wants to do.” 

Continuing with more information from Fox News:

The House passed a revised version of the bill with 225 yea, 201 nay votes, and 1 present, however, the votes of those physically on the floor were only 88 yea and 113 nay. Several Republicans voted by proxy on the measure as well, along with most Democrats.

The Democrats, being the lazy bloodsuckers they are, couldn’t wait to bail out of Washington and not do the jobs they were elected to. As for the few Republicans? I don’t have their names, although I could look them up. I suspect they were the “Usual suspects.” RINO’s and TransRepublicans.

“That is especially true regarding the 1.7 trillion-dollar bill that should have never been ‘passed.’ Joe Biden, who’s been in Washington for half a century, should have known he couldn’t legally sign it either. But he never seems to let the law get in the way of him doing whatever he wants to do.” 

Biden, like all Democrats, doesn’t believe in the Constitution or the Rule of Law. He has never let anything stand in his way of what he wants, be it money, power or sniffing little girls hair. While Pelosi isn’t a pedophile, she is just as corrupt as Biden is. Her favorite line, when she was Speaker of the House was “We have to pass the bill so that you can find out what is in it.”

The reason was simple. Any delay and the members might actually find out just how bad the bills she wanted to ram through actually were and not vote for them, or worse, the serfs, peons and little people in Flyover country might find out and let their representatives know that they weren’t happy.

Pelosi initially implemented proxy voting as a way to avoid spreading COVID-19 in 2020, but continued to allow members to vote without being present on the floor through December. The GOP ended the practice after it took control of the chamber in January.

One potential issue with this lawsuit is the constitution’s providing that each house may determine it’s own rules and procedures. However, there is also the part about there needing to be a quorum in the House to pass a bill. This is going to be very interesting, and as I understand it, Attorney General Paxton is looking for an expedited hearing on this to stop what he sees as illegal spending. All I can say is, I hope he wins and I intend to watch the show.
