Good day all. Recently, the Supreme Court issued a decision on the EPA’s attempt to expand their power to what amounts to puddles in people’s property. They unanimously slapped them down. What is surprising was that it was a unanimous decision. This isn’t sitting to well with people like UpChuck Schumer.
Schumer, who makes Nazis, Communists and Fascists look like true believers in the rights of the people, went off his nut and accused the Court of being the “MAGA Supreme Court.” Here are the details from Fox News:
Senate Majority Leader Chuck Schumer, D-N.Y., slammed the Supreme Court’s ruling Thursday that limited the Environmental Protection Agency’s ability to regulate bodies of water, calling it a “MAGA” court even though the decision was 9-0.
The decision by the court concerned how the EPA treats water on people’s private property. The EPA has long had a tendency to stomp all over people’s property rights, denying them the use of their land and not compensating them for it. This is part of what the court was responding to.
On Thursday, the high court issued an opinion that narrowed the EPA’s broad definition of Waters of the United States (WOTUS). The court said the federal government must define WOTUS as a water source with a “continuous surface connection” to major bodies of water.
Basically they told the EPA that they can’t take people’s property claiming that a puddle that only appears when it rains is a major body of water. That would be something like Lake Michigan or the Atlantic Ocean. Since this decision stripped power away from the regulatory and deep state, this is what set off Upchuck Schmuckface.
“This MAGA Supreme Court is continuing to erode our country’s environmental laws,” Schumer tweeted after the opinion was released. “Make no mistake – this ruling will mean more polluted water, and more destruction of wetlands.”
I take it someone forgot to mention to UpChuck that a unanimous decision also included the three barking progressive moonbats.
The ruling came down 9-0 in favor of plaintiffs Michael and Chantell Sackett, two Idaho residents whom the EPA prohibited from building a home near a wetland years ago.
“The EPA ordered the Sacketts to restore the site, threatening penalties of over $40,000 per day,” Alito’s majority opinion stated. “The EPA classified the wetlands on the Sacketts’ lot as ‘waters of the United States’ because they were near a ditch that fed into a creek, which fed into Priest Lake, a navigable, intrastate lake. The Sacketts sued, alleging that their property was not ‘waters of the United States.'”
As I recall, the Sacketts had built a house and other things and the EPA told them to tear it all down or else. Now I freely admit, I’m doing this from memory and haven’t bothered to look up the details. As far as I’m concerned, this was an illegal taking of their property without compensation as well as an abuse of power by the EPA. As you would expect. The Republicans were quite happy with the decision.
Republicans and industry groups embraced the decision as a blow against what they view as federal overreach and excessive regulation.
“Big win today at the US Supreme Court,” said West Virginia Attorney General Patrick Morrisey, whose office led 26 states in filing an amicus brief supporting the Sacketts.
Of course, the White House, along with UpChuck, were also unhappy that they had been slapped down once again.
“It will jeopardize the sources of clean drinking water for farmers, businesses and millions of Americans,” White House press secretary Karine Jean-Pierre said at Thursday’s press briefing in reaction to the decision.
“President Biden will use every legal authority available to him to ensure Americans in every state have clean water,” she added.
We already have laws on the books about keeping water clean, and the penalties for illegal dumping are massive. What this was all about was stripping people’s land away from them at no cost to the Government. Again, going from memory, I recall hearing something, a very long time ago, that all the “Environmentalists” would like nothing better then to completely depopulate the Midwestern and western states and turn the whole thing into one giant national park. Using the regulatory agencies as their stormtroopers was one of the ways they planned on doing this.
As KJP stated, Dementia Joe will do whatever he can to strip people’s rights and property away from them. Well, the people running him will do so. Of course, Dementia Joe has always been on board with “Der Zustand uber Alles,” so it’s understandable that he and the rest of the Democrats are so enraged.
As expected, they are calling for packing the court again. Never mind that the three progressives agreed with the Constitutionalists. That they are calling for packing the court with justices who will rule in favor of the government regardless of the Constitution speaks volumes. Well, we can worry about that Constitutional Crises another day. For now, sit back, pop a cold one, (Which isn’t sold or given away by Dudweiser) and enjoy this victory.
