Good day all. This story has just broken. Daniel Penny, the former Marine who was forced to defend himself and others on the New York Subway has been exonerated. The jury has returned a verdict of NOT GUILTY in the remaining charge.
For those who have been living under a rock for the last year, Daniel Penny was on a subway when a crazed nut named Jordan Neely started ranting, raving and threatening people. Penny grabbed him and got him into a choke hold to try and keep him from attacking people. Due to all the drugs in his system, Neely wouldn’t calm down and eventually died.
There were witnesses and videos galore of the incident and anyone with two functioning brain cells could see that Penny was acting in self defense and the defense of others. However, as we’ve all come to learn, Alvin Bragg doesn’t have two functioning brain cells and he criminally charged Penny with 2nd degree manslaughter and criminally negligent homicide.
The more serious charge resulted in a hung jury. By rights, the charges should have been dismissed. However, the judge sent the jury back to consider the lesser charges. Apparently, this was in violation of his own instructions. (I’ll leave that to others more knowledgeable in the law and this case) From what I understand, this was a major error and if the jury had convicted, probably wold have resulted in the verdict being thrown out on appeal. In any case, this won’t be happening. The jury came back very quickly and delivered a verdict of Not Guilty.
As expected, the “Usual Suspects” are unhappy with the verdict and are screaming racism and calling for riots. (Yeah, good luck with that) Here are some of the details of the outcome from Fox News:
Daniel Penny has been found not guilty of criminally negligent homicide in the subway chokehold death of Jordan Neely. It comes after jurors told the court Friday morning they couldn’t reach an agreement on the top charge, second-degree manslaughter, and prosecutors moved to dismiss it, prompting the judge to controversially allow them to only deliberate the second charge.
The prosecutors, in the opinion of many, are the ones who should be on trial. Dismissing the charge is what led many lawyers to ask why the case continued in the first place. It appears the judge was trying to “Get” Penny. Now when the verdict was read, many in the courtroom cheered the outcome. Of course, as mentioned before, the “Usual Suspects” were not happy.
Penny’s side of the courtroom erupted in cheers, prompting an angry response from Neely’s side, including his father, Andre Zachary, who was escorted out of the courthouse along with several Black Lives Matter leaders after allegedly snapping.
Someone clapped, and Zachary turned and glared, “Are you trying to f—ing get killed?” The man who clapped later told Fox News he did not take the comment as a threat.
This clown is suing Mr. Penny. The acquittal makes this difficult and there is the other issue that Zachary was, apparently, a no show dad. Many people are wondering where Neely’s family was when he was on the street and homeless.
Hawk Newsome, a leader of BLM’s New York chapter, commented that “It’s a small world.” Others on Neely’s side of the courtroom were seen weeping at the verdict.
Oh look! Communists from the Black Lives Only Matter group making implied threats again! I wonder if they’ve recovered any of the donations all the guilty white liberals gave them that seemed to have gone missing over the years? As for that blithering idiot Alven Bragg, he released a statement.
In a statement, Manhattan District Attorney Alvin Bragg, whose office secured charges against Penny with a grand jury indictment after police had questioned and released him in connection with the incident, said he would respect the jury’s decision. However, he also condemned “unacceptable” behavior that he said had targeted his prosecutors.
“Unfortunately, over the duration of this trial, talented career prosecutors and their family members were besieged with hate and threats – on social media, by phone and over email,” he said. “Simply put, this is unacceptable, and everyone, no matter your opinion on this case, should condemn it.”
This is actually the first I’ve heard about threats to the prosecutors. That isn’t to say they didn’t happen and whoever made them should be dealt with in accordance with the law. (Something that Bragg and his office seem to have a problem with) Bragg’s politicizing the office, first with this garbage against President Trump and now this has ticked off a lot of people and he is now facing a challenger in the next election.
Maud Maron, a former public defender and parents’ rights advocate who is running to unseat Bragg, condemned her opponent for bringing the case to begin with.
“The NYPD Officers who initially interviewed Daniel Penny and declined to arrest him got it right,” she told Fox News Digital. :The Manhattan jury who heard all the evidence, deliberated and returned a verdict of not guilty got it right. The New Yorkers and their fellow Americans who were rooting for Daniel Penny as a hero and understood he should never have been charged in the first place got it right. The only person who got this wrong was Alvin Bragg. DA Bragg has pursued a reckless ideological agenda since his first day in office. Manhattan deserves a district attorney who will defend all New Yorkers, apply the law fairly and make Daniel Penny’s heroism unnecessary by cleaning up the subways and streets of New York City.”
I don’t know anything about this woman and where she stands politically. However, she can’t be any worse then this Soros DA, and hopefully will be a lot better. As for Daniel Penny, he is a free man. He will need to deal with the money grab by the alleged family of Neely, but hopefully, they will be laughed out of court. This was a case that should never have been brought and is just another indication that New York City and New York State are nothing more then a giant floating turd in the toilet of America. It needs to be flushed ASAP.
