Federal Judge orders state to stop enforcing immigration laws, State ignores her

Good day all. Almost since President Trump was sworn in, the democrats have been using their pet Obama and Biden judges, with a sprinkling of Clinton and Bush judges, to block President Trump from removing the millions of criminals Biden let into the country.


Many of these judges are flat out ignoring Article II of the Constitution, among other things. One even ordered the Administration to basically invade a foreign country to get a deported illegal back. We’re also seeing states refusing to assist ICE and DHS from rounding up the worst of the worst of the illegal aliens.

However, there are also a number of states that are happily assisting ICE in collecting these two legged predators. One of these is Florida. Recently, a Federal idiot Judge issued an order forbidding Florida from enforcing several immigration laws they passed? Florida’s answer to that order? No. Here are the from Fox News:

A federal judge in Florida said an order that blocks local police from enforcing a new state immigration law applied to all local agencies despite the state’s attorney general stating otherwise in a recent memo.

Oh this is going to be fun. At first glance. It looks like we have a state telling on overreaching, power mad Obama judge to go pound sand.

U.S. District Judge Kathleen Williams told attorneys for the state during a hearing in Miami on Tuesday that she planned to issue a preliminary injunction against a statute that makes it a misdemeanor for undocumented migrants to enter Florida by eluding immigration officials.

Williams said she was “surprised and shocked” that Florida Attorney General James Uthmeier told local police in a letter last week that they didn’t need to follow her order. 

“What I am offended by is someone suggesting you don’t have to follow my order, that it’s not legitimate,” Williams said.

Well, you are an Obama judge after all, so of course your orders aren’t generally legitimate.

Earlier this month, Williams issued a temporary restraining order against the statute. Gov. Ron DeSantis signed the legislation into law in February as part of President Donald Trump’s push to crack down on illegal immigration.

Williams extended the order another 11 days after learning authorities had arrested 15 people, including a U.S. citizen born in Georgia.

Obviously the citizen from Georgia was an error, unless that person was also committing a crime that caught the attention of the police. I need more information on that one.

After the extension, Uthmeier sent a memo to state and local law enforcement officers telling them to stop enforcing the law, even though he disagreed with the judge’s order.

That’s pretty much par for the course. But then something interesting happened.

Five days later, however, Uthmeier sent another memo saying that the judge was legally wrong and that he couldn’t prevent local police officers and deputies from enforcing the law. 

Well, that’s an interesting turn of events. Unfortunately, the Fox story only goes so far with the details. However, a quick search has brought up more information from a source closer to home. Here are additional details from the Tampa Bay Times:

The showdown between the federal judge and the state attorney general’s office came nearly one month after immigrant groups and their lawyers filed sued suit against Uthmeier and state prosecutors across Florida, saying that the new state law, which makes it a misdemeanor for adults who came to the U.S. illegally without checking in with border authorities to enter the state, is unconstitutional because only federal authorities have the power to enforce immigration laws. After the lawsuit was filed early this month, Williams issued two temporary restraining orders that banned state authorities from enforcing the new law.

Well, now I can see the problem and why the Florida AG is ignoring this idiot judge. The state is not enforcing immigration laws. When they find someone who is not a citizen or legal resident alien, the hold them and contact ICE who then handle the situation. As the constitution and law states, a State is not required to assist the Federal Government in enforcing federal laws, in this case, immigration laws. However, they may do so if they so choose. Obviously, Florida has chosen and that’s what’s pissing off this Obama judge.

Here’s what triggered the confrontation in Miami federal court: Last Wednesday, Uthmeier told the Florida Department of Law Enforcement and other police agencies that they could continue to enforce the state statute criminalizing illegal immigrants arriving in Florida who hadn’t notified federal authorities of their entry into the U.S. — contrary to Williams’ April 18 restraining order.

So far, I don’t see a problem. Illegal aliens are breaking the law by crossing the border without permission. Since they are in the United States illegally, hence the term “Illegal Aliens,” their continued presence is an ongoing crime. Now as an example, kidnapping is against the law. It’s generally handled by Federal Agents, but in all cases, it’s also against the law at the state level. No one has any issue with this or with local police officers arresting kidnappers.

That day, Williams scolded lawyers for the attorney general’s office after learning that Florida Highway Patrol officers arrested more than a dozen people — including a U.S. citizen — after she had ordered them to stop on April 4 when she issued a 14-day temporary restraining order that “prohibited the enforcement” of the state’s immigration law.

Saying she was “astounded” by the Florida Highway Patrol arrests, Williams extended her ruling for another 11 days, blocking the enforcement of the state immigration law through Tuesday, April 29. In her latest order, she spelled out that the Florida Department of Law Enforcement, Florida Highway Patrol and all other police agencies were bound by her ruling.

This is when the Florida AG sent out his initial memo to follow this moron’s questionable order. However, five days later, apparently after some internal review and discussions that may have happened that we aren’t aware of, the Florida Attorney General changed his mind.

Judge Williams ordered my office to notify you of the evolving scope of her order, and I did so,” Uthmeier wrote in another memo to Florida law enforcement agencies. “But I cannot prevent you from enforcing (the state immigration law) where there remains no judicial order that properly restrains you from doing so.”

Now that was a nice bit of legal wordplay. It looks like AG Uthmeier found a nice loophole and drove a truck through it.

Lawyers for his office argued the judge’s ruling does not apply to “independent” law enforcement agencies, such as the Florida Highway Patrol, the Florida Department of Law Enforcement, county sheriffs’ offices and local police.

They are not parties,” the attorney general’s office asserted, because they are not “in active concert or participation with” his office and state prosecutors in Florida.

That looks like something the Courts like to do when they don’t want to hear a case. They claim that the parties have “No Standing.” It looks like Mr. Uthmeier has used their own weapon against that Obama judge.

Uthmeier’s office argued “defendants have no power to control or direct” the behavior of state and local law enforcement.

While the Attorney General communicated the (judge’s) view that law enforcement should not make arrests under (the state immigration law), he did so solely to comply with this Court’s order—which Defendants maintain is unlawful,” the office added.

This is going to set up a nice fight and one that has been a long time coming. For to long Federal judges, mostly, but not exclusively, Progressive Liberal Democrat judges, have been basically legislating from the bench. The Democrats have, for a long time, used the courts as weapons against moderate to conservative people, organizations, local and state governments.

Since the reelection of President Trump and his instructions to round up and remove all illegal aliens from the United States, these corrupt, power mad Obama and Biden judges have actively interfered with this plan. Some have actually issued orders to the Trump Administration to turn planes around or return deported criminals to the United States.

The Democrats love to say that this is a “Constitutional Crises” and they are correct. What they are wrong about is which side is causing it. It’s not the Trump Administration and it’s not the Republicans. It’s the Democrats. It’s their actions through their judges who are pushing a constitutional crises. These Obama and Biden judges are actively ignoring the separation of powers, specifically Article II of the Constitution. I think the actions by the Florida Attorney General may be might be the first “Shot across the bow” that these judges have gone to far.
