Good day all. You may recall the big stink the Democrats made over the deportation of one Kilmar Abrego Garcia, aka Maryland Man. Garcia had been illegally in the United States for years and, as I recall, already had a deportation order against him. The Democrats decided to make Garcia the “Hill to die on” and as usual, they succeeded in politically dying.

In the end, the Democrats got their wish and Garcia was returned to the United States. However, it wasn’t in the way they wanted. Garcia was slammed with numerous federal charges including Human trafficking and locked up awaiting trial. This is where yet another corrupt idiot pretending to be a judge stepped in. She ordered Garcia to be released pending trial. Here are the details from Fox News:
A federal judge in Tennessee has denied the government’s request to hold Kilmar Abrego Garcia in continued detention while his criminal case proceeds.
U.S. Magistrate Judge Barbara Holmes denied the government’s request to hold Abrego Garcia, though he will remain in custody until at least a hearing that has been scheduled to determine conditions of release, which the government can, and will likely, appeal.
From what I understand, the DoJ has already stated they will not release Garcia under any circumstances. Now a few details on what a magistrate judge is and what authority they have. First, they are not federal judges. They have not been confirmed by the Senate. They are basically hired by an actual judge to handle all the drudge work that a Federal Judge may not have time, (Or desire), to do.
Now as to Barbara Holmes, I don’t have a lot of information. It looks like she was appointed/hired in 2015. It appears she attended Vanderbuilt University and her legal career specialized in commercial bankruptcy proceedings. Otherwise, I haven’t been able to find much about her in the 5 minutes I’ve spent looking for her.
Abrego Garcia appeared at his arraignment and hearing on the government’s detention on June 13. According to the judge’s decision on Sunday, “the sole circumstance about which the government and Abrego [Garcia] may agree in this case is the likelihood that Abrego [Garcia] will remain in custody regardless of the outcome of the issues raised in the government’s motion for detention.”
Wait for it. The mind numbing stupidity of this magistrate is about to be displayed.
Holmes said in her decision that the court found no detention hearing is authorized under the Bail Reform Act because the government failed to prove the case involved a minor and that Abrego Garcia is considered a flight risk.
Not a flight risk? Let’s disassemble this, shall we? First, Garcia is an illegal alien. He has already been deported and the only reason he’s back is to face the human trafficking and other charges. Second, he was already under a deportation order, (Yes, the Democrats would like you to ignore that little fact). Third, he’s looking at decades in a federal prison. If I were him, the second I was out the door, I would be beating feet for the border. Hell yes this clown is a flight risk.
Still, even if Abrego Garcia is to be released, ICE will arrest and detain him immediately via civil immigration process, separately from the criminal case.
Unless this moron of a magistrate decides to “Escort” Garcia out a side door or something.
The criminal case against Abrego Garcia, an alleged MS-13 member, comes after a high-profile, protracted legal fight over his deportation and the Trump administration’s efforts to delay his return to the U.S., even after the Supreme Court ordered the administration to “facilitate” his release earlier this year.
That “Facilitation” amounted to a call to the President of El Salvadore from the President of the United States. I think it went something like this:
“Hi Nayib, It’s Donald, How are things?”
“Hola Donald, Things are great. How are things with you?”
“Not so good. I’ve got a problem with a bunch of Judges who think they are in charge.”
“Si, I have seen that on the News. So what can I do for you Compadre?”
“Those judges want me to have you return that clown Kilmar Garcia. So, can you?”
“Well Donald, he is not a good man and we have him locked up. I really can’t see letting him go. You do understand of course.”
“Oh I most certainly do, but I had to ask. So, how’s the wife and kids?”
“They are good, thank you for asking.”
“Well I have to go. I’ll have my people talk to your people about a good trade deal. Keep on working to Make El Salvadore Great Again!”
“Gracias Donald. Good bye.”
“Bye!”
In short, I think the Trump administration simply went through the motions and made no real attempt to get Garcia back. Then came the videos of the police stop and things changed.
The indictment alleges that Abrego Garica was part of a smuggling ring that helped bring immigrants to the U.S. illegally and smuggle them across the country. According to the indictment, Abrego Garcia and his co-conspirators made at least 100 trips between Texas and Maryland between 2016 and 2025, when he was deported.
Special Agent Peter T. Joseph told prosecutors on June 13 that he was first assigned to Abrego Garcia’s case in April 2025, when he was still detained in El Salvador. Since then, Joseph said, he has reviewed footage from Abrego Garcia’s 2022 traffic stop, which has emerged as the basis of the human smuggling charges.
And that was the catalyst to actually get Garcia back into the United States. In El Salvadore, he probably would have been released in the next year. Now he’s looking at a good 20+ years in a federal prison. This is one reason that he must be considered a flight risk. He has every reason to run.
As for this magistrate? This is just another nail in the coffin of the Judicial Branch. Magistrates have been rubber stamping Federal warrants for years that have ended up with innocent people terrorized and others wounded or killed when Federal agents stormed someone’s home in the middle of the night with no notice.
I don’t know what we can do legally, but I think it may be time to start holding both Magistrates and Judges accountable when their very questionable decisions blow up in everyone’s faces. Garcia is a classic case in point. If Barbara Holmes succeeds in getting Garcia out and he does run and get away, She needs to face the consequences of her decisions. What those may be? Perhaps not being arrested and tried, but being fired, disbarred and financially ruined might work.
