Virginia Prosecutor tells Govno Spanberger to pound sand

Good day all. Virginia is now showing the rest of the country just how the Democrats will rule if they regain power at the federal level. The first thing the Democrats did was basically repeal the 2nd Amendment.


They are also pushing massive, and unneeded, tax increases and moving to protect criminals and illegal aliens. Because of all this, Spanberger’s poll numbers are collapsing. (People do not like being lied to) One of the main issues angering Virginians are the moves to strip people of their 2ns Amendment rights. Now one of the Virginia commonwealth attorneys is saying he wont’ enforce the new gun ban laws. Here are the details from Fox News:

Ryan Mehaffey, a Marine veteran and Virginia prosecutor, is taking a hard-line stance against what he believes is an “unconstitutional” new gun ban signed by Democratic Gov. Abigail Spanberger.

Spanberger, who has been slipping in the polls amid criticisms of her progressive policy agenda, signed a new bill last week banning the future sale and manufacture of “assault weapons,” including many semiautomatic rifles, pistols and shotguns. The law also bans the future sale of magazines with a capacity of more than 15 rounds.

Basically, semiautomatic firearms have been all but outlawed in Virginia.

The move caused immediate backlash from many Virginians and raised new Second Amendment violation concerns.

While I am not familiar with the Virginia state constitution, I’ve heard that these Democrat diktats may also violate that as well as the United States constitution. (Not that the Democrats care about the constitution, state or federal) I’ll let those who are familiar with the Virginia constitution comment below.

Rather than protest, however, Mehaffey, who serves as the commonwealth attorney for Spotsylvania County, is drawing a line in the sand and flatly refusing to enforce the ban.

I’m going to assume that a County Attorney is what most people consider to be a District Attorney.

With the bill set to take effect this July ahead of America’s 250th anniversary of independence, Mehaffey sent a letter to Spotsylvania Sheriff Roger Harris, instructing him that the ban is “unconstitutional and cannot be lawfully enforced.”

A statement released by Spanberger’s office called the assault weapons ban a “critical step toward protecting families, communities, and the law enforcement officers who serve them.”

No it isn’t. The Democrats want to ban all private ownership of firearms so that their slaves have no means to object to the commands of their rulers. One group that won’t pay any attention these laws are actual criminals. In fact, they are going to ramp up their attacks on regular people. (Of course, all the Democrats will have their own security so they won’t be worried)

In response, Mehaffey said in an interview with Fox News Digital that the law “is striking at the core of the militia system that existed in Virginia.” According to Mehaffey, the Second Amendment is not just an assurance of personal freedoms, but also a safeguard for a community’s ability to defend itself through a “well-regulated militia.”

“Our founders were careful to make sure when they drafted our founding document, that the ultimate right of the people was preserved to defend themselves and to defend their community,” he explained. “So, the linchpin of the constitutional analysis is going to be does this instrument have some reasonable relationship to the preservation or efficiency of a regulated militia.”

Technically, the militia is every man between the ages of 16 and 45. Of course, that was set in the 18th century and things have changed. For starters, you now have women also available to act as part of the militia and due to the general state of American health, you could push the age up to the mid 50’s or early 60’s today.

Mehaffey argues that in Virginia, historical tradition and case law precedent not only allow citizens to own firearms but even require them to arm themselves with the weapons of a basic infantryman for common defense. In the Founding Fathers’ time, Mehaffey said the standard issue was a musket and 20 rounds. Today, the basic infantry weapon in the U.S. military is the M4A1 carbine equipped with a 30-round magazine.  

“The second amendment may not mean that you are allowed to have a nuclear weapon,” he laughed. “But what it does allow you to have is a basic infantry weapon.”

Technically, the 2nd Amendment does allow the private ownership of nuclear weapons. However, there are a number of issues with actually having a few. Right off the bat is cost to purchase. You’re talking probably a couple of million dollars. Then there is storage. You have to make sure that the weapon is stored in such a way that it doesn’t risk people or property. (Radioactive materials)

Finally there is the problem of actually firing one. It’s not like you can just set it off in your back yard. They do tend to make a bit of a mess when you set one off. (It does make a pretty mushroom cloud) You will cause damage to other people’s property and that is not a good thing.

“That sort of weapon is the core of what’s protected by the Second Amendment. Not necessarily a nuclear warhead, but a rifle that you can take out and form either a fire team or a company to defend yourself and to defend your community.”

Back when the 2nd Amendment was ratified, people could own muskets and rifles, pistols, swords, cannon and actual warships. These days, it’s rifles, (Full automatic), belt fed machine guns, grenade launchers, mortars, artillery and armored vehicles. If you want to spend the money for a fully equipped M1 Abrams Main Battle Tank, you should.

Mehaffey is not alone in his stance. In addition to what he characterized as the “overwhelmingly positive” response from his community, Smyth County Commonwealth’s Attorney Phillip Blevins, an Air Force veteran, has also refused to enforce the bill, arguing it is unconstitutional. The ban is also facing lawsuits from gun-rights groups, including the NRA, Firearms Policy Coalition and Second Amendment Foundation.

Back in 1946, there was an incident in a town in Tennessee called Athens. Again, it was the Democrats who were acting like the slavers and tyrants they are. They had been rigging elections and jailing innocent people for some time. Then World War Two happened. When the war ended, all these veterans came home. They took a look around and basically asked themselves, “What the Hell? Didn’t we just put a stop to this in Europe and Japan?”

They decided to run some candidates to clean up the town and the Democrat elites sent in their thugs. On election day, they stole the ballot boxes and wouldn’t let people count them. That was it as far as the Veterans were concerned and they decided to do something about it. That something was going to the local National Guard armory and cleaning it out. Then they basically launched an attack on the corrupt sheriff and government.

This became known as the Battle of Athens and was the last successful rebellion in the United States. The Veterans blasted open the doors to the building and forced the Sheriff, his deputies and a few others to surrender the ballot boxes. When they got into the building, they found stacks of prefilled ballots that they were going to stuff the ballot boxes with.

If these people didn’t have access to guns, both privately owned and military issue, the Democrats would have continued their corrupt rule. Instead, they were run out of town and a new government took office and cleaned up the mess. This is the reason for the 2nd Amendment.

It isn’t just to protect yourself from criminals, although that is the main reason many people get guns. It isn’t just for hunting, although millions of people go out every year and blast Bambi to kingdom come and make venison stew out of him. It isn’t just to defend the borders of the United States, although that too is a major reason. It’s to provide the people of the United States with the tools they need to protect themselves from a tyrannical government. The Democrats have torn off the veneer and are now telling people exactly what they plan to do the anyone who stands in their way.

While Mr. Mehaffey and Phillip Blevins are doing their part to protect the rights of the people of Virginia, I’m slowing coming to the conclusion that a repeat of Athens Tennessee on a state level may be the only way to stop the Democrats from their goal of a single party totalitarian state. I also expect the idiot who can’t spell Virginia in a Supreme Court appeal, Jay Jones, to flat out threaten these to Commonwealth Attorneys with arrest. That or he will threaten to have them summarily shot. It won’t be the first time he’s made threats like this. We shall see what happens next.
