California or the egg?

California has once again decided to impose it’s rule on the normal people of America. They have announced that all farms raising chickens throughout America will have to comply with their stupid regulations.

This will cause egg prices to increase, more than likely, significantly. Here are the details of what the People’s Democratic Republic of California has done now, from Fox News:

The new year is expected to bring rising chicken egg prices across the U.S. as California starts requiring farmers to house hens in cages with enough space to move around and stretch their wings.

Frankly, who cares what the Moonbats in California do to their food producers. It shouldn’t have any affect on the rest of us, should it?

The new standard backed by animal rights advocates has drawn ire nationwide because farmers in Iowa, Ohio and other states who sell eggs in California have to abide by the same requirements. To comply, farmers have to put fewer hens into each cage or invest in revamped henhouses, passing along the expense to consumers shopping at grocery stores. California is the nation’s largest consumer of eggs and imports about one-third of its supply.

This looks like a classic violation of the Commerce Clause to me. Here is the text of the Article 1, Section 8, Clause 3 of the Constitution of the United States.

[The Congress shall have Power] To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes.

constitution, Void where prohibited by Obama

Now this section is one of the most abused parts of the Constitution, but the original intent was to keep states from blocking commerce between each other. Usually by imposing taxes and tariffs on products from other states. Forcing business in other states to comply with regulations imposed on businesses internal to the originating state smacks of a form of protectionism. Now just how expensive is this wet dream for the Animal’s First, People last groups?

Jim Dean, president and CEO of Centrum Valley Farms in Iowa and Ohio, said one of his buildings that holds 1.5 million hens is now about half full to meet California’s standards, and another building may have to be completely overhauled. Farmers like him in cold climates will have to install heaters to replace warmth formerly generated by the chickens living close together. Dean said that’s something people in sunny California didn’t consider.

“You’re talking about millions upon millions of dollars,” he said. “It’s not anything that’s cheap or that can be modified easily, not in the Midwest.”

double-facepalm

Do you really think the Moonbats of California have any clues as to how the world or business actually works? Of course not! All you need to do is look at their stupid referendums they keep passing to see just how dumb they are.

California voters in 2008 approved the law backed by animal rights advocates to get egg-laying hens out of cramped cages and put them by Jan. 1, 2015, in larger enclosures that give them room to stretch, turn around and flap their wings.

Barking Moonbat

Why did they vote in favor of this asinine law? Because chickens have feelings and are as smart as people, that’s why. Well, compared to the moonbats of California, those birds probably are smarter. They certainly are smarter then the California Legislature.

State legislators followed with the companion piece in 2010 requiring the out-of-state compliance.

And that is where I see a problem. How the heck is California allowed to force their asinine rules on the other 49 states? Needless to say this is going into the courts, however, we have a judiciary currently made up of mouth breathing morons who have no idea what the Constitution says, let alone what it actually means. Because of this, they have sided with the Communists in California over the rest of the country time and time again.

California has prevailed in lawsuits, including six from major egg-producing states that argued the state is dictating market prices in other states in violation of the Commerce Clause of the Constitution. Appeals are pending.

The-Good-Idea-Fairy-3

Frankly, it’s time those clods on the Supreme Court actually look at what they have wrought and start reigning in the states that want to impose their laws on other states. The Commerce Clause does allow for them to handle this, since regulating trade between the states is a federal matter. On the other hand, we have the 10th Amendment, which the courts have been ignoring for decades that limits the powers of the Federal government.

don't confuse

If the Supreme Court actually does it’s job, they can bring California’s idiocy to a screeching halt, but also let them continue destroying their own economy. At the current rate the Moonbats have been devastating what was once the 8th largest economy in the world, I’d expect their complete collapse to start in the next 3-10 years. Then maybe we can finally kick those idiots out of the Union.

  2. Thanks to last year’s drought and the price of gas last summer, chicken feed is expensive. Cut back production to that sufficient to serve the other 49 states, and probably have a better bottom line.

IF California wants eggs, that’s THEIR problem. . .
