Appeals court refuses to lift hold on Obama

Good day all. Among the may things Obama has been doing that ignores the law, one is granting what amounts to a general amnesty for illegal aliens. His excuse has been that Congress hasn’t just rolled over and given him what he wants.

The amnesty he created with an executive order was immediately challenged in court and a stay on the order was granted. The Obama regime appealed and last week the stay was upheld pending a full trial. Here are some of the details of Der Fubar’s latest crushing defeat in court from Fox News:

A federal appeals court refused Tuesday to allow the implementation, for now, of President Obama’s executive action that could shield from deportation as many as 5 million illegal immigrants.

Awww, what a shame. All those criminals aren’t actually getting their amnesty after all.

The U.S. Justice Department had asked the 5th U.S. Circuit Court of Appeals to reverse U.S. District Judge Andrew Hanen’s earlier decision temporarily halting the administration’s plan. Hanen issued the temporary hold in February, after 26 states filed a lawsuit alleging Obama’s action was unconstitutional.

What Obama did was a pretty blatant offense. He usurped the power of Congress to write the immigration laws. Although the story doesn’t mention it, the Department of InJustice lawyers were raked over the coals by the judge in this case, Andrew Hanen. According to the Washington Examiner:

U.S. District Judge Andrew Hanen, who had put a temporary hold on the action, not only refused to lift the hold — he also came very near to accusing administration lawyers of flat-out lying to him.

The administration’s assertions in the immigration case have been “misleading,” “troublesome,” and “belied by the facts,” Hanen wrote. “Any number of federal judges, given this misconduct, would consider striking the government’s pleadings.” Doing so would effectively end the case altogether, and Hanen wrote that he had decided not to take that action because the issues at stake are of great national importance.

In court arguments, Hanen specifically asked the administration lawyers whether the Department of Homeland Security would begin implementing DACA before Feb. 18. They said no. Hanen therefore issued an injunction temporarily stopping DACA on Feb. 16, two days before it was scheduled to go into effect. At that point, Hanen thought he had stopped things while he considered the larger issues of the lawsuit, which focus on the constitutionality of Obama’s action.

Silly Judge, this is the Obama administration. Probably the most corrupt administration in the last 100 years, which is saying something. What came next almost got a few DOJ lawyers tossed into a cell.

The judge was stunned when, on March 3, administration lawyers filed a “Defendant’s Advisory” admitting that the administration had begun implementing the expanded DACA program back in November, and had in fact granted new protections and work permits to “approximately 100,000 people” by the time administration lawyers told the judge nothing was happening.

This set up the recent hearing at the appellate level in which 2 of the three judges ruled to keep the stay in place. The third judge ruled that the stay should be lifted with some rather tortured logic. I looked up this judge. He is Stephen A. Higginson and would you care to guess who appointed him to the bench? I’ll give you three guesses but you will only need one.

As you would expect, the Obama regime isn’t taking this well. Getting back to Fox News:

White House Spokesperson Brandi Hoffine said after the ruling, “today, two judges of the Fifth Circuit chose to misinterpret the facts and the law in denying the government’s request for a stay.”

The White House has repeated its position that the president has exclusive authority to enforce immigration laws and can adjust policies to fix a “broken immigration system.” Fourteen states have sided with Obama in the case, and say the benefits of immigration outweigh the costs.

This has been the whole problem with the Obama regime. He has nothing but contempt for the Country he is presiding over. He hates the constitution and considers anyone who opposes him to be evil and out to get him. He has also surrounded himself with people who worship the ground he putts on and never disagree with him.

As of this posting, Obama has lost almost every major court case where he has usurped powers he isn’t entitled to under the Constitution. This one looks to be yet another one where King Putt gets his head handed to him. The only question is, will Obama ignore the courts? There is no doubt he will continue to try and work around the decisions, using the Clintonion phrase “It depends on what the meaning of “Is” is.”

I’ve said it before and I will say it again. Obama should have been removed from office years ago. Now, I’m thinking that not only should he be removed, (Impeachment), he should also be criminally investigated for what he has done while in office. I’m not holding my breath that this will happen. That would mean we had a congress that actually cared about the Nation and not about their own privileges.
