Good day all. If you work in the Technical fields, generally referred to as the STEM fields, (Science Technology, Engineering and Math), you are very familiar with corporations firing American employees and hiring cheap foreign workers using the H1B visa system.

There are any number of stories of this happening, such as Disney getting rid of most of their American staff, and forcing them to train their replacements from India. The H1B visa system was never meant to be used in such a manner, however, under the previous administration, with the connivance of the Beltway Uniparty, nothing was done.
Now, as the old saying goes, “There’s a new sheriff in town.” The Department of Justice has now started taking action against American companies who abused the various foreign worker visa programs and refused to hire Americans. Here are the details from Fox News:
The Department of Justice announced Thursday it has filed a lawsuit against a Colorado corporation for allegedly discriminating against U.S. workers.
The complaint alleges that in 2016, Crop Production discriminated against at least three United States citizens by refusing to employ them as seasonal technicians in El Campo, Texas, because Crop Production preferred to hire temporary foreign workers under the H-2A visa program.
“In the spirit of President Trump’s Executive Order on Buy American and Hire American, the Department of Justice will not tolerate employers who discriminate against U.S. workers because of a desire to hire temporary foreign visa holders,” Attorney General Jeff Sessions said in a statement. “… Where there is a job available, U.S. workers should have a chance at it before we bring in workers from abroad.”
This particular case revolves around agricultural workers, however, I don’t think it’s going to stop there. Once the DoJ gets a few scalps under it’s belt, legitimate scalps and not the fakes ones Eric Holder and Loretta Lynch liked to take, I think we’re going to see a few fortune 500 companies getting a “haircut.”
The various visa programs have become totally perverted from their original designs. Since I’m familiar with the H1B program, being in the Technology Field, I can and will comment on that. The H1B program was meant to find people with very specific training and skills, skills that might not be available in the United States.
The visa holders were meant to come in for a specific project and then return to their home countries. They were to be paid at the same rate Americans were paid at, the idea being they wouldn’t be hired to replace Americans as cheap labor. One of the problems was the “Minimum Wage” listed was never updated, so now it is generally cheaper to hire foreign programmers, database administrators and systems people.
Now, major corporations have stopped being subtle with their discrimination and are actively terminating higher paid American workers with what are supposed to be temporary foreign workers with specific skill sets. These H1B visa holders generally don’t know their ass from a hole in the ground and require a lot of hand holding.
This is not a hard and fast rule of course. I’ve worked with a few H1B holders, and had some that were very good, and a few that we couldn’t get rid of fast enough, they were so incompetent. While I would have preferred to hire Americans, (Not that I was a hiring manager), the decisions to bring in H1B’s was made far up the food chain. All we saw were resumes that were preselected from a pool of foreign based technical people. No Americans were even sent to us to look at.
With the Department of Justice no beginning to crack down, and with the full support of President Trump, hopefully, more jobs for Americans will open up as the H1B’s and others are sent packing. I would also like to see a few CEO’s and senior Human Resource managers who have been screwing over Americans discover the joys of manual labor. Such as making little rocks out of big ones and making new license plates. (I’m looking at you Iger)

One final note to clear up any misconceptions, when I refer to Americans, I also include Lawful Resident Aliens, those who have moved here and have green cards. Green Card holders are treated just like American Citizens. They can move from one job to the next with no restrictions. H1B visa holders are locked to the company they are working for. If they quit or are terminated, they are on the next plane out of the United States.
