Good day all. Well, one more, another piece of President “Pen and Phone” Obama’s legacy has just been tossed on the ash heap of history. This time it was the payouts to insurance companies from the treasury.
These payments were never authorized by congress, they were simply done through executive order. The payments were meant to cover the losses generated to insurance companies due to the wrecking of the health insurance system by Obama and the Democrats. Since the payments, on their face, violated the constitution, President Trump just issued another executive order undoing Obama’s executive order. Here are some of the details from Fox News:
President Trump plans to halt payments to insurers under the Affordable Care Act “immediately,” in a major blow to ObamaCare that is likely to draw a legal challenge. The president, though, used the overnight decision to up pressure on Democrats to negotiate a “fix” to the “imploding” health care law.
“The Democrats ObamaCare is imploding. Massive subsidy payments to their pet insurance companies has stopped. Dems should call me to fix!” he said in a pre-dawn tweet on Friday.
Yeah, that’s not going to happen. The Democrats intend to use this to scream, rant and rave that President Trump is destroying Obamacare. This, along with his last EO regarding expanding options has driven the likes of San Fran Nan Pelosi to new heights of apoplexy.
He added, “ObamaCare is a broken mess. Piece by piece we will now begin the process of giving America the great HealthCare it deserves!”
As you would expect, there will be court challenges. However, the Constitution is rather clear about this. Congress has to appropriate the funds for the subsidies, and they never did. Obama just looted the treasury without authorization. The Republicans, as usual, failed to stop him and the Democrats didn’t care to.
The Justice Department took swift action, notifying a federal appeals court in Washington, D.C., in connection with a related lawsuit that an upcoming Oct. 18 payment “will not occur.”
I’ll be honest, I’m not sure why the courts were told. I gather there is some court case regarding the payments, probably regarding their constitutionality that was underway. If the payments are stopped, then I guess the case becomes moot.
Trump’s decision was expected to rattle already-unsteady insurance marketplaces. The president has previously threatened to end the payments, which help reduce health insurance copays and deductibles for people with modest incomes, but remain under a legal cloud.
As I recall, and previously mentioned above, Congress said the payments could be made, but never set aside the money to make them. Since Obama didn’t give a damn about the Constitution and actually making requests to Congress, he just ordered the Treasury secretaty at the time to write the checks, Since that person was just as corrupt as Obama and the other Democrats, he signed them and sent them off to the Insurance companies.
The president’s action will likely to trigger a lawsuit from state attorneys general, who contend the subsidies to insurers are fully authorized by federal law, and the president’s position is reckless. Xavier Becerra, California’s attorney general, called the decision “sabotage,” and promised a lawsuit.
Becerra was in congress when this garbage was passed. Why didn’t he make sure it was funded? Oh, that’s right. He doesn’t give a damn about the Constitution of the United States, being a Democrat and all. I also have little doubt that he will find some corrupt Obama judge to tell Trump to issue the payments. If that happens, President Trump should not only refuse, but arrest the judge. At the very least, he should formally request the impeachment of this and other judges who openly flout the Constitution and the separation of powers. As for the Democrats in Congress?
After the president’s intentions were disclosed, leading Democrats in Congress were quick to criticize the plan.
In a statement, Senate Minority Leader Chuck Schumer, D-N.Y., and House Minority Leader Nancy Pelosi, D-Calif., predicted that Trump’s expected action would increase Americans’ health premiums by 20 percent or more.
“If these reports are true,” the Democrats said in the joint statement, referring to the president’s plans, “the president is walking away from the good-faith, bipartisan Alexander-Murray negotiations and risking the health care of millions of Americans.”
The Democrats were referring to bipartisan talks being led by Sen. Lamar Alexander, R-Tenn., and Sen. Patty Murray, D-Wash., to seek a bipartisan agreement for funding ObamaCare subsidies and stabilizing health insurance markets.
This is something Pelosi should have done when she shoved Obamacare down everyone’s throats. The facts are, Obamacare was a disaster from day one. The people didn’t want it and it’s been collapsing ever since. The list of Executive Orders put through by King Putt to make this work was long, and most of them very illegal. But then, Obama thought he was king, not president and that he made the laws, not Congress.
When Obamacare kicked in, I was paying about $400/month. Last year, it jumped to over $800/month. I was about to give up what was a damn good insurance plan when I was hired for a job. I canceled my old insurance and went on the company plan, for significantly less money. (It wasn’t as good though) That job didn’t work out and I left the company. I also lost my insurance, and being unemployed, and living off my savings, couldn’t afford new insurance or COBRA.
Do you know what the effect of Democrats destruction of the Insurance industry has been? I just came form a drug store. I had to refill a prescription. I won’t go into what for, but it’s something I’ve been questioning my doctor over for years. I had been paying around $15-$20 for a three month supply. I was just hit with a charge of $76 for the same drug. I simply can’t afford it and refused it, turned around and walked out the door. This is what that scum Obama and the Democrats have done to me. Forget replacing Obamacare, just flat out end it and end it now.
