Liberal Heartache, Dead liberal judges votes don’t count

Good day all. The 9th Circuit court of Appeals has been reliably anti-constitutional for decades. They became the most overturned appellate court in the United States, so bad were many of their decisions. One of the leading moonbats on the bench, Judge Stephen Reinhardt, finally kicked the bucket last year after decades of legislating from the bench. Apparently the 9th Circus thought he could continue issuing ruling from the grave.

It took the United States Supreme Court…once again, to slap down yet another silly notion by the 9th Circus, and tell them that dead judges are not the same as dead Chicago voters. Here are the details from Fox News:

The Supreme Court on Monday ruled that the decisive vote in a California pay dispute case before a lower court doesn’t count — because the vote came from a judge who died before the ruling was issued.

The case from the San Francisco-based 9th Circuit U.S. Court of Appeals involved a dispute over pay filed by a Fresno County government employee. Judge Stephen Reinhardt, who was seen as a progressive icon on the bench, heard the dispute and participated in a preliminary vote. The appeals court then issued an opinion in his name nine days after he passed away in March 2018.

But the high court, vacating the decision of a federal appeals court, said Monday that “federal judges are appointed for life, not for eternity.”

I wonder, has anyone broken the news to the Democrat Party? After all, most of their voters are deceased.

The upshot is that Judge Reinhardt’s vote made a difference,” said the Supreme Court in its unsigned ruling. “Was that lawful?”

In the eyes of moonbats everywhere, YES! In the eyes of everyone else? “What, are you kidding? He’s dead, of course his vote doesn’t count!” Well, it seems the Supreme Court agrees that once a judge is dead, he’s gone.

The justices said it was not. “Because Judge Reinhardt was no longer a judge at the time when the en banc decision in the case was filed, the 9th Circuit erred in counting him as a member of the majority.”

I wonder if the 9th circus considered that the Supreme Court actually practices what it preaches, so to speak.

The votes of Justice Antonin Scalia issued after his sudden death three years ago did not count, even though he had participated in a number of argued cases earlier in the court’s term. No decision is official until it is formally released by the court, and every member of the court must be on the bench at the time.

Reinhardt was one of the longest-serving federal judges when he died at age 87, and one of the most liberal on the 9th Circuit. He was appointed to the federal bench in 1980 by President Carter.

And here we have yet another complete and utter disaster from the 2nd worst President in United States history. (Obama won the championship)

The case was sent back to the 9th Circuit for reconsideration.

And since this is the 9th circus, they will reconsider, and decide that yes, Dead Liberal Judges DO get a vote and DO serve eternally. Conservative and Constructionist jurists? Their votes don’t count even if they’re alive.

When he died, Eric Garcetti, mayor of Los Angeles, called Reinhardt “one of the greatest jurists of our time. A searingly brilliant Angeleno and true progressive icon.”

No, Reinhardt was the prototype for the black robed judicial tyrant. Rarely did his ruling have any basis in the Constitution.

He was considered a liberal stalwart on the bench. He wrote in one opinion that a Trump administration order to deport a man who entered the country illegally nearly three decades ago and became a respected businessman in Hawaii was “inhumane” and “contrary to the values of the country and its legal system.”

Note that he didn’t use anything like the Law or the Constitution in that decision, only “Feelz”.

Reinhardt joined another judge in ruling that the words “under God” in the Pledge of Allegiance were unconstitutional, a decision that was later overturned.

Reinhardt was a flat out traitor. Granted, not under the definition in the Constitution, a document he cared little for. No, he could be counted on to issue rulings that would get honest people killed and do damage to the nation. He was the primary reason the 9th Circuit became known as the “9th Circus.” Now that he is off the bench and rotting in the ground, President Trump gets to appoint his replacement. That replacement is NOT going to be another Stephen Reinhardt, and that has the Progressives heads detonating all over Washington. This is also why the survivors tried to say his vote counted, even though he had assumed room temperature. Once again, the Supreme Court had to slap the 9th Circus down. Sadly, they won’t change until all the Progressives are dead and gone.
