USSC hands President Trump yet another win

Good day all. Once again, the United States Supreme Court, with 2 obvious exceptions, has read the Constitution and the laws regarding Immigration and sided with President Trump. And once again, the 9th Circus Court of Appeals has been slapped down.

In this case, it was the 9th Circus’s ruling regarding illegal aliens who claim asylum. President Trump had put in place a rule that, as usual, followed the law. In this case, it was illegal aliens who came through Mexico and claimed asylum here rather than in Mexico. Here are the details from Fox News:

In a major win for the Trump administration, the Supreme Court issued an order late Wednesday ending all injunctions that had blocked the White House’s ban on asylum for anyone trying to enter the U.S. by traveling through a third country, such as Mexico, without seeking protection there.

Basically, if someone is running and actually needs asylum, they are supposed to apply at the first country they arrived at. What has been happening for the last few years, (Actually a lot longer), is that illegals from other countries have been transiting through Mexico, jumping the border into the United States, and when caught, claiming political asylum. They would be given a hearing date and then released. Usually, they were never seen again unless they were picked up by ICE.

President Trump ordered that anyone who came in from Mexico or Canada who had not applied for asylum there, be deported. This set off the open borders scum who were the ones to come up with the idea to use our asylum laws against Americans. They challenged President Trump’s rule and as is usually the case, an Obama judge assumed authority he didn’t have and stopped the policy.

The 9th Circuit Court of Appeals – long a liberal bastion that has been aggressively reshaped into a more moderate court by the Trump administration – handed the White House a partial victory in the case on Monday by ending the nationwide injunction against the asylum policy. However, the 9th Circuit kept the injunction alive within the territorial boundaries of the circuit, which encompasses California, Arizona, Alaska, Hawaii, Montana, Nevada, Idaho, Guam, Oregon and Washington.

The partial victory was more of a housekeeping thing more than anything else. Since President Trump took office, Obama judges have been issuing rulings and ordering them enforced throughout the United States. They were usurping authority they didn’t have. The 9th put a stop to that, stating that any rulings were only valid in the districts they were issued. Only the United States Supreme Court may issue a ruling that affects the entire country.

The Supreme Court’s order was not a final ruling on the policy’s merits but does allow the policy to take effect nationwide, including in the 9th Circuit, while the case makes its way through the lower courts.

I am no expert on this case law, however, I believe that bypassing the first country you arrive in and jumping the border is against United States laws and international agreements, however I will bow to those with far more knowledge in that area.

President Trump tweeted that the ruling was a “BIG United States Supreme Court WIN for the Border on Asylum!” The administration had argued in a brief to the Supreme Court that unless the injunctions were totally lifted everywhere, it “would severely disrupt the orderly administration of an already overburdened asylum system.”

In a not unexpected development, this was not a unanimous decision. There were two dissenting justices. You won’t be surprosed who they were either.

Only Justices Sonia Sotomayor and Ruth Bader Ginsburg dissented.

“Once again the Executive Branch has issued a rule that seeks to upend longstanding practices regarding refugees who seek shelter from persecution,” Sotomayor and Ginsburg wrote.

And Once again, Sotomayor has once again shown that she was put in place for the sole purposes of prtecting the Obama legacy and the Deep State. Ruth Bader-Ginsberg has a long history of contempt for the Constitution. As for the phrase “Long standing practices”, who cares? What is the actual law in this matter? Obviously, these two flat out ignored it, as they usually do.

They added that they were disappointed the majority failed to exercise “restraint,” and instead intervened in the lower-court matter before it was fully resolved.

These two, along with all the Obama judges, had better count their blessings that President Trump believes in the Rule of law, even if they don’t. If he didn’t, President Trump would simply ignore the courts all together, and probably have a few judges criminally charged.

The DOJ also said the ruling would “bring order to the crisis at the southern border, close loopholes in our immigration system, and discourage frivolous claims.”

Easily 90% of the asylum claims, if not more, are frivolous if not flat out fraudulent. Under the Obama regime, people who really were deserving of asylum were routinely denied it, and many of these people were killed. Oh, they also happened to be Christians being killed for their religious beliefs by Muslims. Of course, the Democrats have a long history of not protecting those in danger due to their religious beliefs. Of course, the Democrats never see it that way.

In a joint statement, House Judiciary Committee Chairman Jerrold Nadler, D-N.Y., and Subcommittee on Immigration and Citizenship Chair Zoe Lofgren, D-Calif., said they were “gravely disappointed.”

Lives will be lost,” Nadler and Lofgren said. “This rule will result in those fleeing fear and persecution to be turned away at our doorstep and will only exacerbate the humanitarian crisis in the [Central American] region. The United States can and must do better.”

No, we mustn’t. Coming from a country that is run by kleptocrats that have run the conomy into the ditch doesn’t warrant asylum. Yes, if you come here through the proper channels, applying for an immigration visa and getting it, they are more then welcome to come in. Those who are under threat of death, that should definitely be looked into. Just because you can’t buy a big screen TV? Tough! Back to the turd world hellhole you came from. Maybe you should try fixing your mess there instead of importing it here.

The legal challenge to the new policy has a brief but somewhat convoluted history. Obama-appointed U.S. District Judge Jon Tigar in San Francisco blocked the new policy from taking effect in late July. A three-judge panel of the 9th U.S. Circuit Court of Appeals narrowed Tigar’s order so that it effectively applied only in Arizona and California, states that are within the 9th Circuit.

I think even the 9th Circus is catching on to the antics of these Obama Judges. Of course, the Obama judges don’t see it that way. They are under the impression that they are the actual rulers of the United States, and that the Trump administration are the usurpers.

In his ruling Monday, Tigar stressed a “need to maintain uniform immigration policy” and found that nonprofit organizations such as Al Otro Lado don’t know where asylum seekers who enter the U.S. will end up living and making their case to remain in the country.

President Trump said he disagreed with the judge’s ruling, and the idea of single federal judges issuing nationwide injunctions in general — a phenomenon that has exploded under his administration.

It exploded because the Senate allowed these black robed tyrants onto the bench in the first place. The Supreme Court shouldn’t have to issue these rulings, slapping the lower courts down. That these judges, almost all of them Obama judges, think they are in charge should worry anyone who believes in the separation of powers under the Constitution. However, their day has arrived and the USSC is starting to take action.

The rules issued by the Trump administration in July apply to most migrants who pass through another country before reaching the United States. They target tens of thousands of Central Americans fleeing violence and poverty who travel through Mexico each month to seek asylum in the U.S. and would affect asylum seekers from Africa, Asia and South America who arrive regularly at the southern border.

And it should. If they arrive in Mexico, then they should apply there and become Mexico’s problem. Of course, Mexico hasn’t, until recently, been of much help to the United States. However, that is starting to change.

Asylum claims have spiked since 2010, and there is currently a backlog of more than 800,000 cases pending in immigration court. Most asylum claims often fail to meet this high legal standard after they are reviewed by asylum judges, and only about 20 percent of applicants are approved.

That jump in 2010, as I recall, coincided with a number of open borders groups telling illegals that if they claimed asylum, they could stay and get all sorts of nice perks at taxpayer expense. Now, the original case is back in the hands of the 9th Circuit Court, but things have changed in the last few years, and for the better for those of us who support the Constitution, the Rule of Law and individual rights.

The radical transformation of the court, which has 29 seats, is largely the result of Trump’s push to nominate conservative judges and bypass traditional consultations with Senate Democrats.

The Democrats fully intended to stop President Trump’s plans to overhaul the courts and restore the Constitution to it’s rightful place as the supreme law of the land. For decades, the 9th Circus used the Constitution as toilet paper. The Democrats put Progressives on the bench as their way of asserting total control over the slaves serfs people of America. Thanks to Dingy Harry Reid’s short term thinking and long term stupidity, he gave the current Senate Majority leader the precedent to shut down the Democrats.

Thirteen of the 29 seats are now occupied by GOP-appointed judges. Last year, that number stood at six.

“Thanks to Trump, the liberal 9th Circuit is no longer liberal,” The Washington Post noted earlier this year.

It still needs some work, along with all the other courts. The reason that President Trump has been able to appoint so many new judges can be laid at the feet of that SCoaMF, Barack Obama. He couldn’t be bothered to fill all the vacancies on the federal court.

When President Trump took office, he had a long list of qualified jurists in hand and has been appointing them to every open seat. Now, President Trump’s work is showing America some nice dividends, with the respect for the Constitution finally being restored. Now, the courts are finally focusing on America and not on other countries.
